Abstract

ABSTRAKMasyarakat Gayo di Kabupaten Aceh Tengah melalui lembaga adat Sarak Opat yang terdiri dari Reje, Imem, Petue dan Rayat menyelesaikan permasalahan yang terjadi dalam masyarakat. Tujuan penelitian ini adalah untuk mengetahui bagaimana penyelesaian perkara pidana oleh lembaga adat Sarak Opat dan faktor-faktor apa saja yang menyebabkan sebagian masyarakat memilih menyelesaikan perkara pidana melalui perangkat adat Sarak Opat. Penelitian ini menggunakan pendekatan deskriptif kualitatif, dimana hasil penelaahan kepustakaan dan penelitian lapangan dianalisis dan kemudian diuraikan dalam sebuah tulisan. Hasil penelitian menunjukan bahwa penyelesaian perkara pidana oleh perangkat adat sarak opat dimulai dari pihak yang bersangkutan melaporkan pada aparat kampung, kemudian Kepala Kampung memanggil sarak opat, untuk menyelidiki dan melakukan musyawarah penyelesaian terhadap perselisihan/sengketa pidana yang terjadi, faktor masyarakat memilih menyelesaikan perkara pidana melalui lembaga adat sarak opat diantaranya adanya rasa patuh dan penghormatan pada pemimpin, adanya rasa kekeluargaan dan biaya terjangkau dari segi ekonomi.ABSTRACTThe Gayo community in Central Aceh Regency through the Sarak Opat customary institution consisting of Reje, Imem, Petue and Rayat resolves problems that occur in society. The purpose of this research is to find out how the settlement of criminal cases by the Sarak Opat customary institution and what factors cause some people to choose to settle criminal cases through the Sarak Opat traditional apparatus. This research uses a qualitative descriptive approach, where the results of the literature review and field research are analyzed and then described in a paper. The results showed that the settlement of criminal cases by the traditional Sarak Opat apparatus started from the party concerned reporting to the village officials, then the Village Head summoned the Sarak Opat, to investigate and carry out deliberations to resolve criminal disputes / disputes that occurred, community factors chose to settle criminal cases through Sarak Opat traditional institutions include a sense of obedience and respect for leaders, a sense of kinship and affordable costs from an economic perspective.

Abstract

Law No. 12 of 1995 article 14 (1) concerning correction which in Letter (d) states that prisioners receive healt services and proper food. Inadequate health services are one of the impacts that can be felt by the inmates of the class II B Takengon Prison, which affect prisoners’ health. In this study, the author discussed the way on how prosiners’ health has been implemented in class II B Takengon prison. This study used an empirical legal research method which tried to explain fact in the field through interviews or direct observation. This study aimed to find out how the implementations of health services for inmates in Class II B Takengon Prison. The result showed that the implementation of health services for the inmates in the Class II B Takengon Prison is not optimal due to the lack of healthcare workers such as dentists and slow process of fund disbursement which affects the limitation of medicine availability as well as inadequate health facilities. It can be concluded that the implementation of health services for inmates in the Class II B Takengon is not optimal and the facilities is inadequate. The researcher suggests that Takengon prison should improve health services and add more health facilities.
