Abstract

In the sale of apartment, developer can carry out marketing before the construction are done or commonly called Pre Project Selling system, the selling and buying must be written in the form of Sales and Purchase Agreement. To do sales by pre project selling, developer must to fulfill administrative requirements, one of which is Building Permits. Moreover, because the selling and buying must be written in the form of Sales and Purchase Agreement, one of requirements to get Sales and Purchase Agreement is to have building permits. In the construction of apartment developers also must have building permits of apartment which is given from regional government. But in reality, there are still project of apartement construction doesn’t have building permits, for example 45 Antasari  Apartment. Building permits are necessary to ensure legal certainty of a building. Therefore, responsibility of developer is necessary if he neglect one’s duties. By analysis the author suggest the responsibilities of developer can be interpreted more, which will be further analysis using the normative legal research by examining primary and secondary legal materials that have been collected and processed for the formulation of research conclusions.

Abstract

Inheritance Certificate is a document that proves who is entitled to inherit from the heir, so that there is no doubt or dispute over the inheritance information, it is important to know who is authorized to make the Inheritance Statement. The mechanism of the certificate of inheritance issued by the Lurah based on the Regulation of the Minister of Agrarian Affairs Number 3 of 1997 concerning the Provisions of PP No: 24 of 1997 concerning Land Registration Article 111 paragraph (1) letter c of Making Inheritance Certificate (SKW). This type of research is normative legal research that uses legal and conceptual approaches. This study used primary and secondary legal sources. This is also written and considered to answer questions to clarify the authority of the Lurah in making the inheritance of Indonesian citizens of Chinese descent. The results show that the authority of the Lurah in making SKW for Indonesian citizens of Chinese descent is only regulated in the Implementation of Article 111 paragraph 1 letter c number 4. the legal consequences of the inheritance certificate made by the Lurah against Indonesian citizens of Chinese descent are null and void, and in making SKW in Kelurahan Indonesian citizens of descent, they must refer to Article 111 paragraph 1 letter c number 4 of the Regulation of the Minister of Agrarian Affairs and Spatial Planning.

Abstract

Currently, there are still many overlapping land title certificates. Many court decisions attempt to guarantee legal certainty. However, one court decision is certainly not enough to accommodate all the rights owned by both parties in a land dispute, considering that in civil decisions related to land, someone wins or someone loses or the lawsuit is only partially granted, or the lawsuit cannot be accepted. So in efforts to resolve a land dispute, there are various options for legal resolution of the case, namely checking the validity of the two certificates to the National Land Agency (BPN), administrative resolution of National Land Agency’s responsibilities to the Administrative Court, civil action, or criminal action to District Court, as well as efforts to resolve disputes between the parties to the District Court from the first level to judicial review. This research aims to gain an understanding of what rights the parties have in resolving overlapping land title certificate disputes. The research method used is normative legal research, the results of the research show that there is still a lack of role and responsibility for BPN in resolving disputes.

Abstract

Menyimpan dan memelihara protokol notaris harus harus sesuai dengan peraturan yang berlaku. Penyimpanan protokol notaris pada cloud storage dalam konsep cyber notary sangat dimungkinkan sebagai solusi permasalahan keamanan, biaya perawatan, dan luasnya lahan yang diperlukan. Naumn dalam Pasal 16 ayat (1) huruf b Undang-Undang Jabatan Notaris Perubahan (UUJN Perubahan) hanya menetapkan mengenai kewajiban notaris dalam menjalankan jabatannya membuat akta dalam bentuk minuta akta dan menyimpannya sebagai bagian dari protokol notaris dalam bentuk aslinya untuk menjaga keotentikan akta, hal ini menimbulkan kekosongan norma dalam penyimpanan protokol notaris pada cloud storage. Berdasarkan hal tersebut maka tujuan penelitian ini untuk mengetahui bagaimana urgensi, kepastian hukum dan tanggungjawab hukum notaris terhadap penyimpanan protokol Notaris Pada Cloud Storage dalam kaitan Cyber Notary. Tesis ini memakai jenis penelitian hukum normatif dengan penelitian yang didasari dari adanya kekosongan norma. Teknik pengumpulan bahan hukum yang digunakan adalah teknik studi pustaka dengan sistem kartu. Analisis bahan hukum dilakukan dengan menggambarkan apa yang menjadi masalah (deskripsi), menjelaskan masalah (eksplanasi), mengkaji permasalahan dari bahan hukum yang terkait (evaluasi) dan memberikan argumentasi dari hasil evaluasi tersebut, sehingga diperoleh kesimpulan mengenai persoalan yang dibahas. Hasil penelitian menunjukkan bahwa penyimpanan protokol notaris secara elektronik pada cloud storage penting dilakukan terkait tugas notaris sebagai pejabat umum, sehingga negara harus memberikan kepastian hukum akan hal tersebut dengan membuat aturan yang tegas dan jelas terkait penyimpanan protokol notaris pada cloud storage. Mekanisme yang dilakukan adalah dengan menggunakan proses alih media menjadi bentuk digital atau scanning. Pertanggungjawaban notaris terkait protokol notaris yang dialihmediakan dan disimpan dalam cloud storage sama seperti tanggungjawab terhadap protokol notaris yang disimpan secara konvensional.

Abstract

Penelitian ini mengkaji perlindungan hukum bagi pihak ketiga dalam sengketa terkait akta autentik yang dibuat oleh notaris, dengan fokus pada analisis tanggung jawab hukum notaris. Akta autentik memiliki kekuatan pembuktian yang sempurna di hadapan hukum, namun dalam praktiknya sering terjadi permasalahan, terutama ketika akta tersebut tidak mencerminkan fakta sebenarnya atau bahkan dipalsukan. Akibatnya, pihak ketiga yang berkepentingan, seperti ahli waris atau kreditur, dapat dirugikan. Berdasarkan Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris beserta perubahannya dalam Undang-Undang Nomor 2 Tahun 2014, notaris memiliki tanggung jawab untuk memastikan keabsahan dan keakuratan informasi dalam akta yang dibuatnya. Penelitian ini menggunakan pendekatan yuridis normatif dengan analisis terhadap kasus-kasus terkait tanggung jawab notaris dalam pembuatan akta autentik. Hasil penelitian menunjukkan bahwa terdapat celah dalam pengawasan terhadap notaris dan bahwa peraturan yang ada masih memerlukan perbaikan agar lebih efektif dalam melindungi hak pihak ketiga.

Abstract

Penelitian ini bertujuan untuk menganalisis penerapan iktikad baik dalam perjanjian kredit, khususnya dalam konteks kredit macet, serta implikasinya terhadap perlindungan hukum bagi kreditur. Iktikad baik merupakan prinsip dasar dalam hukum kontrak yang menuntut setiap pihak untuk bertindak dengan itikad yang jujur dan adil, baik dalam pelaksanaan kewajiban maupun dalam menyelesaikan perselisihan. Namun, dalam praktiknya, sering kali terjadi penyalahgunaan prinsip ini, terutama dalam kasus kredit macet, yang dapat merugikan pihak kreditur. Penelitian ini mengangkat dua rumusan masalah utama: pertama, bagaimana pengertian dan penerapan iktikad baik dalam perjanjian kredit yang melibatkan kredit macet, dan kedua, bagaimana prinsip iktikad baik mempengaruhi perlindungan hukum terhadap kreditur dalam kasus tersebut. Metode penelitian yang digunakan adalah yuridis normatif, dengan pendekatan peraturan perundang-undangan. Data yang dikumpulkan berupa bahan hukum primer, sekunder, dan tersier yang dikaji secara mendalam untuk memperoleh pemahaman yang komprehensif mengenai implementasi iktikad baik dalam kasus kredit macet. Kesimpulan dari penelitian ini adalah bahwa penerapan iktikad baik sangat penting untuk melindungi hak-hak kreditur, terutama dalam menghindari terjadinya penundaan yang merugikan dalam eksekusi hak tanggungan, dan bahwa tindakan hukum yang tidak berdasarkan iktikad baik dapat menambah kompleksitas penyelesaian sengketa dalam kredit macet.

Abstract

Land sales and purchase agreements are one of the most common transactions in daily life. An important element in this agreement is the measurement of the land being sold. However, measurement errors in land sale transactions often occur, which can lead to significant legal consequences for the parties involved. Measurement errors can affect the validity of the agreement and the rights and obligations of the parties, such as the seller and the buyer. According to the Civil Code (KUHPerdata), measurement errors in land can lead to the cancellation of the agreement, price reduction, and the obligation to compensate for the loss resulting from the difference in land area. Furthermore, both parties may negotiate or conduct a remeasurement to reach a fair resolution. If an agreement cannot be reached, the agreed party may file a lawsuit in court. Therefore, it is crucial to understand the legal implications of measurement errors in land sale agreements and the legal resolution procedures outlined in the Civil Code.

Abstract

Sale and Leaseback agreements  are one of the increasingly popular financing methods in strategic asset management. This agreement is considered to allow the owner of the ship to sell his assets to a third party with an agreement to re-lease the ship for a certain period of time. This method offers financial flexibility, but also presents various legal challenges, particularly related to ownership and certainty of the rights of the parties involved. This study aims to analyze the legal basis, characteristics of agreements, and their implications for the transfer of ship ownership. The approach used in this study is normative with analysis of relevant laws and regulations and case studies. The results of the study show that although  the Sale and Leaseback agreement  provides great benefits in terms of financing, the implementation in Indonesia still faces obstacles, especially for marine capital goods that include immovable objects. In addition, there is a potential for legal disputes if one party fails to fulfill its obligations. For this reason, more detailed legal arrangements are needed to protect the rights and obligations of the parties. This study recommends harmonization between the rules in the field of financing institutions and the rules applicable in shipping as well as stricter supervision of the implementation  of Sale and Leaseback agreements  on ship assets. With adequate arrangements, this agreement can be an effective solution in supporting financing in the shipping sector.

Abstract

Franchise agreements play an important role in providing legal protection for franchise business actors in Indonesia, both for franchisors and franchisees. This study aims to analyze the effectiveness of franchise agreements in protecting the rights and obligations of the parties and identify potential legal problems that arise in their implementation. The approach used is normative juridical, with an analysis of related laws and regulations, such as Government Regulation No. 42 of 2007 concerning Franchises, as well as franchise agreement documents from various business sectors. The results of the study show that franchise agreements that are drafted by fulfilling the legal principles of the agreement, such as legal certainty, fairness, and balance, are able to provide adequate legal protection for both parties. However, there are still challenges in implementation, including inconsistencies in the content of the agreement with regulations, lack of understanding of legal aspects by business actors, and weak supervision of the implementation of the agreement. This research recommends strengthening regulations and education for franchise business actors to create a fairer and more sustainable business ecosystem.
