Abstract

Konflik dalam masyarakat industri sering dipandang sebagai kausa prima ketidaksetaraan sosial dan alineasi hubungan industrial antara buruh dan pengusaha. Kesenjangan tersebut telah melahirkan resistensi buruh dan sebaliknya upaya pengusaha untuk mempertahankan posisi dalam bentuk yang ekstrim. Pengaturan bentuk-bentuk ekstrim perselisihan hubungan industrial dalam Undang-Undang Ketenagakerjaan masih belum mencukupi dalam memberikan perlindungan hukum bagi para pihak yang berselisih. Hal tersebut menjadikan implementasinya menjadi bias dan rawan penyimpangan. Lembaga penyelesaian perselisihan hubungan industrial yang sudah diakomodasikan dalam instrumen hukum juga masih memiliki kelemahan untuk menjawab persoalan tersebut. Kata Kunci : Konflik dan Hubungan Industrial

Abstract

Conflict of interest between employee and employer has a complexity since its biopsychology and sosioeconomic in nature. As its implication, it is difficult to create a consensus between two different interest within a legal perspective. Justice theory by John Rawls has answered the respective problem by giving legal priority upon the group of people who have less capacity in sosial and economic. According to John Rawls, law shall give orientation toward marginalized group. In industrial relations, law shall take side upon the employee who are in subordinate position. Pertentangan kepentingan antara pekerja dan pengusaha memiliki kompleksitas karena bersifat biopsikologis dan sosio-ekonomi. Sebagai implikasinya, sulit mempertemukan dua kepentingan yang berbeda tersebut dalam satu rumusan hukum. Teori keadilan dari John Rawls telah menjawab persoalan tersebut dengan memberi prioritas hukum kepada orang-orang yang secara sosial ekonomi kurang beruntung. Hukum menurut John Rawls harus berorientasi kepada kelompok marjinal. Dalam hubungan industrial, hukum harus berpihak kepada pekerja yang berada dalam posisi subordinat.

Abstract

This research shows that several factors have caused the unavailability of worker union. The factors include the government, the companies, the laws and the workers. The government does not actively socialize and supervise worker unions. Moreover, employers prefer an unofficial worker union rather than the official one. The Indonesian Industrial Relationship Law and Worker Union Law regard worker union as a right rather than an obligation. However, the workers do not fully aware of the benefit of the union. Rather, the workers consider the requirement of providing article of association and financial autonomy as burdens in establishing the union. The condition is getting worse with the fact that the workers do not have opportunity to establish the worker union.

Abstract

This study analyzes legal protection for domestic workers in the plasma fake eyelashes industry in Kabupaten Purbalingga from a labor law perspective. The method used in this study is juridical empirical. The data used in this study consisted of primary data, secondary data. Primary data were obtained from a field study conducted in Bojongsari District and the plasma fake eyelashes industry in Purbalingga Regency. Secondary data is obtained from primary legal materials in the form of laws and regulations relevant to the topic under study. According to the employment law, the research result shows that the legal protection of homeworkers in the Plasma hair industry in Purbalingga faced a significant challenge. Although it is covered in law 13 of 2003, it does not accept the right and protection as stipulated in the law on wages, employment contracts, freedom of Union and assembly, working hours, occupational safety and health, and social security. With these issues, home workers are very vulnerable and hold poor positions; therefore, particular actions are needed to encourage the protection and fulfillment of their fundamental rights. Strategic policies need to be carried out that recognizes the existence of home workers. These policies need to be incorporated into national statistical data and legislation as an affirmative step taken by the Indonesian Government. Furthermore, the Government needs to develop home worker protection policies that include their fundamental rights. The Government needs to establish a mandatory minimum health and worker protection scheme not to be a burden

Abstract

One of the most vital industries with significant potential for development in Indonesia is the tourism industry. The current trend of the tourism industry development tends to lean towards Community-Based Tourism or CBT. Thus, the focus of this research is the legal protection of CBT workers, especially in terms of wages at Bedah Menoreh Pathway. This research aimed to collated and analyzed existing models of wages legal protection for CBT workers and compare them with Indonesian laws and regulations pertaining to Bedah Menoreh Tourism Supporting Path development. This research is empirical normative research. Analysis was conducted through systematizing and defining acquired data chronologically and on the basis of forms of legal protection as stated in laws and regulations. Based on the findings and analysis, several factors caused the absence of legal protection of CBT workers especially in terms of wages. The researcher concludes that there must be a new pattern on wages regulation mechanism that will protect tourism workers relative to the condition of this unique CBT Attraction.Keywords: Bedah Menoreh pathway, CBT Worker, legal protection, wages.

Abstract

The Employment Law, the Job Creation Law and their derivatives only provide separation pay as an obligation of the employer which must be fulfilled to the employee when terminating their employment relationship due to certain reasons, while leaving the amount to be regulated in the separate work agreement, the company regulations or the collective work agreement. The absence of authentic interpretation and provisions regarding the amount of separation pay in employment regulations in Indonesia raises problems in both the meaning and the application of the law. The questions raised in this research are whether the court decision that applies the amount of severance pay the same as the amount of reward for the fulfilled term of office is correct, and is the meaning behind setting the amount of separation pay determined in the work agreement, the company regulations, or the collective work agreement. This research aims to identify and analyze the aforementioned problems. The research method used is normative and analytical descriptive which relies on secondary data as the source. The results of the research display that, in cases where it is not regulated, the judge ultimately determines the amount of separation pay to be the same as the calculation of the gratuity for long service. This is not entirely correct because the reward for a long period of service is intended as a gratuity for years of service that has been dedicated to the company so that rational considerations are the basis for the calculation and separation money is intended more as a bond of love so that the moral dimension is stronger.Keywords: Employment Law, Implementation, Meaning, Severance Pay, Work Termination AbstrakUndang-Undang Ketenagakerjaan dan Undang-Undang Cipta Kerja beserta turunannya hanya menyatakan uang pisah sebagai kewajiban pengusaha yang harus diberikan kepada pekerja dalam pemutusan hubungan kerja dengan alasan tertentu dan menyerahkan besarannya untuk diatur dalam perjanjian kerja, peraturan perusahaan, atau perjanjian kerja bersama. Tidak adanya penafsiran otentik dan ketentuan mengenai besaran uang pisah dalam peraturan ketenagakerjaan di Indonesia membawa permasalahan dalam makna dan penerapan hukumnya. Pertanyaan yang diangkat dalam penelitian ini ialah apakah putusan pengadilan yang menerapkan besaran uang pisah sama dengan besaran uang penghargaan masa kerja sudah tepat, dan apakah makna dibalik pengaturan besaran uang pisah ditentukan dalam perjanjian kerja, peraturan perusahaan, atau perjanjian kerja bersama. Adapun tujuan dari penelitian ini ialah untuk mengetahui dan menganalisis permasalahan yang diangkat sebagaimana disebutkan. Metode penelitian yang digunakan ialah normatif dan bersifat deskriptif analitis yang mengandalkan data sekunder sebagai sumber data. Hasil penelitian menunjukkan, dalam hal tidak diatur, hakim pada akhirnya menentukan besaran uang pisah sama dengan perhitungan uang penghargaan masa kerja. Hal tersebut tidak sepenuhnya tepat karena uang penghargaan masa kerja dimaksudkan sebagai penghargaan atas masa kerja yang sudah diabdikan kepada perusahaan sehingga pertimbangan rasional menjadi dasar perhitungannya dan uang pisah lebih dimaksudkan sebagai tali kasih sehingga dimensi moral lebih kental.Kata Kunci: Hukum Ketenagakerjaan, Makna, Pemutusan Hubungan Kerja, Penerapan, Uang Pisah
