Abstract

This legal research aims to identify and assess universal jurisdiction for piracy of the Safmarine Asia vessels. This research is a normative research viewed from prescriptive characteristic by statute and case approach, and uses primary and secondary legal materials through library research, and analyzed as syllogism. The result shows the law enforcement towards piracy on “Safmarine Asia” committed on the high seas by Somali pirates, under the doctrine of universal jurisdiction through national court of Kenya, in accordance with Convention on the High Seas (CHS) 1958, United Nations Convention on the Law of the Sea (UNCLOS) 1982, Convention for the Suppression of Unlawful Acts of Violence Against the Safety of Maritime Navigation 1988 (SUA) 1988, and United Nations Security Council Resolutions. In addition, Kenyan jurisdiction was also fall under Memorandum of Understanding (MoU) between the Government of Kenya and European Union concerning the transfer of persons suspected of having committed acts of piracy and prosecution also trial of transferred persons.

Abstract

This journal aims to know the responsibility from the parties in non-international armed conflict in the country. As described in Geneva Convention 1949 Article 3 that parties in armed conflict not of an international required for implementing the clauses following the convention. This research uses statute approach and conceptual approach; and the characters are prescriptive and adaptive. The legal materials which are used are use either be primary and secondary legal materials. The collection of legal materials technique that used in this research is library research. The analysis technique that used is the deductive format. Based on the result of this research, there are some responsibilities from the conflict parties in non-international armed conflict. The responsibility from the parties regulated in some international regulations.

Abstract

Penelitian ini bertujuan untuk mengkaji penanganan cyber crime di ASEAN dan peran Asean Regional Forum dalam mewujudkan regional cyber security melalui Treaty of Amity and Cooperation.Penelitian hukum ini adalah penelitian hukum normatif bersifat preskriptif dengan pendekatan penelitian melalui pendekatan undang-undang dan pendekatan konseptual.Bahan hukum penelitian inimenggunakanbahan hukum primer dan bahan hukum sekunder.Bahan hukum tersebutdikumpulkan melalui studi kepustakaan dan studi dokumen, yang selanjutnya teknis analisis yang digunakan adalah metode deduktif. Hasil penelitian menunjukkan bahwa penanganan cyber crimedi dalamAsean Regional Forum adalah melalui Confidence Building Measures, Preventive Diplomacy dan Conflicts Resolutions melalui konsep keamanan kawasan.Treaty of Amity and Cooperation dapat dijadikan landasan hukum bagi negara-negara anggota Asean Regional Forum guna mewujudkan regional cyber security selama masing-masing negara menghormati prinsip itikad baik dan prinsip persetujuan untuk terikat sesuai dengan Hukum Perjanjian Internasional. Negara-negara ASEAN juga dapat memanfaatkan keanggotaan negara-negara maju Asean Regional Forum dalam pembangunan regional cyber security di ASEAN melalui mekanisme kerjasama bilateral.

Abstract

Biopiracy is a problem that threatens many developing countries that have high genetic resources and traditional knowledge related to genetic resources such as Indonesia. Indonesia is one of the most vulnerable countries experiencing biopiracy. One of the genetic resources that are susceptible to biopiracy are medicinal plants. Indonesia has since used antiquity medicinal plants which is also a traditional knowledge of Indonesia but often foreigners take advantage of it and take economic value from the utilization without giving rights to the local community. On the other side of the Convention on Biological Diversity and adopted by the Nagoya Protocol which both have been ratified by Indonesia to discuss biodiversity protection and the utilization of genetic resources, one of which is the regulation of access and benefit sharing (ABS). This study consists of two main substances, first how the concept of ABS can be used as a step to prevent biopiracy in Indonesia. Second, the supporting factors that can make the concept of ABS is running optimally in Indonesia.

Abstract

This journal aims to know the application of the principles of good neighborliness in the transboundary haze pollution in the ASEAN region. Principles of good neighborliness determines that a country is not allowed to perform an action, such that within the territory of the country, causing environmental problems in other countries. This research is a normative legal research or doctrinal, and prescriptive. This research uses statute approach and conceptual approach. The legal material which are used are primary and secondary legal materials. The collection of legal materials technique that  used in this research islibrary research. The analysis technique used is the deductive pattern. Based on the results of this research and discussion produced the conclusion that transboundary haze pollution (transboundary haze pollution) in the ASEAN region has violated the principles of good neighborliness in international environmental law. The application of the principles of good neighborliness based on some the regulations of international law.

Abstract

Non-governmental organizations which engaged in international human rights such as Human Rights Watch, found some facts about the violation of the law of war on the armed conflict between Israel and Palestine in a military operation called Operation Protective Edge. A number of Palestinian human rights organizations have collected the facts of the violations and submitted an investigation request to the ICC. Under Article 13 of the Rome Statute 1998, the International Criminal Court (ICC) or the International Criminal Court has three forms of authority to examine a dispute. One of them is through the initiative of the ICC Prosecutor or known as proprio motu. This paper will examine the issues in the request for investigation of proprio motu on alleged violations of the war committed by Israel.
