Abstract

Competitiveness in trade activity does get higher time after time. It can be seen from the powerful competitive products either from quantity or quality aspects. ASEAN as one kind of regionalism throughout the world has affected into international trade flows development. The sector that cannot be forsaken is culture industry and creative economy. Through creative economy development, it influences states economic transformation which is can be perceived from the upgrading state qualification, based on World Bank system, for instance Singapore and Malaysia. It becomes important due to the creative economy development is not only limited to trade in goods circulation but also happening on trade in services, intellectual property rights and investment. In accord with those circumstances, this research intends to evaluate the creative economy regulation and implementation in Indonesia and its relation to ASEAN Member States (AMS) either for people to people connectivity, physical connectivity, institutional connectivity and/or resources connectivity in order to be contemplated as standard regulation considerations of creative economy protection in ASEAN. Ultimately, based on this evaluation, it could achieve Creative ASEAN reliability for enhancing economic growth and income in ASEAN.

Abstract

AbstrakPenelitian bertujuan untuk mengetahui penerapan diversi terhadap tindak pidana pencurian dengan kekerasan dalam perkara anak nomor 02/Pid.Sus-Anak/2015/PN.Kds yang telah dilakukan oleh Hakim di Pengadilan Negeri Kudus dan menemukan kesepakatan diversi. Penelitian hukum ini menggunakan metode penulisan hukum empiris untuk meneliti mengenai penerapan diversi di Pengadilan Negeri Kudus yang dibahas dengan pendekatan kualitatif. Anak melakukan tindak pidana pencurian dengan kekerasan bersama dengan orang dewasa yang mengakibatkan korban dirawat di rumah sakit selama tujuh hari karena luka berat yang dideritanya. Anak didakwa dengan dakwaan alternatif yaitu Pasal 365 ayat (2) ke-2 dan ke-4 KUHP atau Pasal 353 ayat (2) KUHP, berdasarkan hal tersebut Pembimbing Kemasyarakatan Bapas Pati menyarankan bahwa anak yang berkonflik dengan hukum harus ditempatkan di LPKA Kutoarjo. Hasil penelitian di Pengadilan Negeri Kudus menunjukkan bahwa Hakim melakukan diversi dengan alasan kepentingan terbaik bagi anak, tetapi pelaksanaan diversi tersebut tidak sesuai dengan Pasal 3 Peraturan Mahkamah Agung Nomor 4 Tahun 2014. Aparat penegak hukum pada tingkat kepolisian dan kejaksaan juga telah salah menerapkan hukum dalam melaksanakan diversi, karena telah melampaui batasan diversi yang telah ditentukan dalam Pasal 7 Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak.Kata Kunci: Diversi, Pengadilan Negeri Kudus, Pencurian dengan Kekerasan.AbstractThe research aims to determine the implementation of the diversion of theft with violence in the children case number 02/Pid.Sus-Anak/2015/PN.Kds which has been done by the Judge in the District Court of Kudus and decree a diversion deal. This legal research used empirical legal writing method to examine the implementation of diversion in the District Court of Kudus which is discussed by qualitative approach. The minor committed a violent theft crime along with an adult causing the victim to be hospitalized for seven days due to severe sustained injuries. The minor was charged with an alternative indictment, in Article 365 paragraph (2) to the 2nd and 4th of the Criminal Code or Article 353 paragraph (2) of the Criminal Code, based on the case Probation Institution (Bapas) of Pati suggested that the minor should be in LPKA Kutoarjo. The results of the research in the District Court of Kudus indicate that the Judge diverts for the best interests to the child, but the implementation of the diversion is inconsistent with Article 3 of the Supreme Court Regulation No. 4 of 2014. Abstract

AbstrakPenulisan Hukum ini bertujuan untuk mengetahui urgensi pengetatan remisi narapidana korupsi berdasarkan Peraturan Pemerintah Nomor 99 Tahun 2012. Penelitian ini merupakan penelitian hukum normative, bersifat preskriptif. Teknik pengumpulan data dalam penelitian ini adalah dengan cara studi kepustakaan. Dalam penulisan hukum ini, penulis menggunakan analisis dengan teknik deduksi berdasarkan metode penalaran deduktif. Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan bahwa kebijakan pengetatan syarat pemberian remisi koruptor yang diatur dalam Peraturan Pemerintah Nomor 99 Tahun 2012 merupakan salah satu kebijakan yang memberikan dampak yang baik terhadap upaya penanggulangan tindak pidana korupsi di Indonesia. Sulitnya penegak hukum dalam memberantas korupsi membuat justice collaborator merupakan salah satu upaya untuk membantu penegak hukum dalam mengungkap kasus korupsi dan sebagai bentuk sistem pembinaan dalam sistem pemasyarakatan. Adanya syarat menjadi justice collaborator dalam pemberian remisi narapidana korupsi juga sebagai salah satu langkah preventif dan represif. Narapidana dengan kejahatan luar bisa seperti korupsi tidak serta merta bisa memperoleh remisi namun harus memenuhi syarat. Syaratnya adalah bersedia bekerjasama dengan penegak hukum untuk membantu membongkar perkara tindak pidana yang dilakukanya atau sebagai Justice Collaborator. Kebijakan pengetatan remisi tidak bertentangan dengan Undang-undang Nomor 12 Tahun 1995 tentang Pemasyarakatan. Peraturan Pemerintah Nomor 99 Tahun 2012 merupakan bentuk pengaturan lebih lanjut dari Undang-undang Nomor 12 Tahun 1995 tentang Pemasyarakatan.Kata Kunci: Korupsi, Remisi, Justice Collaborator, Peraturan Pemerintah Nomor 99 Tahun 2012, Undang-undang Nomor 12 Tahun 1995.AbstractThis legal writing aims to determine the urgenc of tightening remission  Corruption Prisoners based on Government Regulation No. 99 of 2012. This legal writing includes normative legal research, is perscriptive. Technique of collecting data in this research is by way of literature study. In the writing of this law, the author uses analysis with deduction techniques based on deductive reasoning method. Based on the results of research and discussion can be concluded that policy of tightening conditions of granting remission corruptor arranged in Government Regulation No. 99 Year 2012 is one of the policies which give effect to the efforts to combat criminal acts of corruption in Indonesia. The difficulty of law enforcement in anticorruption makes the justice collaborator is one effort to  help law enforcement in exposing corruption cases and as a form of system construction in the correctional system. The existence of these terms becomes collaborator in granting remission justice convicts of corruption as well as one of the preventive and repressive measures. The prisoners with extraordinary crime such as corruption are not necessarily gain Remission, they need to fulfill the requirements that is willing to cooperate with the law enforcer to unload their criminal case as Justice Collaborator. Policy of tightening remission not have been contrary to the Act No. 12 Year 1995. Abstract

This study addresses juvenile delinquency in Indonesia through a combined legal and social analysis, proposing innovative solutions for sustainable impact. Drawing inspiration from Michael Foucault's Panopticon theory, the study examines how Law Number 1 of 2023 on the Criminal Code interacts with evolving social dynamics. It advocates for a flexible legal framework that not only punishes but also emphasizes rehabilitation and social reintegration for adolescents. The research underscores the critical need for legal reforms that adapt to changing societal norms and challenges posed by information technology. It explores the influence of unrestricted digital media access on adolescent behavior, including phenomena like klithih, which reflects community and peer influences. The study's findings highlight the pivotal role of family, peers, and community in shaping youth behavior and calls for enhanced community-based education and supervision strategies. Consequently, the study proposes recommendations for a more humane and effective legal approach to juvenile delinquency. These include prevention strategies that empower communities in educating and monitoring young people. By advocating for a holistic and evidence-based approach, this research aims to inspire policymakers, legal practitioners, and the public to foster a supportive environment for Indonesian youth, paving the way for a brighter future.
