Abstract

Dalam sistem administrasi negara modern sudah tidak perlu lagi mempertahankan pemerintahan desa sebagaimana sekarang karena sudah sangat ketinggalan zaman. Hasil Sensus Penduduk 2010, penduduk yang tinggal di perdesaan tinggal 51 persen. Tren tersebut akan terus berlanjut sehingga pada tahun 2025 penduduk desa tinggal 30 %. Untuk itu, pemerintahan paling rendah di desa yang diperlukan bangsa Indonesia adalah daerah otonom yang bersifat perdesaan yang modern. Daerah otonom perdesaan yang ada sekarang yaitu kabupaten yang dibedakan dalam kelembagaan dan anggaran dengan pemerintah kota tidak pernah digagas oleh founding fathers dan diatur dalam UUD 1945 asli. Founding fathersdan UUD 1945 asli pasal 18 dan Penjelasannya hanya akan membentuk daerah otonom besar dan daerah otonom kecil dimana daerah otonom kecil di dalamnya termasuk desa/ negari/dusun/ marga, dan lain-lain. Abstract

The local government is part of a national government empowered to regulate and administergovernmental affairs entrusted to her. Therefore, between central and local governments have asystemic relationship between sub-systems so as to form an integral system of government. Therelationship between central and local governments is determined in its oversight system that rests ontwo bases: hierarchical and functional. Base hierarchy to determine the extent to which higherauthority overseeing the local government while the functional basis to determine the extent to whichfunctional departments / sectoral and local government departments overseeing general. Based on thissurveillance pattern then there are four models of relationships referred to by the countries in thisworld with many variants. Four models are models of French, British model, German model, andmodel of the Soviet Union. Indonesia's New Order embraced the French model, while at theReformation Orde more embracing German model

Abstract

This research was conducted to analyze the implementation of adequate health access in the Class II A Padang Correctional Institution from a Human Rights (HR) perspective. The study employed a qualitative research method with a descriptive-analytical approach. The results indicate that the provision of health services in the Class II A Padang Correctional Institution has not been guided by HR principles and Human Rights-Based Public Service Standards (P2HAM). Limitations in human resources, inadequate medical facilities and infrastructure, especially for pregnant and breastfeeding women and children, as well as a lack of effective regulations in the application of health standards, are the main factors hindering the fulfillment of health rights for inmates. Furthermore, strengthening regulations and oversight from the authorities is also an essential factor in ensuring that the health rights of inmates can be optimally fulfilled in the Correctional Institution to realize a more humane and just correctional system.
