Abstract

This study examines the contribution of Imam Al-Shafi'i in positioning the basis of the teori of the verification of hadith in Al-Risalah. The purpose of this paper is to reveal the role of Imam Al-Shafi'i in positioning the accepted standard and the absence of a hadith as a source of Islamic law. The process of data collection is done by examining the theories of hadith submitted by Al-Shafi'i in the book Al-Risalah and displays the analysis of the scholars who commented on the book Al-Risalah. The result of the analysis raises several theories of hadith verification from al-Shaafi'i; i.e. he explained that Hadith must fulfill certain criteria so that it can be accepted or not. Al-Shafi'i also explained the rules on the differences found in Hadith both in terms of text and history, how the law in a hadith can be replaced by another hadith. In addition, Al-Shafi'i made a clear boundary between Hadith, Sunnah and qawl his companions and his position in the excavation of law which is also called Khabar, Akhbâr, Riwâyah, Atsar. This study is very useful for researchers thought Imam al-Shafi'i to be more intact in understanding the contribution of Al-Shafi'i, not only the theory of Usul Fikih and Fikih, but also in the fundamentals of the theory of hadith verification.

Abstract

Penelitian ini bertujuan untuk mengatahui praktik dan tata cara penyerahan separuh mahar saat akad nikah dalam tradisi Masyarakat Ramong (Thailand Selatan), dan untuk mengatahui Hukum tradisi penyerahan separuh mahar saat akad nikah di Masyarakat Ramong (Thailand Selatan). Jenis penelitian ini adalah penelitian lapangan menggunakan pendekatan kualitatif. Dengan mengambil sumber data secara online dari masyarakat di Ramong sebagai sumber data ini. Hasil penelitian ini ditemui bahwasanya praktik dan tata cara penyerahan separuh mahar saat akad nikah di Masyarakat Ramong Thailand Selatan yaitu bahwa separuh mahar diserahkan ketika berlangsung akad nikah. Namun dari mempelai laki-laki kepada mempelai perempuan yang dilakukan ketika berlangsung akad nikah dan separuh lagi setelah akat nikah. Tradisi yang telah berlaku di masyarakat memang sudah sejak lama berkembang, bagaimanapun bentuknya itu telah diterima dan dilakukan oleh masyarakat. Pemberian separuh maharnya di masyarakat Ramong ialah bisa memberi separuhnya dan separuh lagi memberinya setelah akat nikah tapi harus ada janjian pembayaran. Dan saparuh maharnya lagi bisa digantikan dengan barang tapi harus disetujui sebelah pihak perempuan juga, dikarenakan takut salah paham ataupun menjadi permasalahan. Abstract This study aims to determine the practice and procedure for handing over half of the dowry during the marriage contract in the Ramong Community tradition (Southern Thailand), and to determine the Law of the tradition of handing over half of the dowry during the marriage contract in the Ramong Community (Southern Thailand). This type of research is field research using a qualitative approach. By taking online data sources from the community in Ramong as the source of this data. The results of this study found that the practice and procedure for handing over half of the dowry during the marriage contract in the Ramong Community of Southern Thailand is that half of the dowry is handed over when the marriage contract takes place. However, from the groom to the bride which is done when the marriage contract takes place and the other half after the marriage contract. The tradition that has been in place in society has indeed developed for a long time, whatever its form has been accepted and carried out by society. The giving of half of the dowry in the Ramong community is that half can be given and the other half given after the marriage contract but there must be a payment agreement. And the other half of the dowry can be replaced with goods but must be approved by the woman too, because of fear of misunderstanding or becoming a problem.

Abstract

The results of this research are: Judging from the Syafi'i madzhab fiqh related to the contents of the decision in case Number 1835/Pdt.G/2023/PA.Mr which includes child support and implementing the policy in article 14 of the Supreme Court Circular Letter Number 3 of 2015 regarding increases child support is 10% per year of the specified amount excluding education and health costs, which is not in accordance with the theory of fiqh of the Syafi'i school of thought. In the Syafi'i school of fiqh there is no special provision that regulates the increase in the amount of child support by 10% every year after divorce. The child support decision in case Number 1835/Pdt.G/2023/PA.Mr, which experienced an increase of 10% per year in long-term calculations, is increasingly increasing and making it difficult for the father's economy to meet the child's support demands.

Abstract

Penelitian ini dilakukan bertujuan untuk mengetahui bagaimana kawin paksa yang terjadi di desa Mandala Kecamatan Rubaru Kabupaten Sumenep, serta mengetahui bagaimana perspektif Husein Muhammad terhadap kawin paksa yang terjadi di desa Mandala kecamatan Rubaru kabupaten Sumenep. Penelitian ini berjenis penelitian lapangan (field reserch) dengan menggunakan pendekatan kualitatif, dimana penelitian dilakukan berdasarkan objek alamiah yang datanya didapat dari tempat kejadian. Teknik pengumpulan data yang digunakan berupa observasi, wawancara dan dokumentasi. Adapun hasil penelitian ini adalah masih terdapat beberapa perkawinan paksa yang terjadi di desa Mandala, dan diantaranya kawin paksa ini terjadi karena disebabkan oleh faktor kekerabatan, faktor ekonomi serta keyakinan orang tua terhadap calon pilihannya. Secara hasil akhir dalam perspektif Husein Muhammad praktik kawin paksa tersebut tidak sesuai dengan hukum Islam, karena terdapat unsur paksaan di dalamnya. Menurut Husein Muhammad perkawinan atas dasar pemaksaan memuat pertentangan dengan kesetaraan dan keadilan gender dengan kata lain, praktek tersebut dipandang sebagai perampasan hak perempuan.
