Abstract

Peace in the family (sakinah) is the hope of all couples. Creating a sakinah family is not merely the duty of a wife, but must be supported by both parties (husband and wife). Household life will also require several patterns that form the basis of a strong and harmonious family foundation. This pattern will later complement the deficiencies that should exist in the family. During the trip, many families in which there are problems, which are caused by several unfulfilled needs, instead take the way of divorce rather than maintaining family relationships.In Islamic studies literacy, forming a sakinah family can be achieved through the mawaddah and rahmah stages. Al-Razi in his commentary explains that mawaddah means jima 'and rahmah is to have children. Although now this is considered irrelevant by most people, but in an analytic-comparative way, what Al-Razi said above can be supported by a psychological perspective.Abraham Maslow, a well-known humanistic psychologist, explained that in his life, humans must meet their standard of life. There are five patterns of needs that must be met hierarchically. Among them are psychological safety, love / belonging esteem and self-actualization. These five needs will later support the actualization process in humans, as well as in pairs. If the five stages of these needs are met, then humans will get happiness and satisfaction in having a family.

Abstract

Anak (keturunan) dalam sebuah perkawinan merupakan salah satu tujuan yang diingikan semua keluarga. Namun, akan menjadi problem besar manakala seorang perempuan melahirkan anak tanpa melalui proses perkawinan yang sah atau yang populer disebut anak luar kawin. Disebut problem karena status anak tersebut dengan kedua orang tuanya menjadi absurd, terutama yang berkaitan dengan hak waris, hak perwalian, maupun hak nafaqah. Di sinilah pentingnya penelitian ini dilakukan. Penelitian ini merupakan penelitian pustaka (library research) dengan mengkaji bahan hukum primer maupun bahan hukum sekunder, kemudian menganalisanya dengan berbagai teori, doktrin, maupun asas hukum. Hasil dari penelitian ini menunjukkan bahwa dalam hukum positif, status anak luar kawin tidak hanya memiliki hubungan nasab dengan ibu dan keluarga ibunya, melainkan juga dengan laki-laki yang mengakibatkan kelahirannya, sepanjang dapat dibuktikan dengan ilmu pengetahuan dan teknologi atau alat bukti lainnya yang sah menurut hukum. Sementara dalam hukum Islam, status anak luar kawin hanya memiliki hubungan nasab, waris, dan nafaqah dengan ibu dan keluarga ibunya, hanya saja hakim selaku penegak hukum dapat menjatuhkan hukuman ta’zir kepada laki-laki yang mengakibatkan kelahiran.Keyword: Anak Luar Kawin, Hukum Positif, Hukum Islam

Abstract

Talak merupakan suatu ungkapan yang amat dibenci oleh Allah SWT,meskipun halal. Konsekuensi dari ungkapan talak tersebut ialah terputusnyahubungan perkawinan suami-istri. Dikarenakan akibat yang ditimbulkan daritalak sangat fatal bagi kehidupan pernikahan seseorang, maka munculproblematika di tengah masyarakat muslim. Sebagian kalangan yangberpedoman pada konsep fiqh menyebut bahwa talak sudah jatuh, manakalasang suami mengucapkan perkataan yang mengarah pada talak, meskipuntanpa saksi. Sementara sebagian yang lain yang berpegang pada hukumpositif di Indonesia menyatakan talak tidak akan dapat terealisasi sebelumada putusan pengadilan yang menyatakan sahnya perceraian suami-istri.Kata Kunci: Talak, Fiqh, dan Hukum Positif

Abstract

The religion of Islam is still shackled to an understanding that makes scholars afraid of doing madhzabism. The stagnation of thought has become a big problem faced by scholars. This is what makes Islam in its position is often not in harmony with modern law that is solutive. The sociological approach is no longer in line with the dynamics of society, therefore public trust in religion has been eroded and has resulted in internal Islamic political disputes that consider religion products to be very rigid in providing solutions, hence the writing of this article is more focused on the method brought by Abdullah Saeed in progressive ijtihad method where this method is felt to be very relevant to the times, this paper uses discrete analysis as a method in describing and analyzing the challenges of the progressive Islamic method in carrying out ijtihad and the results of this paper are (1) Abdullah Saeed divides into three groups: the process of interpreting the Koran; textualist group semi-textualist group Contextualist group, (2) Abdullah Saeed's method of ijtihad, who is known as a progressive Muslim, divides into three ijtihad methods which are very well known during the modernization period which he thinks are suitable in influencing the law in the future as long as the law is made:

Abstract

Pesantren merupakan tempat untuk meningkatkan dan mengembangkan pemahaman tentang ilmu agama Islam. Salah satu tugas pesantren adalah mendampingi santri agar mampu berperilaku sesuai dengan nilai-nilai dan ajaran ahlus sunnah wal jamaah. Upaya pendampingan tersebut salah satunya diwujudkan dengan melakukan pembinaan kepada santri guna meningkatkan pemahaman keluarga sakinah. Adanya pembinaan ini dimaksudkan untuk menjembatani keinginan sebagian besar santri untuk menikah setelah lulus dari pesantren dan pengetahuan mereka yang masih minim mengenai perkawinan. Pembinaan ini dilakukan dengan pola demokratis dengan pendekatan partisipatif, di mana pembina bersikap terbuka terhadap segala pendapat yang dikemukakan dan didiskusikan secara bersama-sama. Hasil dari pembinaan ini adalah bahwa untuk mewujudkan keluarga yang sakinah, maka seorang istri harus mengamalkan beberapa ajaran yang tertuang dalam kitab al-Mar’atu as-Sholehah antara lain 1). Mengkomunikasikan setiap persoalan yang muncul dengan suami, 2). Tidak boleh mencela setiap pemberian suami, 3). Tidak membanding-bandingkan suaminya dengan orang lain, 4). Tidak bersikap boros dan/atau terlalu pelit, 5). Tidak berhutang kecuali dharurat, dan sebagainya.

Abstract

It is explained in the KHI that the apostasy of the husband or wife does not cause the marriage to be annulled if the parties concerned from the wife or husband do not take the case to the Religious Court. So that if one partner does not mind if his partner lapses, then the marriage can continue. KHI mentioned the reasons for divorce. It is stated that religious conversion or apostasy that causes disharmony in the household can be used as a reason for divorce. This provision is contrary to the Imam Madzhab. The results showed that there was a difference in the case of a husband and wife who apostatized in the middle of their marriage in their legal status. In the Syafi'i school, it was clear that the marriage was canceled. However, in the Compilation of Islamic Law, it is not very clear about the phase of marriage due to apostasy. The marriage broke up due to divorce due to the absence of household harmony, not due to apostasy committed by one of the parties (husband/wife). In the Compilation of Islamic Law, there should be an additional verse that one of the reasons for the annulment of a marriage is the apostasy of one of the husbands or wives. This addition is in line with the provisions of Islamic Law, where the majority of Islamic Ulama (Imam Madzhab) are very strict about the issue of the annulment of marriages due to apostasy. So that the Indonesian Muslim community, whose majority follows the Shafi'i Madzhab, has no confusion when dealing with regulations that are not by the provisions in force in Positive Law and Islamic Law.

Abstract

Social phenomena which proves many couples have got interfaith marriage in Indonesia and other countries. In this case, interfaith marriage is a marriage of a man of Muslim with non-Muslim women or otherwise, marriage the women of Muslim with male non-Muslim. Therefore, it is necessary for a comprehensive explanation about the law of interfaith marriage. Interfaith marriage in al-Quran and Sunnah can be classified into three, first, the marriage of men of Muslim with the polytheists (musyrikah) women, within the merriage of male of Muslim with polytheists women are disagreement about the law, Ibn Jarir al-Tabari permit the marriage of this category on condition that the polytheistic woman came from the non-Arabs nation’s which have a holy book or the bible, should be married by men of Muslim. Second, the marriage of men of Muslim with women Ahl al-Kitab (kitabiyyah). In this case the majority of ulama get argue that married to of kitabiyah women (Jewish and Christian faiths, either dhimmi or harbi) is permissible. And, third, the marriage of women of Muslim with a male of non-Muslim, whether the merriage to polytheistic or Ahl al-Kitab (kitabi) which in this case is based on the consensus among ulama of islamic jurisprudence (fiqh) that marriage with this category is haraam, whether the male non-Muslim kitabi classified or not.
