Abstract

This research aims at finding out the practice of selling goods without price tags and the fiqh mu’amalah review on its sales at student cooperative stores of PMDG Campus. The method used in this research is descriptive qualitative which describes the various conditions, situations and social phenomena that occur. Applying the field research, this study uses the interview results with the management of student and consumer cooperatives, as a source of data collection. Based on this research, sales in student cooperatives apply the same system as in supermarkets, where the consumer takes the items he wants to buy on the storefront, then takes them to the cashier to carry out the transaction process. Since the price tag is not included, the price given by the cashier sometimes changed or unclear. Hence, it can be assumed that the sale of goods without the use of price tags in student cooperatives Store still has a light ghara>r element, which lies in pricing. Due to the absence of a price tag, the management of the student cooperative sometimes speculated on their merchandise, giving rise to ghara>r. However, the ghara>r that occurs does not happen at the core of the trade, and does not cause hostility, so the buying and selling practice in student cooperatives store is legal.

Abstract

Western political concepts rooted in secularism, liberalism and rationalism have become the dominant currents in organizing the lives of modern societies. However, in practice, this model often fails to ensure social justice, societal stability, and the integration of moral values in the power structure. This article aims to analyze the fundamental weaknesses in the Western political system, especially in terms of ensuring a harmonious and just social order. Through a normative and descriptive approach, this study uses the perspective of Islamic law as a tool of criticism, which emphasizes the importance of the values of tawhid, justice (al-adalah), benefit (maṣlaḥah), and the responsibility of power (al-mas'ūliyyah). The analysis shows that Islamic politics offers a more complete ethical and transcendental framework in sustaining social life, compared to Western politics that tend to be technocratic and pragmatic. Thus, it is necessary to reorient global political thought so that it does not only focus on legal-formal aspects, but also on the spiritual and moral dimensions that are at the core of Islamic law.

Abstract

Javanese people are known to hold on to the traditions of their ancestors. However, many young people just follow the tradition without knowing the beliefs contained and the law in Islam. The purpose of this study is to explain the Mendhem Ari-Ari Tradition in Javanese beliefs in Lidah Wetan Village according to the analysis of 'urf rules. This research is a qualitative research with descriptive-analytical research typology based on primary and secondary data collection methods as well as data collection methods through observation, interviews and documentation. The findings of this research: 1) The tradition of Mendhem Ari-Ari in Javanese beliefs in Lidah Wetan Village, Lakarsantri District, Surabaya City is carried out by using flower sesarat and wishing tools and then covering the grave with a basket for 40 days. 2) The review of the analysis of the rules of 'urf on this tradition is punished as a tradition that should not be done because it does not fulfil one of the requirements of urf and is categorised as fasid urf. But it can be done as long as it does not conflict with Islamic law.

Abstract

The development of digital technology has encouraged zakat management institutions, including BSI Maslahat, to provide online zakat services. This study aims to analyze the online zakat mechanism at BSI Maslahat Surabaya and review it based on the perspective of maqashid syariah. This study uses a qualitative method with a descriptive approach. Data was obtained through field research in the form of interviews with BSI Maslahat Surabaya and a literature study on the concept of maqashid syariah. The analysis focused on the suitability of the zakat collection and distribution mechanism with the five aspects of maqashid, namely hifz al-din, hifz al-nafs, hifz al-aql, hifz al-nasl, and hifz al-mal. The results of the study show that the online zakat mechanism at BSI Maslahat Surabaya is generally in line with the principles of maqashid syariah, in terms of ease of payment, distribution of funds to mustahik, transparency of information, empowerment programs, and the security system for fund management. However, improvements in digital literacy and optimization of information delivery are still needed.

Abstract

Perundungan (bullying) masih sering terjadi pada anak-anak, termasuk di lingkungan pendidikan nonformal seperti Taman Pendidikan Al-Qur’an (TPA). Bentuknya beragam, mulai dari ejekan, julukan yang buruk, pengucilan, hingga tindakan fisik. Kegiatan pengabdian masyarakat ini bertujuan membina santri TPA Al Abrar agar memahami, mencegah, dan menjauhi perundungan dengan meneladani akhlak Rasulullah saw. dalam berteman. Kegiatan dilaksanakan melalui lima tahap, yaitu observasi dan koordinasi awal, penyusunan materi, penyuluhan interaktif, praktik adab berteman, serta evaluasi. Metode yang digunakan meliputi cerita teladan, tanya jawab, permainan edukatif, bermain peran, dan kampanye “Lisan Sholeh, Teman Senang”. Hasil kegiatan menunjukkan bahwa santri lebih memahami arti perundungan, lebih berani menolak dan melaporkannya, serta mulai membiasakan tutur kata yang baik. Pengajar juga memperoleh panduan sederhana untuk mencegah dan menangani perundungan. Pembinaan berbasis keteladanan Rasulullah saw. terbukti mudah diterima anak dan layak dilanjutkan secara berkala.

امللخصيفتح مشاهري إنستغرام واخلدمات الرتوجيية املفتوحة، ولكن ليس كل املشاهري يهتمونابملعامالت اليت يقومون هبا، سواء كان وفقا للشريعة اإلسالمية، فالكثري منهم يقومون ابملعامالتفقط ابالهتمام ابألرابح، على الرغم من أنه من املناسب أن نرى كيف تكون ركائز املتطلباتواملبالغ وأيضا آلية األجور. هناك الكثري من عدم اليقني عند إعطاء األجور وفقا للوقت املوعود.توجان. مث يريد الباحث معرفة نظام أجور التأييد من خالل وسائط إنستغرام يف إندونيسيا.وكيف يكون مفهوم األجور يف املصادقات على فقه املعامالت. منهج البحث املستخدمة هيمنهج النوعية، ونوع البحث هو البحث القائم على أساس. نتائج التحليل أوال، نظام أجوراملصادقة من خالل وسائط إنستغرام يف إندونيسيا، ونظام التعاون الذي تقوم به املتاجر عرباإلنرتنت واملشاهري يتوافق مع اللوائح احلالية، وآلية حتديد األجور من اجلهات الفاعلة التجارية)املتجر عرب اإلنرتنت( إىل املشاهري واليت ميكن القيام هبا يف بداية املعاملة وميكن أيضا أن تكونيف هناية املعاملة وفقا لالتفاقية. ومع ذلك، ال تزال هناك تناقضات يف توقيت أجور املشاهري،واليت غالبا ما حتدث أتخريات يف توفري أجور املشاهري، مما خيلق خسائر للمشاهري. اثنيا، مكافأةالتظهري من خالل العديد من وسائل اإلعالم على إنستغرام وفقا للفقه، ألنه من احلساابتالثالثة أعاله، ميكن استنتاج أن الثالثة قد استوفوا معايري األجر يف الفقه، مثل احلساابتآليات حتديد األجور املوجودة يف البداية أو الدافعني قبل العمل, األجر مربروفقا للشافعي واحلنبلي وهو أجر نتائج خدمات ترويج املنتجات. تقع املكافأة اليت حتدث علىحساب يف البداية وبعضها يف النهاية بعد العمل ، وفقا لالتفاقية. األجر جائزعند الشافعي واحلنبلي حيث يقع األجر يف البداية ، واألجر النهائي جائز عند احلنفي واملالكيواحلنبلي. يف حني أن املكافأة على حساب تعطى عند اكتمال العمل.ممارسة التعاون يف احلساابت التعاقدية مباحة عند احلنفي واملالكي واحلنبلي

ملخص ابلحثابليع عرب اإلنرتنت أو نشري إيلها باتلجارة اإللكرتونية يف كتب معامالت الفقهية املعارصة يوضح أن تعريفابليع عرب اإلنرتنت هو أمر به أسعار نقدية وسلع غري نقدية. أحد األمثلة ىلع ذلك هو التسوق عرب اإلنرتنت)عرب اإلنرتنت( من خالل السوق. يف بدلنا إندونيسيا ، يسمح لألطفال اذلين دليهم معايري تقل أعمارهم عن 17اعما أو أقل بإجراء معامالت ابليع والرشاء. توضح املادة 1457 من القانون املدين أن: "ابليع هو اتفاق يلزمبموجبه أحد الطرفني نفسه بتسليم يشء ، والطرف اآلخر بدفع اثلمن املوعود" وتوضح املادة 1458 من القانوناملدين أن: "يعترب ابليع قد تم بني الطرفني ، بمجرد أن يتفق هؤالء األشخاص ىلع اليشء وسعره ، حىت لو لم يتمتسليمه ، ولم يتم دفع اثلمن. بعد أن رأى ابلاحثون ملحة عن حدوث معامالت ابليع عرب اإلنرتنت يف MobileLegends اهلاتف املحمول اليت تم تنفيذها يف الغالب من قبل األطفال دون السن القانونية يف خضمMagelang Sawangan Mangunsari ، اكن ابلاحثون مهتمني جد ا بتقديم نظرة ثاقبة للمقيمني اذليناكنوا يف احلد األدىن من املعرفة ، خاصة حول تنفيذ بيع األلعاب عرب اإلنرتنت يف MangunsariMagelang Sawangan آلباء األطفال دون السن القانونية. تهدف هذه ادلراسة إىل تقديم ملحة اعمةللمقيمني عن منهجيات بيع حسابات ألعاب Legends Mobile عرب اإلنرتنت ولإلبالغ عن الرشيعةاإلسالمية بليع حسابات Legends Mobile عرب اإلنرتنت ضد القارصين. يستخدم هذا املنهج ابلحيثمصادر بيانات نوعية وصفية تستخدم ويه بيانات أويلة وثانوية، ويشمل هذا ابلحث امليداين واملالحظةواملقابالت واتلوثيق كتقنيات جلمع ابليانات. يف تنفيذ رشاء وبيع حسابات لعبة Legends Mobile، خلصابلاحثون إىل أن األطفال اذلين يقومون برشاءحسابات Legends Mobile قيل إن رشوط ابليع صاحلة ألنابلائع واملشرتي قد نفذا رشوط وأحاكم ابليع.

Abstract

Indonesia is a country rich in cultural diversity, one of which is Javanese culture which is full of philosophical values ​​and symbolic meanings in every practice, including in the traditional wedding procession. One of the important rituals in Javanese traditional weddings is the Panggih Manten ritual, which represents the meeting between the bride and groom with various symbols of life, hope and blessings. Along with the development of the times and the flow of modernization, people's understanding of the philosophical meaning of the ritual has shifted. Some people still carry out this tradition as a hereditary custom without understanding the values ​​contained in it, even giving rise to debates regarding its suitability with Islamic teachings. This study aims to analyze the practice of the Panggih Manten ritual in Javanese traditional wedding traditions and review its suitability with the 'Urf argument in Islamic law. The research method used is qualitative with a juridical-normative approach, while the research location was carried out in Pengkol village, Mantingan District. The results of the study show that the Panggih Manten ritual is basically acceptable in Islamic law as long as it does not conflict with the principles of sharia. Based on analysis from the perspective of al-'urf, several aspects of the Panggih Manten ritual, such as muter asem (the act of making offerings), and the belief in disasters, contain elements that are inconsistent with Islamic law and could potentially lead to idolatry, thus being categorized as al-'urf al-fāsid. Therefore, the Panggih Manten tradition can be preserved through reinterpretation of its meaning and the elimination of elements that contradict Islamic teachings, thus aligning it with Islamic principles.
