Abstract

There are unwritten rules in society called customary law. The customary law sometimes conflict to the rules of religious. Moreover Muslim not to be involved in acts that are prohibited by the religion of Islam. The custom rules need to be analyzed through consideration of Islamic law which is a method of 'al-'Urf' by conducting to 'as-maslahah mursalah', so that the benefit of religion, life, property, descendent, and intellect maintained properly. This 'aqly' proposition is very useful for people who still impose customs rules that seemed to be obeyed. A good thing is not necessarily true yet according to Islam and the thruth is not conflict with the Qur'an and the Hadith of the Prophet as well as maqashid and asy-syari'ah.

Abstract

Essentially divorced may, but shall not home when going without seeing the considerations, therefore, to neutralize the arbitrariness of the divorce. It is necessary to take care of that institution. In this paper will divorce issues before the court in terms of (1) juridiction; (2) normative (QUr'an and Hadith); (3) ushul fiqh (maqashid al Shar'ie and aslahah mursalah); (4) positive and negative impacts of divorce in court.

Abstract

God created creatures called Umm, the Indonesian people call with a call mom, mother, ummi, mama, and so forth. The phrase was only given to women who become and serve someone who is highly respected and cherished because they are given the responsibility by Allah to pregnancy, childbirth, breastfeeding, and also education. Dignity of a mother is very high compared to the other. A heavy resposibility in the form of right and obligations of the mother is what should be understood. So that a child can position the mother in the correct position and is more than the father. It has been explained that the mother is the women who gave bisrt. Therefore the position of the mother is high and mother very broad meaning very large so it's natural rights are required to worship him.

Abstract

Perkawinan Sistem semendo adalah perkawinan dengan menjadikan seorang laki-laki sebagai menantu dan ahli waris baginya dan laki-laki ini tidak memberikan jujur kepada pihak mempelai perempuan bahkan dia adalah penerima jujur. Anak keturunan dari sistem semnedo ini masuk kekerabatan istri dan sibapak tidak mempunyai kekuasaan apaun baik dalam harta maupun terhadap anak-anaknya. Posisi isteri lebih tinggi dari suami sehingga isteri mempunyai kuasa atas segalanya. Suami yang telah menjalankan kewajiban nafkah bagi keluarganya dan dijadikan hanya sebagai tameng dan simbol kepemimpinan dalam rumah tangganya tidak sejalan dengan maqᾶshid as-syarῐ’ah dan mengabaikan al-’urf al-shῐhah. Dalam teori hak dan kewajiban suami dijelaskan bahwa apa yang menjadi kewajiban suami merupakan hak istri dan apa yang menjadi kewajiban istri merupakan hak suami. Memberikan nafkah pada keluarga adalah kewajiban suami dan mendapatkan nafkah dari suami merupakan hak isteri. jika seorang suami telah memenuhi kewajiban nafkah bagi keluarganya, maka suami berhak menjadi pemimpin yang mempunyai otoritas.
