Abstract

Penelitian ini bertujuan mengkajimengenai akta pengakuan pemilik sertifikat hak atas tanah yang dibuat secara dibawah tangan apakah dapat atau tidak dijadikan dasar untuk melakukan pemisahan sertifikat oleh pihak lain yang haknya masuk dalam sertifikat tersebut. serta mengkaji upaya-upaya apa saja yang dilakukan oleh pemilik tanah untuk memisahkan tanah miliknya yang terdaftar pada sertifikat atas nama orang lain.Adapun Jenis penelitiannya adalah penelitian hokum empris dengan metode pendekatan peraturan perundang-undangan, pendekatan konseptual, dan pendekatan empiris. kedudukan surat pernyataan atau pengakuan secara tertulis yang dibuat dibawah tangan mengenai adanya hak orang lain dalam sertifikatnya hanya sebagai alat bukti saja bahwa subyek yang namanya terdaftar didalam sertifikat tersebut mengakui adanya hak orang lain yang masuk dalam sertifikatnyadan adapun upaya yang dilakukan oleh pemilik tanah untuk memisahkan tanah miliknya yang terdaftar pada sertifikat atas nama orang lain adalah meminta kepada subyek yang terdaftar namanya didalam sertifikat tersebut untuk melakukan pemisahan terhadap tanah yang menjadi haknya serta membuat akta peralihan hak atas tanah terhadap tanah yang dilakukan pemisahan tersebut untuk dijadikan dasar dalam melakukan proses balik nama.

Abstract

This study examines the origin of acquisition, as well as the transfer process from customary land ownership rights to individual one. This study is an empirical one with statute, conceptual, and sociological approaches. The origin of customary land in Rarak Ronges Village before village separation had come from forestry land. Local community, then, collectively cleared the land. Over time, these lands has been abandoned. The basis for individual acquisition over those previously abandoned customary land is by cultivating them continuously for over 20 years.

Abstract

This research aims are to know the implementation of just principle towards agricultural land acquisition for public road, and also to know supporting and inhibiting factors during the process of land acquisition for the development of Tegal to Gontoran road in Sandubaya. Type of this research is empirical legal research which applies statute, conceptual and sociological approaches. land acquisition for 20 area of rice fields with 16 owners conducted by discussion. The compensation values rise rejection from the land owner, but eventually they are close the arrangement, land owner and government through discussion. In addition, supporting and inhibiting factors are consist of juridical and non-juridical.

Abstract

This study aims to determine the process and what factors affect the implementation of the prudential banking principle in online-based agreements. This normative-empirical legal research method is basically a combination of normative legal approaches with the addition of various empirical elements with the Statute Approach, Conceptual Approach and Sociological Approach. Based on the results of the research, the application of the prudential banking principle in online-based credit agreements implemented by bank Danamon has complied with the prudential banking principle with the 5C of Credits element implemented by Bank Danamon are in accordance with Bank Indonesia regulations, Financial Services Authority regulations, and other laws and regulations. Other applicable laws and factors that influence this implementation are legal and non-legal factors.

Abstract

This study aims to analyze the impact of forest destruction as a result of changes in the function of the forest in the corn farming area, why the government is not effective in protecting forests, and how the government has made efforts to overcome forest damage. This study uses empirical research. The approach used is the statutory, conceptual and sociological approach. Sources of data used are field data and literature. Techniques/How to obtain data is done by interview technique. The analysis used in this research is qualitative. Based on the research results, the impact of forest damage in the Sumbawa Regency is unpredictable weather conditions from year to year, flooding, erosion, and sedimentation of the forest floor surface, which is starting to erode. Supervision is ineffective due to a lack of Human Resources (HR). Efforts made by Sumbawa Regency in overcoming forest damage are forest and land rehabilitation with a self-management scheme of local community groups.

Abstract

This study aims to determine the legal considerations of the panel of judges in the Mataram District Court Decision Number 299/Pdt.G/2021/PN.Mtr and the defendant's liability in the land lease agreement which is the land owned by the plaintiff. The method used by the researcher in this study is a normative legal research method using the approach of legislation, conceptions and cases. The results of the study were the panel of judges stated that the defendant was proven to be in default, the agreement could be canceled and the object was transferred back to the plaintiff. And the Defendant must pay compensation as a liability

Abstract

The aims of this research are to know notary’s responsibility in data fraud in the making of land sale and purchase before notary by the parties, and also to know legal consequences of data fraud in notary office in Mataram City. Method of this work was empirical legal research which applied statute, conceptual and sociological approaches. The data was collected through library study and interview. Result of this work shows that notary does not responsible on the deed which made from fake data which brought to them by the parties. Legal consequences of the date which made based on fake data which brought by one party, it can be requested for revocation by the aggrieved party.

Abstract

This study aims to determine the application of the Regulation of the Minister of Agrarian Affairs/Head of the National Land Agency of the Republic of Indonesia Number 21 of 2020. Furthermore, this study analyzes the Supporting and Obstacle Factors in the Land Dispute Resolution Process through the Mediation Process. The research method used is the empirical legal research method. The results of this study reveal that the settlement of land disputes at the Central Lombok National Land Agency through mediation has been running well and optimally. There are many land disputes resolved through non-litigation channels, namely mediation. The supporting factor of the mediation is the regulations that facilitate and clarifies in resolving land disputes. The inhibiting factors in land dispute resolutions through mediation at the Central Lombok District Land Office include, first, the parties did not have good intentions, they instead take advantage of the mediation process to stall for time, pretending to forget or dishonesty in resolving disputes. Second, the parties in land disputes insisted to defend their respective rights.

Abstract

This study aims to determine and analyze the existence of a land bank as a state land management agency and to find out how the land bank is regulated according to positive law in Indonesia. The method used is normative, and then the data is analyzed by descriptive analysis. The results of this study indicate that the land bank regulation according to positive law in Indonesia is in Government Regulation Number 64 of 2021 concerning the Land Bank Agency and the existence of the land bank as a state land management institution is that the land bank has the task of managing state land to become more valuable and beneficial following its designation. It is hoped that this land bank can become a helpful institution and run following favourable laws in Indonesia.

Abstract

Tujuan dilakukannya penelitian untuk mengetahui bentuk pelaksanan perjanjian bagi hasil peternakan sapi di Kecamatan Suralaga serta untuk mengetahui hambatan yang terjadi dalam perjanjian bagi hasil peternakan sapi antara pemilik dan peternak di Kecamatan Suralaga Kabupaten Lombok Timur, mamfaat yang bisa di peroleh dari penelitian ini untuk akademis agar bisa memperoleh gelar S1 pada Fakultas Hukum Universitas Mataram serta menambah wawasan dan pengetahan khususnya konsentrasi hukum perdata mengenai perjanjian bagi hasil, metode penelitian yang digunakan yaitu empiris normatif kesimpulan yang dapat ditarik dalam penelitian ini yaitu bahwa pelaksanaan perjanjian bagi hasil peternakan sapi antara pemilik dan peternak di Kecamatan Suralaga Kabupaten Lombok Timur dilaksanakan secara lisan atau tidak tertulis, cara pembagian hasilnya yaitu melalui dua cara yang pertama bagi hasil anak dan yang kedua bagi hasil dalam bentuk uang, hambatan yang terjadi dalam perjanjian bagi hasil tersebut yaitu ketidaktauan para pihak yang melakukan perjanjian bagi hasil akan adanya hukum yang berlaku yang dapat digunakan dalam melakukan perjanjian serta hambatan yang di hadapi dalam perjanjian bagi hasil ini apabila sapi tersebut mati, sapi hilang dan peternak sapi melanggar prestasi.
