Abstract

Amidst rapid technological advancement, this study investigates the influence of Artificial Intelligence (AI) on human relationships and the safeguarding of human dignity. The research questions whether AI’s current trajectory aligns with ethical standards and preserves the core values of human interaction. This study aims to analyze the impact of Artificial Intelligence (AI) development and utilization on changing patterns of human relationships and to assess its implications for the protection of human dignity. Using a normative juridical approach combined with interdisciplinary analysis from ethics and philosophy, the study critically assesses both the advantages, and the ethical risks associated with AI integration. It explores how AI reshapes traditional social dynamics and tests existing legal-ethical frameworks. Through a review of selected case studies and theoretical discourse, the paper identifies deficiencies in existing regulations and emphasizes the urgent need for comprehensive ethical and legal standards. The findings highlight the importance of redefining ethical practices within legal frameworks to ensure justice, transparency, and the continuous protection of human dignity amid evolving AI technologies. The study concludes that AI should function as a supportive tool for legal professionals rather than a substitute for human judgment, with its development and utilization.

Abstract

This article examines the influence of the development law concept on legislative practices in Indonesia, particularly in relation to democratic legitimacy and public participation. Rooted in the paradigm of legal positivism, which positions law as an instrument of state-led social engineering, development law has historically played a significant role in supporting national legal modernization. However, in contemporary legislative practice, this approach tends to reproduce elitist, technocratic, and top-down law-making patterns, thereby generating a deficit of social legitimacy. This study employs a normative legal research method using statutory, conceptual, and theoretical approaches, complemented by a socio-legal analysis based on secondary sources. The Job Creation Law, the Mineral and Coal Mining Law, and water resources regulation are examined as case studies to assess the implications of development law in legislative practice. The findings indicate that the instrumental application of development law contributes to the objectification of society, centralization of state authority, marginalization of legal pluralism, and limitations on meaningful public participation. As a result, laws tend to achieve formal validity while lacking social acceptance and democratic legitimacy. The article subsequently proposes deliberative law as an evaluative framework and normative alternative, emphasizing the importance of communicative rationality, inclusive public discourse, and substantive participation of affected communities in the law-making process. ABSTRAKArtikel ini mengkaji pengaruh konsep hukum pembangunan terhadap praktik pembentukan peraturan perundang-undangan di Indonesia, khususnya dalam konteks legitimasi demokratis dan partisipasi publik. Berangkat dari paradigma positivisme hukum yang menempatkan hukum sebagai instrumen rekayasa sosial negara, hukum pembangunan secara historis berperan penting dalam proses modernisasi hukum nasional. Namun, dalam praktik legislasi kontemporer, pendekatan tersebut cenderung mereproduksi pola pembentukan undang-undang yang elitis, teknokratis, dan berorientasi top-down, sehingga memunculkan defisit legitimasi sosial. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan teoretis, yang diperkaya dengan analisis sosio-legal berbasis sumber sekunder. Undang-Undang Cipta Kerja, Undang-Undang Mineral dan Batubara, serta pengaturan sumber daya air dianalisis sebagai studi kasus untuk menilai implikasi hukum pembangunan dalam praktik legislasi. Hasil penelitian menunjukkan bahwa penerapan hukum pembangunan secara instrumental berkontribusi pada objektifikasi masyarakat, sentralisasi kewenangan negara, penyingkiran pluralisme hukum, serta keterbatasan partisipasi publik yang bermakna. Kondisi tersebut menyebabkan hukum memperoleh legitimasi formal, tetapi lemah dalam penerimaan sosial dan legitimasi demokratis. Artikel ini kemudian menawarkan hukum deliberatif sebagai kerangka evaluatif dan alternatif normatif, dengan menekankan pentingnya rasionalitas komunikatif, diskursus publik yang inklusif, dan partisipasi substantif masyarakat terdampak dalam proses pembentukan undang-undang.
