IMPLEMENTATION OF ECONOMIC DEMOCRACY PRINCIPLE IN ISLAMIC BANKING POLICIES THROUGH FINANCIAL SERVICES AUTHORITY (FSA) IN INDONESIA

Abstract: The enactment of Law No. 21 Year 2011 on the Financial Services Authority (FSA) made the regulation and supervision of financial institutions both banks and nonbank be integrated, including the regulation and supervision of sharia financial institutions in which there is sharia Islamic Banking. One of the principles of Islamic banking, as stated in Law No. 21 of 2008 concerning Islamic Banking is the Principle of Economic Democracy. In the implementation of the principle of economic democracy that the FSA has a significant role in pushing the Islamic banking institution to utilize its resources to promote the local economy, especially groups of people whose economic access is still minimal. In 2014, the FSA issued Regulation No. 19 in relation to inclusive finance. In these regulations, the FSA encourages banking institutions to provide banking services to people who have been marginalized through the branchless bank program. This POJK applies to both conventional banking and Islamic banking. Some conventional banks have been undertaking this program with a wide range of dynamics. Some Islamic banks have been also undertaking it, while others are still at the preparation stage. This paper will analyze the regulations issued by the FSA in order to encourage Islamic banking institutions in actualizing the principle of economic democracy, especially in relation to inclusive finance program. The research method used in this article is normative juridical with the support of primary source through the FSA.Abstrak: Berlakunya Undang-Undang Nomor 21 Tahun 2011 tentang Otoritas Jasa Keuangan (OJK) menjadikan pengaturan dan pengawasan Lembaga Keuangan baik Bank maupun Nonbank menjadi terintegrasi, termasuk pengaturan dan pengawasan Lembaga keuangan syariah yang di dalamnya terdapat Perbankan Syariah. Salah satu asas Perbankan syariah sebagaimana tertuang dalam Undang-Undang No. 21 tahun 2008 tentang Perbankan Syariah adalah Asas Demokrasi Ekonomi. Dalam implementasi asas demokrasi ekonomi tersebut OJK memiliki peran signifikan dalam mendorong lembaga perbankan syariah untuk mendayagunakan sumber daya yang dimiliki untuk memajukan ekonomi masyarakat terutama kelompok masyarakat yang secara akses ekonomi masih minim. Pada tahun 2014 OJK mengeluarkan Peraturan OJK No 19 terkait dengan keuangan Inkusif. Dalam peraturan tersebut OJK mendorong lembaga perbankan untuk memberikan layanan jasa perbankan kepada masyarakat yang selama ini termarginalkan melalui program Laku Pandai. POJK ini berlaku baik untuk perbankan konvensional maupun perbankan syariah. Beberapa bank konvensional sudah meakukan program ini dengan berbagai macam dinamikanya. Sementara itu bank syariah juga sebagian ada yang sudah menjalankan sementara yang lain masih pada tahap persiapan. Tulisan ini akan menganalisis peraturan-peraturan yang dikeluarkan OJK dalam mendorong lembaga perbankan syariah dalam mewujudkan asas demokrasi ekonomi terutama terkait dengan program keuangan inklusif. Metode penelitian pada penelitian adalah yuridis normatif dengan dukungan data-data primer melalui pihak OJK.Keywords: Banking service, economic, financial, democracy.

ABSTRACT This study aims to analyze how Hamka’s thinking about nationality, as well as moral values in accordance with the legal system of the philosophy of Pancasila. The method used in this research is a normative legal research methods to approach concepts (conceptual approach). Hamka’s idea about national values are still relevant in developing the love for the homeland. Hamka’s thinking about nationality, religious and rejected the concept of secularization. He said God is the center of human strength established the nation. The spirit of divinity embodied in the form of patriotism needs to be instilled in every person. According to Hamka, philosophy Pancasila indicates the religious character of the Indonesian nation. Therefore, the implementation of law should be sourced from the religious philosophy of Pancasila. Recognition ofthe existence of God in the Pancasila should be realized in the form of legal which has religious values. Keywords: Hamka, legal philosophy Pancasila, moral law

This study aimed to describe the genocide descriptively Chinese in Batavia that occurred in October 1740. Event known as Chinatown Chinese troubelen or commotion, is the first step of ethnic segregation in Indonesia are carried out systematically by the Trade Union of the East Indies Company (VOC). Research on Islamic law and sufism become important due to the fact that sufism is forbidden legally because it is receptive value outside of Islam. Some Islamic scholars allow so long as not to contradict the rules of Islamic law. Because it needs to be studied in depth interaction with the method of Islamic self-approach method of man to God in the epistemology of Islam. The problem formulation in this research is how tolerance values of sufism in cultural development process? Furthermore how is the interaction of sufism and sharia in the process of cultural approach? The method used in this research is sociological method, while the theory used is the cultural legal theory. Research results show that: Firstly, tolerance of Islam through sufism has been widely accepted since the spread of islam at an early stage. Secondly, the interaction between Sufism and sharia is not contradictory where the application of sharia can be explained easily by using sufism methodology.

ABSTRAK Kajian tentang nilai-nilai islam dan kaitannya dengan pembentukan kesadaran nasionalisme menjadi menarik untuk dikaji karena: peran ulama dan para pejuang muslim tersebut tidak lepas dari semangat untuk keluar dan lepas dari penjajahan. Peran para pejuang Islam baik yang berjuang secara fisik maupun yang berjuang dengan pemikiran melalui pena perlu dikaji untuk mengetahui secara historis peran ulama yang sangat penting dalam pencapaian kemerdekaan dan pembentukan Negara Kesatuan Republik Indonesia. Rumusan masalah dalam penelitian ini adalah: bagaimanakah gagasan pembentukan kesadaran kebangsaan para tokoh bangsa ditinjau dari sisi sejarah hukum? Metode penelitian yang digunakan adalah metode hukum normatif dengan pendekatan sejarah hukum. Teori yang digunakan dalam penelitian ini adalah teori sejarah hukum yang dikembangkan oleh Karl von Savigny. Kesimpulan penelitian yang diperoleh adalah: pemikiran K. von Savigny yang melihat sebuah perubahan dari bentuk yang primitif menuju sebuah bentuk modern juga terlihat dalam proses pembentukan kesadaran nasionalisme Indonesia. ABSTRACT The study of Islamic values and their relation to the formation of nationalism awareness is interesting to study because: the role of the ulama and Muslim warriors is inseparable from the spirit to get out and escape from colonialism. The role of Islamic fighters, both those who struggle physically and those who struggle with ideas through a pen, needs to be examined to find out historically the role of the ulema which is very important in the achievement of independence and the formation of the Unitary State of the Republic of Indonesia. The formulation of the problem in this study is: how is the idea of forming national awareness among national figures in terms of the history of law? The research method used is a normative legal method with a historical approach to law. The theory used in this study is the theory of legal63 history developed by Karl von Savigny. The conclusions of the research obtained are: K. von Savigny's thought which saw a change from primitive to modern patterns was also seen in the process of shaping Indonesian nationalism awareness.

This study is a form of the author's academic anxiety in observing the consumer behavior of users of one of the Gojek applications, namely GoFood, which recently, consciously, and intentionally has committed a default act of canceling the food delivery service after the GoFood driver bailed out with his own money to buy an order. consumer. This act of course caused a huge loss for GoFood drivers who incidentally are small people who are trying to make a living to meet the needs of their families. The research method used in this study is a normative research method with a statute approach as well as a case approach. The authors took both approaches because there are no rules in positive law in Indonesia that regulate the problems to be studied. From the results of the study, it was found that for acts of default by consumers who cancel orders unilaterally and irresponsibly, only civil sanctions can be imposed so that it is not enough to cause a deterrent effect for consumers who have bad intentions. So, it is time for regulators to formulate forms of criminal sanctions against consumers who knowingly and intentionally cancel orders to the detriment of GoFood drivers, as has been formulated by the Philippine government.Keywords: Gojek, GoFood, Online Drivers, and Consumers.

The study on the supervision of the DPR RI on the performance of BPJS Health is important at least for several reasons: First, the lack of optimal oversight of the DPR's supervisory function has resulted in many violations of the implementation of the laws that have been formed. Second, it is important to find out where the role of the House of Representatives (DPR) is as a state institution that has a supervisory function over the policies that have been taken through Law No. it influences the performance of BPJS. The formulation of the problem in this research is: First, how is the implementation of the supervisory function of the House of Representatives of the Republic of Indonesia on the Social Security Administering Body (BPJS) for Health? Second, What is the obstacles to the implementation of the DPR RI's supervisory function on the performance of the Health Social Security Administering Body (BPJS)? The theoretical framework used in this research is Monitoring Theory. The research method used in this study uses empirical legal research methods. The conclusion of the study: the inability of the DPR-RI in carrying out its function to question various government policies that are deemed less popular or suspected of having no major benefits for the community.
