Abstract

Abstract: The results of the study done in the Correctional Institution conducted by the Center of the Study and Development of Kemenkumham Policy for 3 months (4 May-6 August 2009) in 6 Provinces throughout Indonesia, found that the deviation of prisoners' sexual behavior varies greatly from object to object. The study was conducted to 326 prisoners, 108 respondents consisting of Head of Prison, Head of Coaching, Head of Security and discipline, head of coaching and education, and Guardian Prisoners, and 22 people including prisoners' families showed the results: 81 percent or 264 prisoners said they felt uncomfortable when their biological needs are not fulfilled. There are 78 percent or 244 prisoners often fantasize sex, 171 prisoners or 57 percent masturbate and 52 percent or 169 prisoners conduct deviant sexual activities. The above problems show a very different situation from the good and ideals objectives initiated by Sahardjo since the beginning of the establishment of Correctional institution as an institution of guidance, ethics and honor. The two cases above have shown enough that sexual deviations that occur in prisons are in a very alarming stage. Given that the main correctional function is as a process of fostering prisoners when reintegrating with social societies The research method uses doctrinal research methods, which are preliminary studies using a literary approach, in the form of secondary data consisting of primary, secondary and tertiary legal materials. The author finds facts of sexual deviation and the concept of sexual rights in a Human Right perspective, the author argues that reformulation of the provision of romance as an effort to fulfill the sexual needs of prisoners 'rights, the state must fulfill and protect it in the context of prisoners' protection. Reformulation in question without the need to change Law No. 12 year 1999 as the basis of the arrangement, because if the choice is taken as we can understand together that normatively legal politics requires a long time and process. Reformulation of the provision of romance spaces in correctional institutions can use the choice of legal products of Government Regulation as stated in Article 14 verse (2) of Law No. 12 year 1995.Keywords: Romance Room, Sexual Rights Needs, Prisoners.

Abstract

Abstract: The national development scenarios which tend to focus on the economic interest, especially in the raw material manufacturing and high technology industries, caused the agricultural sector as the neglected raw material.Accelerating development through industrial development scenarios without strengthening the agricultural sector is easily slumped and difficult to recover. The problems that arise are the increasing demand for food due to the increase of population, the narrowing of agricultural land ownership due to land conversion, and the processing of land that is not environmentally knowledgeable. Development of agricultural sector should be integrative through empowerment, agrarian reform, and food sovereignty agenda in the framework of spatial structuring of rural areas based on the protection of sustainable agricultural land. This agricultural development agenda contains the meaning that government regulates the policies to protect the independence of individuals and communities that have local wisdom to rebuild food selfsufficiencyand sovereignty, so that national development leads to the welfare of society as a whole. The need for harmonization of the regulation is done by integrating the necessity of sustainable agricultural landprotection, the protection and empowerment of farmers, the agenda of food sovereignty into integrated spatial arrangement planning, finally the land needs are met and the farms become sustainable, independent and prosperous farmers, national food needs are met and Indonesia is a sovereign food country.Keywords: harmonization, spatial arrangement, protection of sustaibaility

Abstract

Abstract: This study aims to describe the efforts to reestablish the relations between the State and indigenous peoples in the protection of indigenous peoples. The benefits of this study are expected to be used by interested parties to formulate policy options in the protection of indigenous peoples through the establishment of Regional Regulations. This study uses a combination of empirical and normative juridical approaches. An empirical juridical approach is an approach used to view social phenomena related to law and its practice. Normative juridical approach is an approach that uses secondary data in the form of primary, secondary and tertiary legal materials. The results of this study show that: First, As long as there are no laws that specifically regulate indigenous peoples, the regulation of indigenous peoples through Government Regulations and Regional Regulations can be justified to fill the legal vacuum to ensure fair legal certainty; Second, the legal product of Lebong Regency Regional Regulation No. 4 of 2017 concerning to Recognition and Protection of Rejang Indigenous Peoples in Lebong Regency, and Rejang Lebong Regency Regional Regulation No. 5 of 2018 concerning to Recognition and Protection of Indigenous Peoples in Rejang Lebong Regency is a role model of how local government efforts in reestablish state and indigenous peoples relations to solve structural agrarian problems by recognizing territories along with traditional rights of Rejang indigenous peoples through legal politics of recognition and the protection of indigenous peoples by establishing regional regulations.  Keywords: Agrarian Reform; Relations; State; Indigenous People;

Abstract

The main of this research is the first to know and understand the space setting of farms areas in Central Bengkulu regency. The second is to know and understand the farmers’ rights covering for the farmlands in Central Bengkulu regency. The sample of this research is 10% people whose taken purposively from 16 villages who settled in Central Bengkulu regency. For this purpose, it was used empiric juridis approach, meanwhile the technique of collecting the data used was the literature review study and field study with using the instrument of structured interview, direct observation and questionnaire. The result of the research were, the first is the space setting of farm areas in Central Bengkulu regency is as the farm of space setting of centred village, where the people gathered in one place so all of facilities, whether settlement, public facilities, rice field and farm areas are centred. The second, the covering of farmers’ rights for the farm lands in Central Bengkulu regency is not sufficiently available, it was proved that there was none of villages as the sample which regulates the space setting of farm areas and the coverage of mers’ rights trough the intrument of village’s regulation

Abstract

ABSTRAKPemerintah Daerah Kabupaten Rejang Lebong telah menerbitkan Peraturan Daerah No. 5 Tahun 2018 tentang Pengakuan dan Perlindungan Masyarakat Hukum Adat di Kabupaten Rejang Lebong. Penelitian ini dilakukan untuk mendeskripsikan siapa unit sosial yang diakui dan apa fungsi peraturan dearah tersebut bagi perlindungan wilayah adat. Penelitian ini menggunakan metode pendekatan yuridis normatif, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan kepustakaan atau data sekunder. Hasil penelitian ini menunjukkan kesimpulan bahwa: Pertama: Kutei adalah unit sosial asli yang diakui dalam Peraturan Daerah No. 5 Tahun 2018 tentang Pengakuan dan Perlindungan Masyarakat Hukum Adat di Kabupaten Rejang Lebong, pengakuan tersebut adalah pengakuan kutei sebagai subyek hukum dan dapat dibebani hak dan kewajiban. Kedua: Peraturan daerah tersebut berfungsi juga untuk melindungi wilayah adat mereka karena menyebutkan kewajiban dari masyarakat hukum adat untuk menjaga kelestarian lingkungan hidup dan sumber daya alam secara berkelanjutan sebagaimana telah diatur dalam hukum adat rejang.Kata kunci: masyarakat hukum adat; pengakuan; perlindungan.ABSTRACTRejang Lebong Regency Government has issued Regional Regulation No. 5 of 2018 concerning Recognition and Protection of Customary Law Communities in Rejang Lebong Regency. The results of this study indicate the conclusion that: First: Kutei is an original social unit that is recognized in Regional Regulation No. 5 of 2018 concerning Recognition and Protection of Customary Law Communities in Rejang Lebong Regency, the recognition is recognition of kutei as a legal subject and can be burdened with rights and obligations. Second: The regional regulation also functions to protect their customary territories because it states the obligations of indigenous and tribal peoples to preserve the environment and natural resources in a sustainable manner as stipulated in the customary law of the rejang.Keywords: indigenous peoples; recognition; protection.

Abstract

The Child Protection Act has given severe sanctions to perpetrators of sexual intercourse and obscene acts as regulated in Article 81 and Article 82 of the Child Protection Law with a minimum penalty of 5 years and a maximum of 15 years in prison. This study aims to determine whether the behavior of the victim's child is considered by the judge in passing a verdict on the perpetrator of sexual intercourse/obscenity and what is the basis for the judge's authority to decide cases based on the provisions of the law. The method used in this study is a normative legal research method (juridical normative) using a statute approach, a conceptual approach, and a case approach. The results of the study show that the behavior of the victim's child becomes the judge's consideration in deciding on the perpetrator. If the victim can prove that the child knows that intercourse is prohibited, and there is no attempt to refuse and continue to do, even accept something from the perpetrator, the judge will give a lighter sentence to the perpetrator of sexual intercourse/obscenity, not by the provisions of Articles 81 and 82 of Child Protection, which is at least 5 years in prison. The judge's authority to decide cases of criminal acts of sexual intercourse or obscenity based on the provisions of the law is regulated in Article 24 paragraph (1) of the 1945 Constitution in conjunction with Article 1 paragraph (1) of Law Number 48 of 2009 concerning Judicial Power which states that judges have the freedom to implement justice for the sake of law and justice.
