Abstract

Sejak diberlakukannya Kebijakan Bebas Visa Kunjungan bagi Orang Asing yang awalnya untuk meningkatkan inventasi di Indonesia rupanya dimanfaatkan pula oleh oknum orang asing lainnya untuk bekerja di Indonesia tanpa melalui prosedur resmi sehingga tidak hanya menjadi masalah pada tugas dan fungsi Direktorat Jenderal Imigrasi sebagai leading sector dalam penanganan orang asing namun berdampak pula pada Warga Negara Indonesia yang akan mencari kerja di Indonesia. Tulisan ini bertujuan mengetahui penyebab Orang Asing bekerja secara nonprosedural di Indonesia dan upaya Petugas Imigrasi terhadap keberadaan dan kegiatan Warga Negara Asing yang bekerja secara nonprosedural di Indonesia. Penelitian ini bersifat deskriptif-analitis dengan menggunakan metode kualitatif dan kuantitatif. Hasil penelitian menunjukkan bahwa keberadaan regulasi terutama Kebijakan Bebas Visa Kunjungan (BVK) menjadi faktor dominan maraknya Orang Asing bekerja secara nonprosedural di Indonesia sehingga perlu dilakukan evaluasi terhadap aturan tersebut secara menyeluruh dengan melibatkan seluruh pemangku kepentingan terkait. Peran vital Direktorat Jenderal Imigrasi dalam mengelola perlintasan manusia baik ke dalam maupun keluar Indonesia perlu didukung oleh penguatan sumber daya manusia serta sarana-prasarana yang memadai. Paralel dengan hal tersebut, peran vital Kementerian Ketenagakerjaan dalam melakukan pengawasan dan penindakan terhadap perusahaan pun harus didukung dengan penguatan yang sama, terutama bagi petugas pengawas ketenagakerjaan. Penguatan payung hukum dan kelembagaan Tim Pengawasan Orang Asing (Timpora) juga menjadi salah satu bahan masukan yang penting mengingat pengawasan yang efektif terhadap orang asing di Indonesia mensyaratkan satu pendekatan yang holistik dan kerjasama yang padu antar pemangku kepentingan didalamnya.

Abstract

The policy of using passenger name records (PNR) at immigration checkpoints is one-way immigration authorities try to enforce the law and protect state security. This is done by exchanging passenger data in the Passenger Analyzing Unit (PAU) system owned by the Directorate General of Customs and Excise with immigration data in the Immigration Management Information System (SIMKIM) and dealing with suspected lawbreakers at the border. This paper uses a qualitative method and descriptive analysis to look at the policy of using PNR to control immigration as much as possible. The analysis results show that the proposed approach still needs help. For example, there are no rules about how the officers and workers of the Directorate General of Immigration and the Directorate General of Customs and Excise should do their jobs. Second, although the existing infrastructure does not meet established standards, it is still transportable. Thirdly, the data exchange collaboration agreement between the Directorate General of Immigration and the Directorate of Customs has not been formalized. Fourth, no authorized official or officer can manage and analyze PNR data. Therefore, the Director General of Immigration recommended overcoming various obstacles, including integrating the PNR system from Customs and Excises and Airline and Border Control Management (BCM).

Abstract

Since the enactment of Law Number 16 of 2011 concerning Legal Aid, the practice of legal aid services still has several problems including not being able to reach all districts/cities due to the limited number of Legal Aid Organizations that can provide services. This paper aims to describe the implementation of legal aid services and analyze optimal strategies in improving the quality of legal aid services. This study used two approaches, qualitative and quantitative or commonly referred to as the Mix Method. Data collection methods used in this study are surveys, interviews and document studies. The results of the study show that the quality of legal aid services as a manifestation of access to justice can be said to be very good by referring to the results of the assessment on the performance of legal aid organization units and the quality of litigation and non-litigation legal aid services. However, several aspects need attention, namely the information aspects in litigation services and the procedural aspects of non-litigation services.   Guided by the results of the study, a strategy is needed to improve the quality of legal aid organization services by increasing access to information to service recipients. Legal Aid providers can use online surveys in evaluating the implementation of legal aid services throughout Indonesia. This strategy is the right step, effective, efficient and in accordance with the pandemic conditions and technological advances.
