Abstract

This research aims at finding out the practice of selling goods without price tags and the fiqh mu’amalah review on its sales at student cooperative stores of PMDG Campus. The method used in this research is descriptive qualitative which describes the various conditions, situations and social phenomena that occur. Applying the field research, this study uses the interview results with the management of student and consumer cooperatives, as a source of data collection. Based on this research, sales in student cooperatives apply the same system as in supermarkets, where the consumer takes the items he wants to buy on the storefront, then takes them to the cashier to carry out the transaction process. Since the price tag is not included, the price given by the cashier sometimes changed or unclear. Hence, it can be assumed that the sale of goods without the use of price tags in student cooperatives Store still has a light ghara>r element, which lies in pricing. Due to the absence of a price tag, the management of the student cooperative sometimes speculated on their merchandise, giving rise to ghara>r. However, the ghara>r that occurs does not happen at the core of the trade, and does not cause hostility, so the buying and selling practice in student cooperatives store is legal.

Abstract

Western political concepts rooted in secularism, liberalism and rationalism have become the dominant currents in organizing the lives of modern societies. However, in practice, this model often fails to ensure social justice, societal stability, and the integration of moral values in the power structure. This article aims to analyze the fundamental weaknesses in the Western political system, especially in terms of ensuring a harmonious and just social order. Through a normative and descriptive approach, this study uses the perspective of Islamic law as a tool of criticism, which emphasizes the importance of the values of tawhid, justice (al-adalah), benefit (maṣlaḥah), and the responsibility of power (al-mas'ūliyyah). The analysis shows that Islamic politics offers a more complete ethical and transcendental framework in sustaining social life, compared to Western politics that tend to be technocratic and pragmatic. Thus, it is necessary to reorient global political thought so that it does not only focus on legal-formal aspects, but also on the spiritual and moral dimensions that are at the core of Islamic law.

Abstract

Javanese people are known to hold on to the traditions of their ancestors. However, many young people just follow the tradition without knowing the beliefs contained and the law in Islam. The purpose of this study is to explain the Mendhem Ari-Ari Tradition in Javanese beliefs in Lidah Wetan Village according to the analysis of 'urf rules. This research is a qualitative research with descriptive-analytical research typology based on primary and secondary data collection methods as well as data collection methods through observation, interviews and documentation. The findings of this research: 1) The tradition of Mendhem Ari-Ari in Javanese beliefs in Lidah Wetan Village, Lakarsantri District, Surabaya City is carried out by using flower sesarat and wishing tools and then covering the grave with a basket for 40 days. 2) The review of the analysis of the rules of 'urf on this tradition is punished as a tradition that should not be done because it does not fulfil one of the requirements of urf and is categorised as fasid urf. But it can be done as long as it does not conflict with Islamic law.

Abstract

The development of digital technology has encouraged zakat management institutions, including BSI Maslahat, to provide online zakat services. This study aims to analyze the online zakat mechanism at BSI Maslahat Surabaya and review it based on the perspective of maqashid syariah. This study uses a qualitative method with a descriptive approach. Data was obtained through field research in the form of interviews with BSI Maslahat Surabaya and a literature study on the concept of maqashid syariah. The analysis focused on the suitability of the zakat collection and distribution mechanism with the five aspects of maqashid, namely hifz al-din, hifz al-nafs, hifz al-aql, hifz al-nasl, and hifz al-mal. The results of the study show that the online zakat mechanism at BSI Maslahat Surabaya is generally in line with the principles of maqashid syariah, in terms of ease of payment, distribution of funds to mustahik, transparency of information, empowerment programs, and the security system for fund management. However, improvements in digital literacy and optimization of information delivery are still needed.
