Abstract

Business activities that can lead to business competition between actors in the field of business can create a broad market and create a democratic market so as to give rise to increasingly fierce business competition. Trade competition is carried out to win the hearts of buyers. Trade on-screen characters attempt to offer alluring items, both in concerning cost, quality and advantage. Of course, the company competes with other competitors to be identified, monitored and tricked in order to obtain and maintain customer loyalty. Business competition carried out by the perpetrators is getting tighter. In this case the Head of Regional Office VII of the Business Competition Supervisory Commission (KPPU) sensed unfair business competition behavior related to the sale of souvenirs located in the Special Region of Yogyakarta, indications of unfair business competition practices were in the form of closed agreements between shops selling souvenirs to visitors who want to travel in Yogyakarta. The indication is that there is a business entity that prohibits suppliers from supplying goods to other business entities and threatens suppliers. This study aims to analyze the suitability of the form of sanctions imposed by the KPPU on souvenir shops that violate them. Abstract

Latar Belakang : Seiring berkembangnya teknologi di era modern saat ini, eksploitasi tak hanya dilakukan dilingkungan masyarakat secara langsung namun juga dalam dunia maya atau media sosial. Kasus Eksploitasi lansia di tiktok masih menjadi perdebatan mengenai adanya unsur pidana atau tidak didalamnya. Tindakan eksploitasi di atur dalam Undang-Undang Nomor 21 Tahun 2007 Tentang Pemberantasan Tindak Pidana Perdagangan orang. Dengan ini diperlukannya penelitian terkait apakah tindakan eksploitasi terhadap lansia di tiktok memenuhi unsur tindak pidana. Tujuan : Tujuan untuk menjabarkan secara rinci mengenai tindakan eksploitasi terhadap lansia di tiktok. Metode : Metode penelitian yang digunakan yaitu secara normatif berdasarkan pada peraturan perundang-undangan terkait. Penulis menggunakan metode pendekatan undang-undang dan konseptual, serta teknik pengumpulan bahan hukum yang diambil melalui studi kepustakaan. Teknik analisis bahan hukum yang digunakan oleh penulis yaitu secara deskriptif. Hasil: Tindakan eksploitasi terhadap lansia di tiktok menandakan bahwasannya kasus tersebut jika ditinjau dari pasal 1 ayat 1 undang undang nomor 21 tahun 2007 sudah memenuhi ketiga unsur diantaranya unsur cara, unsur proses, dan unsur eksploitasi. maka tindakan tersebut bisa dikategorikan sebagai suatu tindak pidana dikarenakan sudah memenuhi semua unsur pidana. Kesimpulan: Penyalahgunaan media aplikasi tiktok yang seharusnya diperuntukkan untuk menciptakan sebuah konten kreatifitas. Tindakan eksploitasi terhadap lansia di tiktok menandakan bahwasannya kasus tersebut jika ditinjau dari pasal 1 ayat 1 Undang-Undang No. 21 tahun 2007 sudah memenuhi unsur tindak pidana perdagangan orang diantaranya yaitu: unsur proses, cara dan eksploitasi, ketiga unsur sudah terpenuhi maka kasus Tindakan eksploitasi terhadap lansia di tiktok bisa dikategorikan sebagai tindak pidana perdagangan orang.

Abstract

Transportation is frequently recognized by many as crucial to the success of a country due to the fact that supports effortless movement of people and goods and contributes to longterm development. The overall objective of transportation is to minimize travel times while stimulating human activity by facilitating connections throughout destinations faster. It must be done to take on transportation wholeheartedly, taking into thought not simply the present situation and conditions but also the environment that surrounds it, including facilities and infrastructure. In addition to an abundance of places to park and expanding vehicular traffic, congestion might get worse as a consequence of a deficiency of supportive infrastructure and facilities. Surabaya is Indonesia's second-largest city after DKI Jakarta. In recognition of Surabaya's their image as a metropolis, numerous citizens of other nearby towns decide to make their homes there. Compared with the Central Statistics Agency, Surabaya is projected to be residence approximately 3,157,126 the residents in the year 2020. Abstract

A music concert event is currently one of the community's sources of entertainment. Because a music event allows followers of a singer and/or band, both local and worldwide performers, to see their idols live. Furthermore, the atmosphere of a music concert can undoubtedly create an impression and experience for the audience. A music performance event will never be devoid of admirers due to the interdependence of these components. Another factor supporting the continued existence of music concerts is the growing public desire for music. The various music performances held in both festival and tour styles, both in Indonesia and abroad, demonstrate the vibrancy of a musical performance. Similarly, there is a high level of public interest in purchasing musical tickets. Every time a music event is held, hundreds or even tens of thousands of people pack the venue. Due to overwhelming demand from the public, promoters frequently lengthen the time of music concerts. One essential factor driving the music industry's rapid expansion is the preservation of solid cooperative relationships between concert promoters and performers." This cooperative partnership concerns the parties' rights and obligations, as well as certain provisions that must be followed. In order for a cooperative relationship to function properly, an agreement or cooperation contract must be used as a medium or instrument to accommodate multiple existing interests. So that it may ensure that all parties' interests are met and no one is hurt. Because all parties fulfill their rights and obligations, the foregoing conditions might be considered perfect in a cooperative relationship. The Covid-19 epidemic, on the other hand, compelled the parties involved by the collaboration agreement contract to execute their rights and obligations. Overall, the Covid-19 pandemic resulted in numerous unexpected cancellations of collaboration, resulting in both material and non-material losses. This study will look at the legal ramifications of event promoters and artists terminating their collaboration owing to the Covid-19 outbreak. The goal of this research is to examine the legal ramifications of event promoters and musicians canceling collaboration because of the Covid-19 outbreak. This study employs a normative juridical methodology using a statutory and conceptual approach, as well as primary, secondary, and tertiary legal materials. This research uses qualitative analysis to obtain legal materials through literature studies. According to the findings of this study, there must be regulations in an agreement or cooperation contract that foresee cancellations due to things beyond the control of the parties involved and non-natural disasters such as the Covid-19

Abstract

Pembangunan di Indonesia mencerminkan komitmen pada trilogi pembangunan yang mencakup pemerataan, pertumbuhan ekonomi, dan stabilitas nasional. Era globalisasi memacu persaingan bisnis yang ketat, memaksa perusahaan guna berkembang atau menghadapi risiko kemunduran. Dalam upaya tumbuh, perusahaan dapat memilih ekspansi melalui pertumbuhan internal atau akuisisi saham dari luar perusahaan. Penelitian ini menyoroti pengambilalihan saham sebagai strategi vital dalam perkembangan bisnis, memungkinkan perusahaan guna memperkuat posisinya tanpa mengakhiri operasionalnya. Namun, implementasi pengambilalihan saham melibatkan kompleksitas regulasi yang harus dipatuhi. Studi ini menggali aspek hukum yang terkait dengan notifikasi pengambilalihan saham perseroan terbatas, dengan memfokuskan pada Putusan Nomor: 34/KPPU-M/2020. Penelitian ini mengungkapkan pentingnya mematuhi peraturan terkini dan dampaknya terhadap persaingan bisnis serta stabilitas ekonomi.

Abstract

Indonesia’s participation in international peace institutions has long been a cornerstone of its foreign policy, rooted in the constitutional mandate of Article 1 Paragraph 4 of the 1945 Constitution, which calls for active contribution to world peace based on independence and social justice. The emergence of the Board of Peace as an international institution focused on conflict resolution and peacebuilding raises significant questions regarding the legal basis, scope, and implications of Indonesia’s membership under national law. This study aims to analyze the legality of Indonesia’s membership in the Board of Peace, examine the applicable national legal framework governing international institutional participation, and formulate a normative understanding of how such membership aligns or conflicts with existing Indonesian law. This study employs a normative legal research method utilizing a statutory and conceptual approach. The results indicate that while Indonesia’s constitution and international treaty law provide a general basis for participation in international organizations, specific legislative frameworks governing membership conditions, obligations, and accountability mechanisms remain underdeveloped.

Abstract

The designation of collateral—specifically land—as "abandoned land" creates legal issues, as it can compromise legal certainty and the protection of the creditor's rights as the security holder. This study aims to analyze the legal protection afforded to creditors in such situations and to examine the legal measures available to safeguard their interests. The study employs a normative legal research method, utilizing statutory, conceptual, and legislative approaches. The findings indicate that while security rights grant creditors priority, the designation of collateral as abandoned land can diminish or even eliminate its value if the land rights are revoked or seized by the government in accordance with applicable laws. Consequently, legal protection for creditors must be ensured through legal certainty, the careful application of credit principles, coordination between land offices and financing institutions, and the availability of mechanisms—such as approval processes or legal recourse—to address abandoned land designations that could prejudice creditors' rights. Therefore, clearer and more balanced regulations are required to ensure that the state's interest in designating land as abandoned remains aligned with the protection of creditors' rights as security holders.

Abstract

The criminal seizure of a debtor's assets that have been declared bankrupt and constitute the bankruptcy estate remains a controversial legal issue in Indonesian law enforcement. This issue arises from the overlap of authority between criminal law and bankruptcy law in determining the party authorized to control and administer the debtor's assets. On the one hand, Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations stipulates that, upon the declaration of bankruptcy, the authority to administer and manage the bankruptcy estate is transferred to the receiver (curator) under the supervision of the supervisory judge. On the other hand, the Indonesian Criminal Procedure Code authorizes investigators to seize property allegedly connected with a criminal offense. This study aims to analyze the legal regulation governing criminal seizure of the bankruptcy estate, examine the legal status of the bankruptcy estate in criminal seizure proceedings, and evaluate the legal protection afforded to creditors against such seizures. This research employs a normative legal research method using statutory, conceptual, and case approaches. The legal materials consist of primary, secondary, and tertiary legal sources analyzed qualitatively through descriptive-analytical methods. The findings indicate that criminal seizure of assets included in the bankruptcy estate is legally permissible provided that it complies with criminal procedural law. However, its implementation must also uphold the bankruptcy law principles of paritas creditorum and pari passu pro rata parte to prevent arbitrary impairment of creditors' rights.
