Abstract

This study aims to contribute ideas in the form of knowledge to the public regarding the efforts that can be made by the parties to provide legal protection for wives and children in unregistered marriages, where unregistered marriages are generally known as valid marriages under sharia but are not recorded in administration. The state creates legal uncertainty for wives and children born in unregistered marriages. The research method used is the normative research method, where the author examines several positive laws governing marriage with various types. The contradiction in legal regulations that the authors found in the research results was then processed and analyzed. The authors found several solutions for wives and children born in unregistered marriages to obtain legal protection following the provisions of laws and regulations that are still valid but not known to the public. It is hoped that, from this research, there will be no more wives and children who are denied their rights because of the uncertainty of the status of Siri marriages.Keywords: Legal Protection, Wife, Children, Unregistered Marriage, Marriage Law

Abstract

This study is a form of the author's academic anxiety in observing the consumer behavior of users of one of the Gojek applications, namely GoFood, which recently, consciously, and intentionally has committed a default act of canceling the food delivery service after the GoFood driver bailed out with his own money to buy an order. consumer. This act of course caused a huge loss for GoFood drivers who incidentally are small people who are trying to make a living to meet the needs of their families. The research method used in this study is a normative research method with a statute approach as well as a case approach. The authors took both approaches because there are no rules in positive law in Indonesia that regulate the problems to be studied. From the results of the study, it was found that for acts of default by consumers who cancel orders unilaterally and irresponsibly, only civil sanctions can be imposed so that it is not enough to cause a deterrent effect for consumers who have bad intentions. So, it is time for regulators to formulate forms of criminal sanctions against consumers who knowingly and intentionally cancel orders to the detriment of GoFood drivers, as has been formulated by the Philippine government.Keywords: Gojek, GoFood, Online Drivers, and Consumers.

Abstract

Penguatan ekonomi desa sudah menjadi pembicaraan pemerintah terbukti dengan lahirnya beberapa peraturan perundang-undangan yang mengatur terkait pembentukan lembaga perekonomian desa seperti Lembaga Perkreditan Desa di Bali dan Lumbung Pitih Nagari di Sumatera Barat ditambah dengan pendirian badan usaha milik desa yang mulai diatur pada tahun 1999 hingga kini Badan Usaha Milik Desa diatur dalam Undang-Undang Nomor 6 Tahun 2014 Tentang Desa. Kedua lembaga perekonomian baik LPD maupun LPN mampu eksis hingga kini dan menopang perekonomian desa sehingga terbentuknya penguatan ekonomi desa dengan adanya kedua lembaga tersebut. BUM Desa yang didirikan saat ini pun sudah mampu menguatkan ekonomi desa dengan bentuk badan usaha yang hingga kini desa-desa berlomba untuk memajukan BUM Desa dan berusaha menguatkan ekonomi desa melalui BUM Desa. Metode yang digunakan dalam penelitian ini adalah penelitian doctrinal research sebagaimana dimaksud oleh Terry Hutchinson penelitian hukum normatif tidak mengenal penelitian lapangan (field research) karena yang diteliti adalah bahan-bahan hukum sehingga dapat dikatakan sebagai libbary based focusing on reading and analysis of primary and secondary material. Hasil penelitian ini adalah bahwa penguatan ekonomi desa dapat dilakukan melalui lembaga perekonomian desa dan badan usaha milik desa karena keduanya adalah penopang ekonomi desa sehingga mampu menyejahterakan desa.

Abstract

This research is motivated by the author submitting an application against a lawsuit related to the determination of the estimated value limit that is not in accordance with applicable regulations, causing losses to the debtor. The purpose of this study is to determine the auction mechanism and the application of determining the value of the mortgage object by the seller. This research is based on the normative legal research method through a legal approach. The results of this study are that the auction mechanism for the execution of mortgage objects through the State Assets and Auction Service Office must comply with the rules in the Regulation of the Minister of Finance Number 213/PMK.06/2020 concerning Auction Implementation Guidelines. The implementation of the determination of the boundary of the mortgage object in the field has not been in accordance with the procedure and legal protection for the debtor has not been maximized because it can only be done through a lawsuit in court and the State Assets and Auction Service Office does not have the authority to conduct an auction against the applicable boundary determination. Suggestions for the Government to change the method of setting boundaries, which previously had 2 (two) methods, namely an assessment to avoid losses suffered by debtors and provide more legal benefits for debtors.
