Abstract

The finance of House Ownership Loan (locally abbreviated as KPR or Kredit Pemilikan Rumah) is a finance product in Muamalat Bank of Branch Office Surakarta using a contract of murobahah and musyarakah mutanaqisah. In its implementation, there is a difference in characteristic between two contracts. The contract of murobahah is only designed for the customers proposing the finance of house construction or renovation. Meanwhile, the contract of musyarakah mutanaqisah is designed for the customers proposing the finance of the finished house. This is a field research using the analytical-evaluative qualitative method. The researcher here attempted to make a clarification between the concept and the implementation. The result of the research showed that not all clause of the practice of KPR finance either with the contract of murobahah or with musyarakah mutanaqisah has been in accordance with the fatwa DSN-MUI. The contract of murobahah practiced was murobahah represented not with pure murobahah. This then has triggered the element of riba (excessive interest) in the transaction. Meanwhile in the contract of musyarakah mutanaqisah the bank does not divide the portion of hishshah into the units of hishshah ((taj’ziatul hishshah) share capital. In fact, the clause is the characteristic in the finance of musyarakah mutanaqisah that must be appeared as the distinguishing with other contract. Abstrak Pembiayaan Kredit Pemilikan Rumah (secara lokal disingkat KPR atau Kredit Pemilikan Rumah) adalah produk pembiayaan di Bank Muamalat Kantor Cabang Surakarta dengan akad murobahah dan musyarakah mutanaqisah. Dalam implementasinya terdapat perbedaan karakteristik antara kedua kontrak tersebut. Akad murobahah hanya diperuntukkan bagi nasabah yang mengajukan pembiayaan pembangunan atau renovasi rumah. Sedangkan akad musyarakah mutanaqisah diperuntukkan bagi nasabah yang mengajukan pembiayaan rumah jadi. Penelitian ini merupakan penelitian lapangan dengan metode kualitatif analitik-evaluatif. Peneliti disini mencoba untuk membuat klarifikasi antara konsep dan implementasinya. Hasil penelitian menunjukkan bahwa tidak semua klausul praktik keuangan KPR baik dengan akad murobahah maupun musyarakah mutanaqisah telah sesuai dengan fatwa DSN-MUI. Akad murobahah yang dipraktikkan adalah murobahah yang direpresentasikan bukan dengan murobahah murni. Hal inilah yang kemudian memicu unsur riba (bunga berlebih) dalam transaksi tersebut. Sedangkan dalam akad musyarakah mutanaqisah bank tidak membagi porsi hishshah menjadi unit modal saham hishshah ((taj'ziatul hishshah). Padahal klausul tersebut merupakan ciri dalam pembiayaan musyarakah mutanaqisah yang harus dimunculkan sebagai yang membedakan dengan kontrak lainnya.

Abstract

Islamic boarding schools (pesantren) frequently exhibit a persistent gap between environmental health compliance and internalized theological conviction. This gap explains why healthy and clean behaviors (PHBS) developed within the pesantren rarely persist once students return home. This study evaluated the effectiveness of Muhammadiyah Environmental Fiqh-based education in improving PHBS knowledge among female students at PP Taruna Al-Qur’an, Sleman. Employing a pre–post intervention design with Normalized Gain (N-Gain) analysis, 188 female students participated in a structured educational intervention delivered in a single 400-minute session. Pre-test results showed a mean correct-answer rate of 10% (very low category), while post-test results reached 93% (very high category). The N-Gain Score of 0.92 fell within the high effectiveness category according to Hake’s criteria, indicating that 92% of the available learning space was successfully filled. The study also confirmed that Muhammadiyah Environmental Fiqh, rooted in universally applicable Quranic principles, can be effectively adopted by non-AUM pesantren institutions. These findings affirm that theological framing is not merely normatively meaningful but also pedagogically superior in health education interventions within Islamic educational settings.
