Abstract

Kegiatan pengabdian masyarakat ini adalah mensosialisasikan Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika kepada para siswa Sekolah Menengah Pertama (SMP). Kegiatan ini bertujuan agar para siswa sebagai generasi muda mengetahui dan memahami bahaya narkotika, sehingga tidak akan melakukan perbuatan yang mengarah pada tindakan terjadinya penyalahgunaan narkotika.Kegiatan pengabdian ini dilandasi pemikiran semakin maraknya penyalahgunaan narkotika di kalangan para generasi muda termasuk para siswa sekolah, baik sebagai pengguna maupun sebagai pengedar. Berdasarkan data survey Badan Narkotika Nasional tahun 2019 ada 2,3 juta pelajar di Indonesia pernah mengkonsumsi narkoba (narkotika, psikotropika, obat-obatan terlarang). Melihat data tersebut dapat dikatakan “Indonesia Darurat Narkotika”. Oleh karena itu, untuk mencegah semakin banyaknya pengguna narkoba di kalangan pelajar, maka perlu dilakukan sosialisasi bahaya penyalahgunaan narkotika. Metode kegiatan pengabdian ini berbentuk penyuluhan hukum Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika, yang dilanjutkan dengan dialog interaktif seputar narkoba antara para siswa dengan tim penyuluh hukum yakni para Dosen Bagian Pidana Fakultas Hukum Universitas Sebelas Maret. Narkoba dari segi agama sudahpasti adalah sesuatu yang haram, dan dari segi masa depan sebuah bangsa, narkoba adalah senjata paling ampuh untuk menghancurkan sebuah negara. Diharapkan dengan adanya kegiatan penyuluhan hukum ini, semakin banyak pelajar yang memiliki wawasan tentang bahaya narkoba.

Abstract

This gratuity is a practice that often occurs in a nation, which is carried out by state administrators or state officials. Gratification is one form given to state administrators or state officials to influence the performance of public officials which can create the potential for creating an economy at high costs and can affect the quality and fairness of services provided to the community. In the development of this gratification, initially gratification only took the form of money and goods, but in fact the practice of gratification has developed in the form of sexual services. This research seeks to answer the issue of limits on gratification as regulated in Article 12 B of the Corruption Eradication Law. Because the existence of gratification for sexual services must be regulated first so that the perpetrator can be subject to criminal sanctions. As a comparison for this research, it uses a comparative method by examining legal regulations regarding gratification in another country, namely Singapore.

Abstract

This article analyzes the criminal offense of promoting online gambling, which is currently widespread on social media. The purpose of this article is to understand the legal frameworks regarding online gambling promotion on social media. The findings indicate that the regulations are found in Article 303 of the Indonesian Criminal Code (KUHP), Article 303 Bis, Article 426 of the New Indonesian Criminal Code (KUHP Baru), and Article 27 paragraph 2, Article 427 of the New Indonesian Criminal Code (KUHP Baru), and Article 45 paragraph 3 of the Indonesian Information Technology Law (UU ITE). The research method used in this writing is legal normative research with a statutory approach and a case approach. The legal sources in this research are primary and secondary legal sources, based on various regulations and various journals and academic writings. The result of the research is that within the online gambling regulations, there is a loophole, which is referred to as the "license" in the KUHP. The online gambling regulations in the Indonesian Information Technology Law are already in accordance with this.

Abstract

This research aims to know how is the prevention of negative content that is accessed by using VPN towards website that is blocked by the government through Indonesian National Police and the obstacle of its prevention. The research conducted is non-doctrinal research, which is a research to know some practical situations. This research uses primary and secondary data. Primary data is direct interviews with the Indonesian National Police and Ministry of Communication and Informatics to know blocking efforts and regulations of applications missuse. Secondary data is obtained by literature studies. The government has blocked websites with negative content based on Minister of Communication and Informatics Regulations Article 19 years of 2014 about Handling of Websites with Negative Content. Government-blocked websites can be opened with VPN applications. Indonesian National Police's step in handling the missuse of VPN applications to access negative content is with the prevention efforts. There is no device missuse regulations yet makes an obstacle to prevent represively. Ministry of Communication and Informatics begins to regulate the utilization of VPN application in the terms of licensing.

Abstract

This research aims to assess the urgency of regulation reform of bribery offence at private sector in Indonesia. This study used doctrinal research methods with prescriptive characteristic. The approach used is legal approach. The legal substances used in this study are primary and secondary legal materials. The techniques of collecting legal materials are by library research and analysis techniques of legal materials using deduction methods. The results showed that the arrangement of bribery in private sector offences in Indonesia still has various problems with the unenactment of Law Number 11 of 1980 on Bribery Offences effectively and impressed forgotten. KPK has attempted to revise the Corruption Act through the Corruption Criminal Act Draft which included articles relating to bribery in private sector offences by adopting the provisions of Article 21 UNCAC. However, the Corruption Criminal Act Draft still lacked a shortage of passive bribery offences.
