Abstract

Walaupun dalam sistem hukum Indonesia tidak menganut sistem precedent, namun dalam kenyataannya, hakim juga dapat terlibat dalam pembentukan hukum melalui putusan-putusannya yang dibuat dan dipedomani oleh hakim lain di masa mendatang sebagai yurisprudensi. Salah satu hal yang memengaruhi isi dari putusan hakim tersebut adalah hukum adat yang berlaku di berbagai daerah. Tulisan ini mencoba menelusuri beberapa putusan hakim yang sudah menjadi yurisprudensi yang mengakomodir keberadaan hukum adat dari Sumatera Utara dalam putusannya. Berdasarkan penelusuran ditemukan ada beberapa ketentuan-ketentuan hukum adat dari Sumatera Utara yang menjadi yurisprudensi yang dimuat dalam beberapa putusan Mahkamah Agung yang berkaitan dengan hukum keluarga, hukum waris, hukum tanah, dan sebagainya. Hal ini tentu harus menjadi perhatian bagi hakim lain di masa mendatang, apabila menemukan kasus yang serupa, dapat menerapkan ketentuan yang sudah ada dalam yurisprudensi tersebut. Dengan harapan, agar tercipta sinkronisasi antara putusan yang satu dengan putusan yang lain dengan tipe kasus yang sama.

Abstract

Perkembangan zaman belum merubah beberapa kebiasaan dalam masyarakat Aceh Pidie seperti perjanjian pinjam emas dengan jaminan tanah sawah. Emas menjadi benda yang sangat bernilai untuk masyarakat Aceh. Pada Pasal 1313 Kitab Undang-Undang Hukum Perdata disebutkan suatu perjanjian adalah suatu perbuatan yang mana satu orang atau lebih yang mengikat dirinya terhadap satu orang lain atau lebih. Jaminan adalah sesuatu yang diberikan kreditur untuk menimbulkan keyakinan bahwa debitur akan memenuhi kewajibannya yang dapat dinilai dengan uang yang timbul dari suatu perikatan. Hasil pembahasan yang di lakukan di Desa Raya Paleue, perjanjian pinjam emas dengan jaminan tanah sawah merupakan perjanjian adat yang berlaku sejak turun temurun. Syarat sah suatu perjanjian tertuang dalam Kitab Hukum Undang-undang Perdata. Pemerintah daerah memberikan wewenang terhadap lembaga adat yang bersangkutan untuk menyelesaikan sengketa yang ada seperti yang di tuliskan dalan Qanun No. 10 Tahun 2008.

Abstract

Default is a condition where the debtor does not carry out his obligations that have been specified in the agreement. In addition to not carrying out its obligations as specified in the agreement, default can also occur where the debtor does not carryout his obligations asstipulated in the law. Research method used is normative yuridicial research, the nature of the research used is descriptive, data collection technique is with do library research and interviews. The results of the study default lawsuit against state owned enterprise on land and buildings sale agreement disputes because where Sumurung Siregar wanted to buy the official house he once occupied but when the installment of the house wascompleted the Director of PT.PLN did not reverse the deed of the official house to the name of Samurung Siregar. So that in this sale and purchase agreement the judge judges by listening to witness statements and examining the existing evidence. From research conducted it can be concluded that the cause of default is that in resolving the default dispute, deliberation must first be carried out so as not to harm the parties if they do not get a solution then go to court.

Abstract

Renting is an agreement with which one party binds itself to give to the other party to using of an item for a certain time and with a payment of a price which latter the party is able to pay. The rights and obligations of the parties on leasing agreement, the rights of the party that rents out are the rights to be received by the party who rents out. The leasing party has the right to rent which must be paid by the lessee at a certain time in accordance with the lease agreement. The renting party has the right to pandbeslag, which is the seizure carried out by the court on leasing applications such as furniture that is at home rented in the event that the tenant is in arrears of rent for auction if the tenant does not pay the arrears in full. The leasing party has the right to request the cancellation of the agreement and compensation. The right of the lessor is to give back the object that is leased to the tenant, maintaining the object that is leased so that it can be used for the intended purpose. The lease agreement ends with breach of contract before the expiry of the lease agreement can expire on its own at a certain time, after being stopped with due regard to a certain grace period. Even though a lease is a consensual agreement, but by law there is a difference between a written rental and an oral lease.

Abstract

Children are entrusted by the almighty as the next generation of this nation who must be protected from all kinds of criminal acts, including criminal acts of sexual abuse which is a cruel act that almost all of the world condemned the behavior. The problem in this study is the legal consequences of the crime of sexual abuse with children, the judge considered the decision No. 934 / Pid.Sus / 2016 / Pn.Mdn and the factors causing the crime to commit sexual abuse to children. The results and discussion in this study are legal consequences arising from criminal acts of sexual abuse to children is the birth of a legal relationship that gives rise to rights and obligations between countries, perpetrators and victims of criminal acts of sexual abuse to children based on the Law of the Republic of Indonesia Number 35 of 2014 concerning of Child Protection, the judge considers the decision No. 934 / Pid.Sus / 2016 / Pn.Mdn is to pay attention to matters that incriminate and alleviate, and consider the ability to be responsible, the judge accuse the defendant by considering Article 81 paragraph (2) of the Law Republic of Indonesia Number 35 of 2014 concerning Amendments to the Law of the Republic of Indonesia Number 23 of 2002 concerning Child Protection, the causes of criminal acts of sexual abuse to children are internal factors (low education and moral, psychological, and economic factors) and external factors (social culture, family and environment, technology, interaction and situation and the role of the victim.
