Abstract

AbstrakThis study is intended to determine the implementation of agricultural zakat in Mare District, Bone Regency. This type of qualitative research is located in Mare District, Bone Regency, precisely in four villages, namely: Ujung Tanah village, Doug village, Tellongeng village, and Batugading village. The results of the study show that: First, the level of understanding of the people in Mare Sub-district towards agricultural zakat fiqh is very minimal. The reason is mainly due to the lack of socialization and or counseling of zakat to the community. Second, farmers in Mare District, Bone Regency, in carrying out zakat on their agricultural products are not in accordance with zakat fiqh. For example, in paying zakat, farmers do not use the size of the niṣab and the level of zakat, but based on the willingness of the heart. Likewise with the distribution of zakat, because it is not deposited at UPZ, but is distributed to the poor, orphans and widows who are left alone. some are even deposited in the village government as funds for the public interest, and some are donated to mosques as community funds for the construction of mosques.Keywords: Fiqh of Zakat; Implementation; Construction; Agricultural Zakat.AbstrakPenelitian ini dimaksudkan untuk mengetahui implementasi zakat pertanian di Kecamatan Mare Kabupaten Bone. Dengan jenis penelitian kualitatif yang berlokasi di Kecamatan Mare Kabupaten Bone, tepatnya di keempat desa, yaitu: desa Ujung Tanah, desa Lakukang, desa Tellongeng, dan desa Batugading. Hasil penelitian menunjukkan bahwa: Pertama, sangat minim tingkat pemahaman masyarakat di Kecamatan Mare terhadap fikih zakat pertanian. Penyebabnya terutama dikarenakan kurangnya sosialisasi dan atau penyuluhan zakat kepada masyarakat. Kedua, para petani di Kecamatan Mare Kabupaten Bone dalam melaksanakan zakat hasil pertaniannya tidak sesuai dengan fikih zakat. Misal dalam membayar zakat, petani tidak memakai ukuran niṣabdan kadar zakat, tetapi berdasarkan kerelaan hati. Begitu juga dengan distribusi zakatnya, karena tidak disetorkan di UPZ, melainkan dibagikan kepada fakir miskin, anak yatim dan janda yang ditinggal sendiri. bahkan ada yang disetorkan di pemerintah desa sebagai dana untuk kepentingan umum, dan adapula yang disumbangkan ke masjid-masjid sebagai dana umat untuk pembangunan masjid.Kata Kunci: Fikih Zakat; Implementasi; Konstruksi; Zakat Pertanian.

Abstract

This research is a comparative study between the age limit of a guardian in marriage according to Islamic law and according to Indonesian law. With this type of qualitative research and normative theological and normative juridical approaches, with secondary data sourced from the Qur’an and the hadith of the Prophet. Marriage Law, KHI, PMA Number 11 of 2017, and other sources of literature. The results of the study show that: First, in Islamic law the determination of puberty criteria for men is based on ihtilam, and menstruation for women. Second, according to the provisions of article 18 PMA number 11 of 2007, the minimum age for a lineage guardian is 19 years, and for a lineage guardian who is not yet 19 years old, he cannot become a marriage guardian. This is intended for the good and benefit of all parties, because then the marriage custodian who has been Rusyd will be able to decide everything based on rational considerations, not because of emotion.
