Abstract

Batam Island as Port and Free Trade area in accordance with Law No. 27 Year 2007 and Government Regulation No. 1 of 2007. Batam as Trade and Free Port areas including islands Watch, Setokok Island, Nipah, rempang, Galang Island, Pulau Galang The new, benefits of the implementation of the free trade zone and port 34 countries have invested in sini.Konsekuensi status Free Trade Zone is the number of investors who have a negative impact on the one hand, and the positive impact on the other side.The negative impact is environmental damage as a result of the operations of these companies, there are companies that produce hazardous toxic waste (B3), there was a company importing B3 waste into Indonesia such as PT. Indonesia ratified the Stockholm Convention was issued Law No. 32 of 2009 on the Protection and Environmental Management replaces Law Number 27 Year 1997 on Environmental Management.Batam City Government faced with a difficult choice in the application of sanctions in accordance with Law No. 32 of 2009 on the Protection and Management of the Environment, because in that regulation, administrative sanctions (ultimum Remedium) environment must be put forward before stepping other sanctions that sanctions Criminal (Premium Remedium ).

Abstract

Since the development of Batam in 1970 until today. Great progress has been achieved so far, by the end of 2013, Batam has accumulated a total of about US $ 16.47 billion. However, the increase in foreign investment in Batam do not necessarily make Batam as the main destination of foreign investment. Indonesia Investment Coordinating Board (BKPM) set a best of seven provincial investment sector "Regional Champioship" in 2011. Kepulauan Riau (Batam) are not included in the list issued by BKPM best. This is due to the dualism of leadership in Batam which give rise to a conflict of regulations produced by the Free Trade Zone Authority (BP Batam) and the governmentof Batam which create legal uncertainty for foreign investors and the establishment of one door integrated services are facing obstacles of coordination between institutions, this is due to the licenses investors related departments / agencies of government that has not been delegated to the authority permissions to the BKPM so that the effectiveness of the one stop service has not reached its full potential, and also labor turmoil that demands minimum wage increases that often culminate in a demonstration anarchists that threaten conduciveness foreign investment in Batam. This research is a normative juridical law, because the data to be retrieved and examined are the data obtained through the primary legal materials, namely Law No. 25 Year 2007 on Investment by using secondary law approach to the principles of law in Indonesia.

Abstract

Masyarakat dalam pergaulan hidup, pada dasarnya memiliki pandangan tertentu tentang apa yang baik dan apa yang buruk untuknya. Pandangan tersebut terwujud dalam beberapa bentuk seperti nilai ketertiban, nilai ketentraman, nilai kepentingan umum, nilai kepentingan pribadi, dan lain sebagainya. Pengaturan penggunaan Kamera Pengintai atau yang sering disebut dengan Closed Circuit Television (CCTV) di Kota Batam mengacu pada ketentuan Perda Nomor 2 Tahun 2007. Perda tersebut dianggap mampu membantu pekerjaan manusia dalam bentuk pengamanan. Penelitian ini ditujukan untuk menganalisis penerapan Perda Nomor 2 Tahun 2007 Kota Batam. Penelitian dilakukan dengan metode pendekatan Yuridis Sosiologis yang menggunakan data sekunder dan data primer yang diperoleh dari lapangan. Pemasangan kamera CCTV di objek vital, fasilitas umum dan kawasan tertentu menurut Perda Nomor 2 Tahun 2007 di Kota Batam tidak sesuai dengan apa yang diinginkan. Pemanfaatan Hasil rekaman CCTV dalam hukum acara pidana kurang bisa diterima dikarenakan lemahnya pemahaman aparatur penegak hukum tentang adanya perluasan alat bukti. Perda Nomor 2 Tahun 2007 juga tidak memberikan kontribusi kepada pihak kepolisian dalam mengungkap terjadinya kejahatan yang terekam kamera CCTV di Kota Batam.

Abstract

Legislation in Indonesia continues to experience growth, including regional governance. Previously, laws relating to local government, namely Law No. 22 of 1999 and Law No. 32 of 2004 recognize the Head of Regency/City as a local executive and the Regional Representatives Council (Parliament) as a legislative that have legislative, supervisory and and budgetary functions. Later under Law No. 23 of 2014 on Regional Government, the legislative function is altered by the function of formulating local regulations. This change is significant to be analyzed by using a normative research method to examine the position of local regulation, the function of regional regulation making and working relationships between the Head of Regioncy/City and Regional Parliament in the process of formulating local regulations. === Peraturan perundang-undangan di Indonesia senantiasa mengalami perkembangan termasuk dalam hal penyelenggaraan pemerintahan daerah. Sebelumnya Undang-Undang tentang Pemerintahan Daerah Nomor 22 Tahun 1999 dan Undang-Undang Nomor 32 Tahun 2004 mengenal Kepala Daerah dan perangkat daerah sebagai eksekutif dan Dewan Perwakilan Rakyat Daerah sebagai legislatif yang memiliki fungsi legislasi, fungsi pengawasan dan fungsi anggaran. Dalam perkembangannya, Undang -Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah fungsi legislasi diubah menjadi fungsi pembentukan peraturan daerah. Perubahan tersebut perlu dianalisis secara yuridis dengan menggunakan metodelogi penelitian yuridis normatif yang menganalisis kedudukan peraturan daerah, fungsi pembentukan peraturan daerah dalam penyelenggaraan pemerintahan dan hubungan kerja Kepala Daerah dengan DPRD dalam proses pembentukan peraturan daerah.

Abstract

The purpose of this research is to analyse the application of Law No. 13 of 2003 on Manpower related to the calculation of overtime wages on a construction service company and analyse the constraints faced by the company due to the calculation of overtime wages based on the Law. It also purports to find solutions that can be implemented in the construction company based on the Law. The result of the research of found that the application of the calculation of overtime wages at Construction Company was still far from what was stated in the Law in terms of both overtime hours and the calculations of the total overtime hours which has exceed of the prescribed number of hours from the rules. The obstacles encountered is that the lack of understanding relating to standard minimum wages in Batam city by the wages councils, union/ worker and labour. The solutions are to implement a calculation system of overtime wages based on the Law and improve the supervision, and check thoroughly the records and calculation of the overtime. Tujuan penelitian ini adalah menganalisis penerapan Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan terkait perhitungan lembur pada perusahaan jasa konstruksi, menganalisis kendala yang dihadapi oleh perusahaan jasa konstruksi dalam perhitungan lembur sebagaimana Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, menemukan solusi yang dapat dilakukan agar penerapan perhitungan lembur pada perusahaan jasa konstruksi sesuai dengan Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Hasil penelitian dari penelitian ini adalah penerapan perhitungan upah lembur pada perusahaan jasa konstruksi masih jauh dari apa yang diatur dalam Undang-Undang baik dari segi jam maupun perhitungan yang dilakukan melebihi dari jumlah jam lembur yang ditentukan peraturan berlaku. Kendala yang dihadapi adanya ketikdaksepahaman dalam menetapkan standar upah minimum Kota yang melibatkan dewan pengupahan, serikat pekerja/buruh dan pekerja. Solusi yang dapat dilakukan adalah menerapkan sistem upah lembur sebagaimana yang telah diatur oleh Undang-Undang berlaku, meningkatkan pengawasan, teliti dalam pencatatan dan perhitungan upah lembur.

Abstract

Galangan kapal yang aman menjadi kesukaan bagi Investor, aman untuk keselamatan jiwa, termasuk kapal harta benda yang ada di dalam lokasi galangan kapal. Agar terjaminnya pelaksanaan sebuah sistim keamanan di galangan kapal maka pemerintah menerbitkan instrumen melalui peraturan menteri perhubungan tentang pemberlakuan penerapan International Ship and Port Sekurity Code (ISPS Code) yang harus dilaksanakan oleh galangan kapal. Tujuan penelitian ini meromendasikan agar ISPS Code dapat diterapkan oleh seluruh galangan kapal yang ada di Kota Batam. Penerapan ISPS Code bertujuan untuk menciptakan rasa aman digalangan kapal. Observasi untuk penelitian ini dilakukan pada salah satu galangan kapal di Batam yang telah menerapkan ISPS Code. Metode yang digunakan dalam penelitian ini adalah penelitian secara empiris yang menghasilkan data dari lapangan berupa hasil penelitian langsung di sebuah galangan kapal. Implementasi ISPS Code sangat bermafaat bagi pengguna jasa pelabuhan galangan yaitu meningkatkan kepercayaan investor untuk berinvestasi dalam pembuatan kapal baru khususnya di galangan kapal di Kota Batam. Investor semakin percaya pada keamanan yang tersedia di galangan meski nampak birokratis prosedural bagi perusahaan galangan kapal tetapi dampaknya sangat mempercepat pertumbuhan ekonomi.

Abstract

The implementation of juvenile justice with a progressive legal approach deserves to be used in child law enforcement because it prioritizes the interests of child protection. The relevance of progressive law enforcement to the juvenile justice system in Indonesia rests on the objectives of the juvenile justice system and the existence of rules for arrest, detention, and sentencing of crimes as an effort and form of sanctions against children, which can be in the form of treatment placed in the juvenile justice constitution. This research uses the juridical-normative method, namely legal analysis conducted by reviewing library materials or secondary data, and the data will be analysed through qualitative methods. This study aims to make law enforcers apply progressive law maximally in law enforcement of juvenile justice. The results of this study indicate that law enforcement for juvenile criminal justice in Indonesia is generally still far from the will of law enforcement with a progressive legal approach, and diversion is the right way to decide child criminal cases.

Abstract

The construction of housing and settlements in urban areas generally takes place rapidly, requiring large areas of land. The construction of housing and settlements is one of the fundamental problems faced by the government, including in Karimun Regency. This study examines the legal implications of controlling environmental impacts in housing development in Karimun district, policies related to environmental law, urban spatial planning. This research is a normative legal research based on the results of library research. The secondary data are in the form of laws and regulations in the field of environmental law, urban spatial planning, land law, books and research results in the field of environmental law. Sustainable development and controlled use of natural resources are the objectives of environmental management. To achieve the goal, it must be estimated changes in environmental conditions, both favorable and unfavorable.
