Abstract

Di Indonesia kebijakan pembayaran zakat profesi diserahkan kepada tiga lembaga yaitu Kementrian Agama, Majelis Ulama Indonesia, dan Badan Amil Zakat berdasarkan tinjauan Fikih Islam. Aturan tertulis mengenai kewajiban zakat profesi ini tertuang dalam Fatwa MUI nomor 3 tahun 2003 dan Peraturan Menteri Agama nomor 52 tahun 2014. Aturan tersebut diimplementasikan dalam pengumpulan zakat yang dilakukan oleh Badan Amil Zakat Nasional. Dengan menggunakan metode analasisis komparatif, kajian ini menemukan adanya perbedaan antara aturan pelaksanaan zakat profesi di Indonesia dengan pendapat ulama fikih secara umum pada penentuan nishab. Perbedaan tersebut terletak pada penghitungan nishab berdasarkan pendapatan dikurangi kebutuhan pokok pada pendapat para ulama fikih. Aspek inilah yang tidak diperhitungkan dalam pelaksanaan zakat profesi di Indonesia. Dengan demikian, ada potensi seorang yang belum dikategorikan wajib zakat menurut jumhur ulama fikih menjadi kategori muzakki berdasarkan fatwa MUI dan PMA. [In Indonesia, the policy of paying professional zakat is left to three institutions, namely the Ministry of Religion (KEMENAG), the Indonesian Ulema Council (MUI), and the Amil Zakat Agency (BAZNAS) based on a review of Islamic Jurisprudence. The written rules regarding professional zakat obligations are contained in the MUI Fatwa number 3 of 2003 and the Minister of Religion Regulation number 52 of 2014. These rules are implemented in the collection of zakat carried out by the National Amil Zakat Agency. By using a comparative analysis method, this study finds a difference between the rules for implementing professional zakat in Indonesia and the opinion of fiqh scholars in general in determining the nishab. The difference lies in the calculation of nishab based on income except basic needs in the opinion of fiqh scholars. This aspect is not taken into account in the implementation of professional zakat in Indonesia. Thus, there is the potential for someone who has not been categorized as obligatory for zakat according to the number of fiqh scholars to be categorized as muzakki based on the MUI and PMA fatwas.]

Abstract

Technological advances have had many positive impacts on the development of zakat management. Especially in terms of increasing transparency, accountability and service quality. These three aspects are considered to have an impact on increasing the number of muzakki in Zakat Institutions, including the National Amil Zakat Agency (BAZNAZ). This study seeks to analyze the relationship between these three aspects on the decision to become muzakki with zakat at the National Zakat Amil Agency (BAZNAS) in the Bangka Belitung Islands Province. The population of this study is 518 people, with a sample of 84 respondents. The data obtained were analyzed using multiple regression tests and hypothesis testing using SPSS version 26.0. as an analytical tool. The research results show that, partially, Transparency, Accountability and Service Quality have a significant effect on Muzakki's decision to pay zakat at BAZNAZ Bangka Belitung Islands Province. Simultaneously, these three variables also show the same results. The Study also shows that three variables contribute a portion of 10.5% factors of decision to become muzakki, while the rest are influenced by other variables not examined in this study.

Abstract

Talak merupakan salahsatu sebab terputusnya ikatan pernikahan antara suami dan istri. Syariat meletakkan hak mencerai di tangan suami. Dengan alasan lelaki lebih matang secara akal dan lebih berpandangan jauh terhadap kebaikan rumah tangga. Karena itu Syariat sangat berhati-hati agar hak talak (mencerai) tidak sembarang diucapkan. Bentuk kehati-hatian itu antara lain memberlakukan hukum talak ketika diucapkan secara bergurau (hazlan). Sementara dalam KHI, aturan dan ketentuan yang mengatur tentang talak telah menutup ruang untuk terjadinya peremehan terhadap hak talak dalam bentuk talak secara bergurau. Tahapan-tahapan perceraian dan keharusan perceraian dilakukan di hadapan Pengadilan Agama menutup kemungkinan adanya unsur bergurau dalam mencerai.

Abstract

The purpose of this research is to analyze the issue of marital rape provided in the law on the elimination of family violence - Law No. 23 of 2004th- and the draft of book of Indonesian criminal law, compared to Islamic jurisprudence through the views of scholars in the case. The research found the following results: there is difference in meaning of term of rape between Islamic jurisprudence and Indonesian Law. The term of rape in Islamic Jurisprudence formed from two elements: forbidden intercourse and coercion. While the rape in Indonesian Law is based on the absence of choice in intercourse, and its applicable to married and unmarried persons. Although the Islamic Juriprudence and Indonesian Law have same views in prohibition any actions of violence againts women, however the difference between two laws in the concept of the rape has implications in type of punishmen toward this crime.

Abstract

Local tradition in its various forms was practiced by the people of the archipelago, before the arrival of Islam. In its development there was an assimilation between local traditions and religious practices of the Muslim community in Indonesia. This study intends to reveal how the process of assimilation of local wisdom into the religious practices of Muslim communities in Indonesia, especially in Bangka Belitung. This study uses qualitative research methods with observation instruments and interviews with several informants, namely religious and community leaders. This study finds that local wisdom that is incorporated into religious practice, such as the Dambus tradition, is driven by the motivation to maintain the traditions or heritage of predecessors. On the other hand, this effort intends to show that religious values can still be practiced without having to lose identity and culture. And Based on Islamic law, this form of religious practices is not contrary with the rules dan principles of Islam.

Abstract

Setiap perintah dan larangan dalam syariat Islam mempunyai tujuan dan hikmah yang dinginkan oleh Pembuat Syariat. Ada syariat yang bersifat ma’qul makna, yaitu syariat yang hikmahnya dapat dirasio oleh pemikiran manusia. Ada juga bersifat sebaliknya ghairu ma’qul makna, seperti jumlah rakaat shalat, melempar jamarat, thawaf dan lain-lain. Pernikahan adalah syariat yang ditetapkan oleh Pembuat syariat yang bersifat ma’qul makna. Tujuan (maqasid), makna, hikmah dari pernikahan dapat dirasio oleh akal bahkan disebutkan secara eksplisit dalam ayat-ayat Al-Quran dan juga hadis Nabi Saw. Dalam kitab Ihya Ulumuddin, Imam Ghazali menerangkan tujuan-tujuan dari syariat pernikahan. Makalah ini membahas pandangan-pandangan Imam Al-Gazali terkait maqasid pernikahan, berdasarkan karyanya yaitu Kitab Ihya Ulum Al-Din. Menurut Imam Gazali maqasid pernikahan ada yaitu: mendapatkan anak, menyalurkan syahwat, mendapat ketenangan dan kegembiraan, berbagi tugas rumah tangga dan mujahadah memenuhi keperluan istri.

Abstract

Nafkah adalah salahsatu hak finansial yang ditetapkan oleh Syariat Islam yang muncul dari akad nikah yang sah. Dalam menentukan standar nafkah wajib ahli hukum Islam (fuqahā) melihat ada berbagai pertimbangan yang dapat dijadikan acuan yaitu kondisi suami (hāl az-zauj), kebutuahn atau kondisi istri (hāl az-zaujah) atau keadaan keduanya secara bersamaan. Sementara dalam hukum positif keluarga muslim Indoensia melalui Kompilasi Hukum Islam (KHI) menetapkan bahwa ketentuan standar kewajiban nafkah menyesuaikan kondisi suami. Standar nafkah dalam fiqh mengakomodir banyak sisi, sementara dalam KHI lebih sederhana karena mengambil satu pandangan fiqh saja. Ketetapan dalam KHI bahwa standar nakfah menyesuaikan kondisi suami mengadopsi pandangan mazhab jumhur fuqaha.

Abstract

Abstrak: Penelitian ini bertujuan untuk menguraikan tradisi Tangkel Bonglai yang dipraktikkan oleh sebagian masyarakat di Bangka Belitung. Tradisi tengkel bonglai dilakukan dengan meletakkan garam dan air di dekat makanan yang disajikan kepada orang-orang pada perayaan pernikahan. Tradisi ini dilakukan dengan tujuan untuk melindungi makanan agar tidak basi dan pengantin tidak mengalami hal-hal buruk. Dengan menggali informasi dari informan penelitian, data-data yang diperoleh dianalisis dengan pendekatan yuridis menggunakan al-‘urf sebagai framework analisis. Penelitian ini menyimpulkan bahwa tradisi tangkel bonglai masuk dalam kategori ‘urf fasid, karena tradisi ini diiringi dengan kepercayaan jika ditinggalkan akan menimbulkan sesuatu yang buruk. Keyakinan ini mengandung unsur syirik, karena mempercayai ada kekuatan lain, selain Allah, yang dapat memberikan manfaat dan mudharrat.

Abstract

Divorce (ṭalāq) is a husband's right to terminate a marriage, based on the Qur'an and Hadith. However, the technical procedures for pronouncing divorce—particularly when declared outside the court—are not explicitly regulated in these primary sources, leading to differing views among the public. In response, the Indonesian Council of Ulama (Majelis Ulama Indonesia, MUI) issued Fatwa No. 4 of 2012, declaring that extrajudicial divorce is religiously valid but must be verified in court proceedings, with the wife’s waiting period (iddah) calculated from the moment the husband declares the divorce. This study employs a library research method, utilizing primary legal sources such as Fatwa No. 4/2012, the Indonesian Marriage Law, and the Compilation of Islamic Law (KHI), with data collected through documentation and analyzed using descriptive analysis. The results show, first, that according to MUI's fatwa, divorce outside the court is valid under Islamic law. Second, this fatwa contradicts the formal legal system in Indonesia, particularly Article 39 of the Marriage Law and Article 115 of the KHI, both of which stipulate that divorce—whether by ṭalāq or judicial petition—must be carried out before a court session to be legally recognized. Therefore, the MUI fatwa cannot serve as a binding legal basis within the Indonesian legal framework.
