Abstract

Law on Currency regulates an obligation to use Rupiah in the Indonesian territory. According to article 21 paragraph (1) of Law No. 7 of 2011 concerning Currency, Rupiah must be used in every transaction that has the purpose of payment, settlement of responsibility with money; and/or other financial transactions. However, since the enactment of the Law, the use of foreign currency as legal medium of exchange is still being done by businessman in Batam City. This study aims to determine the effectiveness of the implementation of the Law in Batam City. This study uses empirical sociological methods to analyse the effectiveness of the Law. The data collection is done by conducting interviews by purposive sampling and research libraries. The results indicate that the application of the Law on Currency in Batam City has not been effective; consequently it has no impact on the investment climate in Batam City. The implementation of the Law and the obligation to use Rupiah in Batam City can be realized if the Bank of Indonesia or the government can set up specific rules for Batam City which has one goal, namely the stability of rupiah.   === Undang-Undang No 7 Tahun 2011 Tentang Mata Uang mengatur kewajiban penggunaan Rupiah di wilayah NKRI. Menurut pasal 21 ayat (1) Undang-undang Nomor 7 Tahun 2011 Tentang Mata Uang, Rupiah wajib digunakan dalam setiap transaksi yang memiliki tujuan pembayaran; penyelesaian kewajiban lainnya yang wajib dipenuhi dengan uang; dan/atau transaksi keuangan lainnya. Akan tetapi sejak ditetapkanya Undang-Undang Mata Uang tersebut, penggunaan valuta asing sebagai alat pembayaran yang sah tetap dilakukan oleh para pelaku usaha di Kota Batam.  Penelitian ini bertujuan untuk mengetahui efektivitas penerapan Undang-Undang mata uang di kota Batam. Penelitian ini menggunakan metode sosiologis empiris dengan mengedepankan penelitian terhadap efektivitas hukum. Pengumpulan data dilakukan dengan melakukan wawancara yang ditentukan secara purposive sampling dan penelitian pustaka. Hasil penelitian ini menunjukan bahwa penerapan Undang-Undang Mata Uang di Kota Batam tidak berjalan efektif sehingga tidak memiliki dampak bagi iklim investasi di Kota Batam. Penerapan Undang-Undang Mata Uang dan kewajiban penggunaan Rupiah di Kota Batam dapat berjalan apabila, Bank Indonesia atau pemerintah dapat membuat aturan khusus bagi kota Batam dengan tetap pada satu tujuan yaitu kestabilan nilai Rupiah.

Abstract

Indonesia's strategic sea location is one of the most demands by local and foreign shipping. Shipping becomes an element of nation's economy and government?s concern. This is proven by the issuance of Law No. 17 of 2008 concerning Shipping which regulates implementation, legal protection of community, especially shipping companies, both debtors and creditors, judges, trustees and related institutions. Yet, it cannot implement effectively because Article 223 of Law No. 17 does not have a Ministerial Regulation governing the procedures for its implementation, consequently it disadvantages and leads to a loss for creditors and debtors. This study uses a normative legal research method which examines the secondary materials which is supported by a primary data. The Progressive Legal Theory is used by this study. It argues that there must be a procedure which links the implementation of shipping claims and the legal actors both creditors - debtors, judges and harbourmaster. They must pay attention to ethics and procedures in making decisions. In this regard, a Ministerial Regulation governing the claim procedures must be established.

Abstract

Intellectual property is the result of a work for an author that has exclusive rights that only exist and are attached to the owner or bearer of rights of a work. Other parties craving to use or use the copyright need to create or produce the work required in obtain the author's permission. The problems in this research were how is the legal protection for the creator or copyright holder of the song to the payment of royalties and how to complete the objection to approve the use of the song without paying royalties. This research used normative research methods. Normative research is research on literature or document studies that support secondary research. Data collection from the results of the study was then analyzed by the author by qualitative-descriptive. Which is the type of research that aims to obtain about how the use of exclusive rights to economic rights that are still not properly implemented which requires an increase in the Author or the Copyright Holder. Based on the research results and discussion, it can be concluded the use of exclusive rights to economic rights that are still not properly implemented which requires an increase in the Author or the Copyright Holder. The formation of LMKN is a form of protection given by the Government to the copyright of songs given also provides tariffs on royalties that must be agreed by the User. Dispute resolution can be done through litigation and non-litigation. Dispute resolution involving different countries can be done through the WIPO Arbitration and Meditation Center.

Abstract

Indonesian is a constitutional state which aspires to provide justice, certainty and legal benefits for the community. In terms of realizing these legal goals, it is necessary to have law enforcers capable of carrying out the proper orders. The prosecutor is one of the law enforcers. However, in terms of exercising their authority, prosecutors are also faced with various problems, namely in conducting additional examinations. The purpose of this research is first, to determine the authority of the prosecutor to conduct additional examinations and second, to analyze the considerations, namely the Panel of Judges on the Decision of the Tanjung Balai Karimun District Court Number: 54 / PID.B / 2005 / PN. Tbk. The research method used in this research is normative juridical. The type of data used by the author in this study is primary data and secondary data.  The results of the research show that in the calculations with additional examinations by the prosecutor it can be carried out on various cases, namely: Cases that are difficult to prove, Cases that can disturb the public, Cases that can lead to state safety. Meanwhile, for other cases which do not fall into one of the 3 criteria above, no additional examination shall be carried out by the Public Prosecutor, but only by the investigator upon request or instruction from the Public Prosecutor.Negara Indoensia merupakan negara hukum yang memiliki cita-cita dalam memberikan keadilan, kepastian dan kemanfaatan hukum bagi masyarakat. Dalam hal mewujudkan cita-cita hukum tersebut, maka diperlukannya penegak hukum yang mampu menjalankan kewenangan sebagaimana mestinya. Jaksa atau penutut umum emrupakan salah satu penegak hukum yang dapat mewujudkan cita hukum tersebut. Namun, dalam hal melaksanakan kewenangannya, jaksa juga diperhadapkan dengan berbagai probelematika yaitu dalam melakukan pemeriksaan tambahan. Tujuan dalam penelitian ini yaitu pertama, untuk mengetahui mengenai kewenangan jaksa untuk melakukan pemeriksaan tambahan dan kedua, untuk menganalisis mengenai pertimbangan Majelis Hakim Terhadap Putusan Pengadilan Negeri Tanjung Balai Karimun Nomor: 54/PID.B/2005/PN. Tbk.  Metode Penelitian yang digunakan dalam penelitian ini adalah yuridis normatif. Jenis data yang digunakan penulis dalam penelitian ini yaitu berupa data primer dan data sekunder. Hasil penelitian menunjukkan bahwa dalam kaitannya dengan pemeriksaan tambahan oleh jaksa dapat dilakukan terhadap berksa perkara, yaitu: Perkara-perkara yang sulit pembuktiannya, Perkara-perkara yang dapat meresahkan masyarakat, Perkara-perkara yang dapat membahayakan keselamatan negara. Sedangkan untuk perkara-perkara lain yang tidak termasuk salah satu dari 3 kriteria tersebut diatas tidak dilakukan pemeriksaan tambahan oleh Jaksa Penuntut Umum, akan tetapi pemeriksaan tambahan yang dilakukan hanyalah oleh penyidik atas permintaan atau petunjuk Jaksa Penuntut Umum.

Abstract

Batam Island as Port and Free Trade area in accordance with Law No. 27 Year 2007 and Government Regulation No. 1 of 2007. Batam as Trade and Free Port areas including islands Watch, Setokok Island, Nipah, rempang, Galang Island, Pulau Galang The new, benefits of the implementation of the free trade zone and port 34 countries have invested in sini.Konsekuensi status Free Trade Zone is the number of investors who have a negative impact on the one hand, and the positive impact on the other side.The negative impact is environmental damage as a result of the operations of these companies, there are companies that produce hazardous toxic waste (B3), there was a company importing B3 waste into Indonesia such as PT. Jace Octavia Mandiri. Stockholm Convention of 1972, the Basel Convention on the Control of Trans boundary Movement on Hazardous Waste and Their Disposal. Indonesia ratified the Stockholm Convention was issued Law No. 32 of 2009 on the Protection and Environmental Management replaces Law Number 27 Year 1997 on Environmental Management.Batam City Government faced with a difficult choice in the application of sanctions in accordance with Law No. 32 of 2009 on the Protection and Management of the Environment, because in that regulation, administrative sanctions (ultimum Remedium) environment must be put forward before stepping other sanctions that sanctions Criminal (Premium Remedium ).

Abstract

The background of the study was about the problems in the policy and implementation of Riau Islands Province Regional Regulation Number 2 Year 2009 about the long-term plan in the effort to eliminate poverty in naval and fishery potential basis to increase the prosperity of Riau Islands Province people in coastal area specifically and Indonesians generally. The problems discussed in this study were about the obstacles in implementing the naval and fishery sector development and the solution to overcome the problems.The absence of basic infrastructure, the low education level, the geographical conditions of occupied islands all over Riau Islands Province area which were heavily influenced by the climate, and the lack of human resources to execute the programs made it slow to reach the targeted change in implementing the naval and fishery development policy.For the development continuation, it is recommended to Riau Islands Province Local Government along with Riau Islands Province People’s Regional Representative Council to issue a Local Regulation to make naval and fishery development to be the main priority in increasing the prosperity of the people as the maritime economy power basis in NKRI framework as the Foremost Islands Province, increasing the control, coordination, and synergy between sectors with related institute in formulating and implementing the naval and fishery development policy, reexamining the aid receivers, making an agreement with a clear regulation and binding the aid receivers.

Abstract

This study to analyze Undang-Undang No. 13 Year 2003 about Employment to organize the labors in order to support the investment at Batam City. This research used juridical sociological law framework. The research showed that the labors wage system at Batam City was adapted to the appropriate living standard at Batam City. The minimum wages at Batam City increased regularly and gave a negative impact in investment climate at Batam City because foreign companies had to pay a high value of wages. Because of that, the solution offered to Batam City government was to create a safe environment and stable labors wage.

Abstract

Dompak Island to Bintan Island bridge construction is a building construction between the government and the private company which then became a written contract that had been agreed by both parties. However, later in time, what was written in the contract was not obeyed by both parties and caused a legal problem between the Riau Islands Government and PT NindyaKarya. Based on the description above, the researcher wanted to analyze Bintan Island- Dompak Island bridge construction implementation whether it had referred to the legal and proportion principles. The researcher also wanted to know the factors, impacts, and efforts that has been done by both parties. The research method that using empirical/sociological law method is done by examining the written positive law requirements used to guide the Bintan Island- Dompak Island bridge construction implementation agreement, and then examined the positive law implementation on the in concreto legal events. The result showed that Bintan Island-Dompak Island bridge construction implementation agreement had not fully obeyed the legal and proportion principles. In the end, the researcher recommended to continue the project of the bridge with the risk of falling down which could bring a big loss to the country, to make the content of the agreement clear and detail, done by the efficient, affective, and accountable goods procurement which in line with the necessity and target set to give a maximum advantages for the society. The legislations made by the government should not contradict each other because it would cause the society to suffer and the welfare society could be realized.

Abstract

The purpose of this study is first, to know about the basic concept of land management rights in Batam City in terms of improving people's welfare. Second, knowing about improving the quality of land management rights in Batam City.The method used by this study is an empirical legal research. The type of data used is primary data, namely those obtained from interviews with the public community, government officers of Batam City, BP Batam and the District office and also Sub-district office. As well as conducting observations in the old village of Tanjung Uma and the old village of Nongsa. Both also use secondary data consisting of primary legal materials, namely the 1945 Constitution and Law Number 5 of 1960 concerning Agrarian Principles.Based on the results of the study, first, it was found that the Implementation of Land Management Rights in Batam became problematic after Indonesia entered the Reform phase with the enactment of Law No. 22 of 1999 on Local Government or Regional Autonomy Law, Law No. 53 of 1999 on The Establishment of Batam city and the Batam Mayor Decree No. 105 of 2004 on The Establishment of 37 Old Village Points. Second, through the socio-legal research, the researcher suggests that the Central Government and the Regional Government of the Riau Islands Province as well as the Batam City Government and BP Batam to immediately restructure the land policy regulations in Batam and synchronize land policies so that Batam people can obtain certainty of land rights as guarantees for their welfare in the future. .

Abstract

Mediation has been regulated in Paragraph 1 Article 1 PERMA no. 1 2016, which is related to the practice of judicial mediation. "Mediation is a way of resolving disputes through the negotiation process to reach an agreement between the parties with the involvement of an intermediary," said the article. The problem in this article is important because the parties can make a peace agreement before the judge who handles the case. In addition, it can be done outside the court which has become known as legal practice. Courts are a matter of peace. This study uses a normative legal approach. The results of the author's research show that the legality of the law that is decided by the judge in court and consensus causes the parties to try to resolve their disputes and must be forced to consider the peace case approved by the judge to be law and have legal force. Be irrefutable. If the settlement of a dispute outside the court is decided by a judge during the trial and arranged in a peaceful case, both parties are legally obliged to follow their decision. A peace dispute that has not been resolved by a judge's decision is poor law enforcement and one of the parties can continue to file lawsuits. Regarding the settlement mechanism between the parties or the mediator in the district court, the judge hears the peace agreement case and the judge strengthens the peace agreement with a peace agreement.
