Abstract

When the issue of polygamy arises, it always be a public concern. For example, when PSI open the campaig for anti-polygamy. On another side, there are those who advocate polygamy because they consider it as a suggestion in Islam. Even tough they open a class to give tricks about how to be able to polygamy without any turmoil with the previous wife. As if the issue of polygamy is never over. So it is interesting to see the whole problem of polygamy in the poles, both in the fields of interpretation, hadith, or fiqh. By connecting with the issue of polygamy in the Indonesian context. The conclusion is that polygamy is regulated in Islam not to cause mafsadat, therefore polygamy needs fair attitude in treating all wives. Indonesia present on this issue to ensure a fair attitude so that permission from the first wife was required. And this requirement must be fulfilled, because it is a part of the obligation to obey the priest which is a religious command.

Abstract

This study is to examine the main function of Friday sermons and Islamic boarding schools in countering radicalism. The main reason for the existence of radicalism is the lack of religious understanding, especially regarding the verses of the Qur'an and Hadith which are only understood textually and are truncated. This happens because of the lack of exploring and comprehensively reviewing the contents of the Qur'an. One of the important moments to convey religious knowledge in the midst of society is the Friday sermon which has become a routine for every Friday prayer. Where maybe only this weekly opportunity they can gather and attend the majlis in the midst of their busy lives. Here, Islamic boarding schools as educational institutions in transforming scientific values and exemplary, are urgently needed to provide role models and become examples of how the Friday sermon theme delivered relates to explanations related to religious texts (al-Qur'an and Hadith), namely explaining the content of the Qur'an, especially those related to radicalism, which is widely misunderstood. In addition, pesantren can unite Muslims in following the correct rules of understanding the Qur'an and Hadith.

Abstract

Keharmonisan dalam rumah tangga merupakan cita-cita bersama yang selalu ingin dicapai oleh pasangan suami istri, namun masalah dalam rumah tangga adalah sebuah keniscayaan. Setiap masalah yang muncul akan diselesaikan secara pribadi oleh mereka. Ketika tidak bisa diselesaikan, maka akan berakhir di depan Hakim, dan hakim tidak langsung memutuskan, melainkan masih mencoba untuk memediasi, agar tidak terjadi perceraian atau pertikaian. Hal ini yang diatur dalam dunia peradilan melalui Peraturan Mahkamah Agung, yakni melalui jalur mediasi. Dalam dunia hukum Islam mediasi ini melalui perantara hakam yang telah ditunjuk oleh hakim. Penelitian ini fokus dalam memandang pelaksanaan mediasi perceraian di Peradilan Agama dalam perspektif hukum. Penelitian ini merupakan penelitian kepustakaan, dalam arti menjadikan konsep tetang hakam untuk membaca pelaksanaan mediasi di Pengadilan Agama, lebih khususnya dalam masalah perceraian. Kesimpulannya, pelaksanaan mediasi yang dilakukan di Pengadilan Agama banyak berbeda dengan yang sudah dijelaskan dalam hukum Islam, khususnya dalam segi wewenang hakam yang berbeda dengan yang dimiliki oleh mediator. Namun hal ini tidak menjadi persoalan karena konteks yang berbeda, yang akan munculnya perbedaan cara yang ditempuh untuk mewujudkan perdamaian bagi kedua belah pihak yang berperkara

Abstract

Religious moderation is increasingly intensified to compensate some groups who continue to make the religious issues as object of conflict. The issue of religion is made as a commodity for political interests, even though Islam has been moderate since its inception. There is a lot of concrete evidence to show that Islam is a moderate religion. Become the mediator of religions that have been held before. Actually, when examined the moderation of Islam it has been built for a long time in Indonesia, especially in the world of islamic boarding school (pesantren). Including in Ma'had Aly (MA) Situbondo, as the institution that takes the Fiqh and Ushul Fiqh for its focus of learning studies, which is under the authority of the Salafiyah Syafi'iyah Islamic Boarding School Sukorejo Situbondo. Seeing the results of their discussion, which stated in Tanwirul Afkar Magazine, it can be seen that they are very moderate. The Fiqh that they convey is not only seen as a product, but also as a process, and that become the reason for their reasoning power of ushuly is always appears. The proposition is not only textual, but it is also contextual. Therefore from this good struggle with various kinds of fiqh madzhab and strengthened by the concept of ushul fiqh they had mastered make the moderate character formed by well.
