Abstract

Penelitian ini bertujuan untuk menganalisis Asas-asas umum Pemerintahan yang Baik dalam pemeriksaan dan penegakan pelaksanaan Jabatan PPAT, serta menganalisis apakah perdamaian para pihak terkait pelapor dan terlapor (PPAT) dapat menghentikan pemeriksaan atas pengaduan pelanggaran kepada Majelis Pembina dan Pengawas PPAT Daerah. Jenis penelitian adalah penelitian yuridis normatif, yang dilatarbelakangi oleh Putusan PTUN Nomor 20/G/2020/PTUN.PBR, Putusan PTTUN Medan Nomor 10/B/2021/PTTUN-MDN, Putusan Mahkamah Agung Nomor 337/K/TUN/2021 mengenai pemeriksaan Jabatan PPAT, Majelis Hakim menyatakan bahwa MPPD harus melaksanakan pembinaan dan pengawasan sesuai Asas-asas umum Pemerintahan yang Baik. Penelitian ini dilakukan dengan menganalisis data sekunder berupa teori, konsep, asas hukum serta peraturan hukum yang berhubungan dengan pokok bahasan serta dilengkapi dengan wawancara kepada Narasumber. Hasil penelitian selanjutnya dianalisis secara kualitatif. Hasil penelitian yaitu pertama, Asas-asas umum pemerintahan yang baik (AUPB) harus konsisten diterapkan dalam pengawasan dan penegakan hukum terhadap PPAT. MPPD Rokan Hulu melanggar prinsip AUPB seperti kepatuhan hukum dan kecermatan, termasuk tidak sesuai prosedur dan mengabaikan fakta. Pembatalan tindakan MPPD oleh hakim menunjukkan perlunya perbaikan prosedur dan kepatuhan hukum. Kedua, Perdamaian antara pelapor dan terlapor diharapkan menghindari konflik berkepanjangan, namun tidak menghapus tanggung jawab hukum PPAT. MPPD harus menegakkan hukum dan mempertimbangkan perdamaian dalam menentukan sanksi, sesuai Peraturan Menteri Agraria Nomor 2 Tahun 2018. Jika MPPD merekomendasikan pemberhentian tanpa mengikuti prosedur dan mempertimbangkan perdamaian, hal ini dapat melanggar peraturan. Evaluasi tindakan MPPD diperlukan untuk memastikan keadilan dan akuntabilitas.

Abstract

This study aims to analyze the authority of the State Attorney (JPN) as a mediator in determining the amount of compensation for the construction of the Solo–Yogyakarta Toll Road, with a case study in Kalurahan T and Kalurahan M. The problem raised is the continued objections from the community to the compensation value determined by the Public Appraisal Services Office (KJPP). The type of research carried out is empirical legal research, with data collection techniques through literature studies, documentation, and interviews with related parties, including JPN, affected communities, and the land acquisition committee. The results of the study indicate that although normatively the mechanism for resolving objections to the compensation value should be through litigation, the presence of JPN as a mediator has proven effective. In Kalurahan T, mediation resulted in land classification adjustments and a fairer increase in compensation values, while in Kalurahan M, mediation increased community understanding of the basis for KJPP assessments. The effectiveness of JPN as a mediator is also reviewed based on the principle of justice, which is reflected in JPN's active involvement in bridging communication, avoiding conflict, and ensuring that the community receives fair and proportional compensation.   Penelitian ini bertujuan untuk menganalisis kewenangan Jaksa Pengacara Negara (JPN) sebagai mediator dalam penentuan besaran ganti kerugian pembangunan Jalan Tol Solo–Yogyakarta, dengan studi kasus di Kalurahan T dan Kalurahan M. Permasalahan yang diangkat adalah masih adanya keberatan dari masyarakat terhadap nilai ganti kerugian yang telah ditetapkan oleh Kantor Jasa Penilai Publik (KJPP). Jenis penelitian yang dilaksanakan adalah penelitian yuridis empiris, dengan teknik pengumpulan data melalui studi pustaka, dokumentasi, dan wawancara terhadap pihak terkait, termasuk JPN, masyarakat terdampak, dan panitia pengadaan tanah. Hasil penelitian menunjukkan bahwa meskipun secara normatif mekanisme penyelesaian keberatan terhadap nilai ganti rugi seharusnya melalui jalur litigasi, keberadaan JPN sebagai mediator terbukti efektif. Di Kalurahan T, mediasi menghasilkan penyesuaian klasifikasi tanah dan peningkatan nilai ganti rugi yang lebih adil, sedangkan di Kalurahan M, mediasi meningkatkan pemahaman masyarakat terhadap dasar penilaian KJPP. Efektivitas JPN sebagai mediator juga ditinjau dari asas keadilan, yang tercermin dalam keterlibatan aktif JPN dalam menjembatani komunikasi, menghindari konflik, dan memastikan masyarakat menerima kompensasi yang layak dan proporsional

Abstract

This research investigates the legal complexities surrounding interfaith marriages in Indonesia, particularly focusing on the concept of self-submission as outlined in the Supreme Court's fatwa Number 231/PAN/HK.05/1/2019. The study explores the validity of interfaith marriages from the perspective of Islamic, Christian, Catholic, Buddhist, Hindu, and Confucian religious laws. It also examines the role of district court judges in determining the validity of such marriages based on self-submission. The findings reveal significant disparities in legal interpretations, with judges who support the legalization of interfaith marriages considering them valid when conducted according to religious procedures that permit interfaith unions. However, judges opposing such marriages reference the prohibitions inherent in the religious laws of one of the spouses. The novelty of this research lies in its analysis of the intersections between religious law and civil law in determining the validity of interfaith marriages in Indonesia, especially the concept of self-submission. The study underscores the urgency of creating a clear, unified legal framework that addresses interfaith marriages, balancing respect for religious beliefs with the need for legal certainty. Nationally, this research contributes to ongoing debates about religious freedoms, marriage equality, and the role of the judiciary in interpreting religious norms within the broader legal system. Globally, it adds to the discourse on how countries with diverse religious populations navigate the intersection of tradition, modernity, and legal recognition of interfaith unions, offering comparative insights into the challenges faced by similar jurisdictions.

Abstract

This study aims to analyze the legal protection for victims of money laundering against the rejection of resistance to the execution of mortgage rights. The analysis was conducted against the background of the verdict of the Cibinong District Court Number 582/Pid.B/2019/PN.Cbi which ruled that one of the results of the money laundering crime in the form of SHGB No. 5993 was returned to the victim but the object of dispute was in the process of execution of a mortgage. This type of research is normative legal research. Normative research is legal research conducted by examining library materials or secondary data. The data in this research is secondary data obtained through literature study and supported by primary data obtained by interviewing sources. The data obtained in this study were analyzed using qualitative methods and then presented descriptively. The results of this study show that the creditor holding the Mortgage Rights has a separatist right guaranteed by the Mortgage Rights Act must take precedence over other creditors. Legal protection for victims of money laundering crimes against the rejection of resistance to the execution of mortgage rights is that they can file a new civil lawsuit to the district court to sue the object of the dispute by adding a new defendant so that it is not Nebis In Idem. In addition, it can be attempted in good faith to mediate between the defendant and the victim for the loss incurred. Victims of money laundering crimes can file extraordinary legal remedies, namely by reviewing the decision of the third party resistance (derden verzet). Seeking good faith towards the victim through mediation related to material damages.
