Abstract

Di era yang serba cepat berubah membutuhkan kesegaran bersikap dalam segala macam situasi yang terjadi. Tuntutan seperti ini memkasa umat islam untuk mengetuk pintu ijtihad yang selama beberapa abad sudah tertutup rapat, agar dapat dibuka lagi demi dilakukannya revitalisasi ijtihad di tengah kehidupan kaum muslimin yang harus berhadpan dengan dampak derasnya arus zaman modern yang tak terbendung lagi. Menjadi sebuah keniscayaan bahwa ijtihad telah menjadi solusi dari buntunya dan kejumudan pemikiran umat yang biasa berpusar pada jawaban-jawaban bersifat klasik yang diberikan para ulama dan fuqoha terdahulu terhadap persoalan yang muncul di zaman dan budaya lokalnya. Untuk itu mentradisikan berijtihad di masa seperti sekarang ini adalah suatu hal yang lumrah karena sesuai dengan kebutuhan. Formula ijtihad yang diusung oleh para ulama saat inipun tak jauh berbeda dengan sebelumnya, namun menitikberatkan pada maqashid syariah atau hikmah dibalik dibumikannya suatu ketetapan hukum Islam. Dengan mengacu kepada kemaslahatan yang berdimensi rasa adil dan rahmatan lil’alamin, maka ijtihad yang dikembangkan bersifat humanis tanpa meninggalkan akar syariat yang menjadi tsawabit dari perubahan (mutaghayyirat) yang terus berlangsung sepanjang waktu, Urgensi Ijtihad di masa ini dan mendatang tak terbantahkan lagi, mengingat umat islam sangat haus dengan jawaban dan fatwa-fatwa dinamis yang diharapkan akan menjadipedoman bagi tata laksana kehidupan duniawi untuk meraih kebahagiaan ukhrawi.

Abstract

Currently, in the social reality around us, possession of property is considered the standard of one's happiness, and having wealth is considered a sign of good luck. Therefore, it can be considered that the main reason why humans tend to pursue wealth is because of the perception that the need for wealth is comparable to the need for family or descendants. It is best to remember that the wealth in this world basically belongs to Allah SWT, as the Creator and Ruler of the universe and its contents. Therefore, wealth owned by humans should be considered a trust from Allah SWT, and humans are entrusted with managing it responsibly in accordance with the rules contained in the Koran and the teachings of the Prophet Muhammad, both for life in this world and in the afterlife.

Abstract

Waqf has a significant role in overcoming the problem of poverty and social issues that exist in society, especially in setting prices, because this can make prices better if the handling is also good. The method used in this research is Library Research by taking secondary data from books, journals and other articles. Explains that the role of waqf in pricing is as follows: Financing Production Facilities, Price Subsidies, Development of Logistics Infrastructure, Poverty Alleviation, Education and Training, Research and Development, Price Supervision, Financing Micro, Small and Medium Enterprises.

Abstract

Euthanasia is a global issue that continues to be debated, especially from a legal and ethical perspective. In Islamic law, the principle of protection of life (hifz al-nafs) is the main basis for rejecting the practice of euthanasia. However, there is a fiqh principle Ad-darurah tubih al-mahzurat which permits prohibited actions in emergency situations, thus giving rise to debate whether this principle can be applied to euthanasia. This study aims to examine the application of this principle in the context of euthanasia based on Islamic law and compare it with positive legal regulations in various countries. The research method used is a qualitative study with a normative approach, involving literature analysis from classical books, fatwas of scholars, Islamic legal journals, and positive legal regulations. The results show that Islamic law generally rejects euthanasia because it is considered contrary to the principles of maqasid sharia. Although there are fatwas that permit certain medical procedures in emergency situations, euthanasia remains categorized as an act that is not permitted by Islamic criminal law. In contrast, several Western countries have legalized euthanasia with strict regulations, unlike Muslim countries, which generally prohibit the practice. The conclusion of this study confirms that the application of emergency rules in euthanasia must consider the principles of maqasid sharia as well as broader ethical and legal aspects. Therefore, further study and coordination between Islamic scholars, medical professionals, and policymakers are needed to formulate regulations that align with Islamic principles and developments in modern medicine.

Abstract

Although abortion regulation has received considerable attention in legal and ethical scholarship, studies that specifically examine abortion for rape survivors within Indonesian health law from the perspective of Maqāṣid al-Sharīʿah remain limited. This study aims to analyze the legal framework governing abortion for rape survivors as stipulated in Government Regulation No. 28 of 2024 on Health and to assess its conformity with the objectives of Islamic law. The research employs a qualitative approach with a normative-doctrinal design through library research. Data were collected using documentary analysis of primary legal sources, such as statutes and classical fiqh literature, as well as secondary sources in the form of scholarly books and reputable journal articles, and were analyzed descriptively and analytically using a maqāṣidī taḥlīlī approach focused on the principle of the protection of life (ḥifẓ al-nafs). The findings indicate that the regulation demonstrates substantive alignment with the objectives of Islamic law, particularly in the protection of life, intellect, lineage, and honour, as evidenced, among other things, by the determination of a 14-week gestational limit prior to ensoulment. Nevertheless, the study also identifies various procedural obstacles that may hinder rape survivors’ access to safe and affordable abortion services. The study concludes that the regulation of abortion for rape survivors in this government regulation represents an implementation of the principles of necessity (ḍarūrah) and public interest (maṣlaḥah), and recommends strengthening institutional coordination and health service procedures to ensure effective and just protection for survivors. This study offers both theoretical and practical contributions to the development of Islamic law and reproductive health policy in Indonesia.
