Abstract

In meeting the need for housing, people with low incomes are very difficult to own a house in cash. The development product which was originally a conventional product, namely KPR, but in Islamic banking the system is used with profit sharing/margin so that it is without usury. The focus of this paper discusses how maqashid sharia and qawaidul fiqhiyyah review Sharia mortgages which are currently one of the prima donna products in Islamic banking. The author uses a normative juridical method, namely legal research using secondary data sources. Normative, because this study will examine secondary data starting from the review of maqashid sharia and qawaidul fiqhiyyah in the field of Islamic banking, especially in Sharia mortgages. Operationally, normative juridical research is carried out by means of library research. The results of this study are Islamic mortgages are allowed because they are part of carrying out the goals of sharia or maqashid sharia in the part of maintaining family and property, it is also assessed that home ownership is a daruriyah need of every human being so that with this Sharia mortgage it can provide benefits for Muslims in general also according to qawaidul fiqhiyyah contracts in Sharia mortgages are allowed by referring to several fiqh rules.

Abstract

Indonesia merupakan suatu Negara yang memiliki jumlah penduduk sebanyak dari Majalah bisnis ternama di AS yaitu Global Finance baru merilis peringkat Negara berdasarkan tingkatan produk domestic bruto (PDB) Perkapita dan Indonesia berada di urutan ke 122. Menurut Badan Pusat Statistik (BPS) pada bulan Maret 2021 di indonesia terdapat 27,54 juta penduduk yang berada di garis bawah kemiskinandan tolak ukur dari masyarakat yang hidup di bawah garis kemiskinan yaitu yang memiliki pendapatan Rp472.525 perkapita perbulan Zakat adalah bagian dari harta yang wajib dikeluarkan oleh setiap muslim apabila telah mencapai syarat yang ditetapkan. Dalam rukun islam zakat ditunaikan dan diberikan kepada golongan yang menerimanya (asnaf). Zakat menempati kedudukan yang sangat penting dalam islam sehingga diposisikan menjadi rukun islam yang ketiga setelah shalat. Perhitungan zakat dan angka kemiskinan, angka pekerja yang mengeluarkan zakat profesi dapat menjadi jawaban untuk meluruskan kekeliruan masyarakat yang belum menerima adanya zakat profesi. Zakat profesi yaitu zakat yang dikenakan pada penghasilan profesi apabila telah mencapai nishab. Dari ayat Al-Qur’an surat Al-Baqarah ayat 267: yang artinya “wahai orang-orang yang beriman, nafkahkanlah sebagian dari apa yang kami keluarkan dari bumi untuk kamu…” ayat tersebut menguraikan tentang nafkah yang diberikan serta sifat nafkah tersebut. perintah ayat tersebut wajib maka, semua hasil usaha apapun bentuknya wajib dizakati termasuk gaji seorang pegawai, jika gajinya sudah mencapai syarat yang ditetapkan dalam konteks zakat. Salah satu tugas lembaga pengelolaan zakat yang keberadaannya dilindungi undang-undang adalah mewujudkan peran zakat sebagai solusi untuk mengatasi kemiskinan. Zakat produktif yaitu untuk menambah atau sebagai modal usaha mustahiq. Zakat meghasilkan redistribusi komoditas pasar dari kelompok kaya ke kelompok miskin. Pada prinsipnya ada dua jalur pendstribusian zakat melalui kekayaan dan pendapatan. Yang merupakan suatu jenis distribusi yang kedua terutama jika diberikan dalam bentuk uang tunai kepada mustahik. Dua fungsi sekaligus, yaitu fungsi pendapatan dan fungsi redistribusi fungsional.
