Abstract

Abstract. Punishment towards adultery in Indonesian Penal Code is still debatable among legal experts or society. Even, every year, there are 2,6 million cases in Indonesia or every hour there are 300 women commit abortion due to unwanted relationship. It is due to Article 284 in regulating it, while in Islamic Criminal Law clearly regulates about it stating that the relationship is an adultery. The research shows that the adultery concept according to the Code is the concept of prevention at the end or after the commission meaning that the commssion is not deemed as a crime if the perpetrators are unmarried that can sue the party, the complain from the wife or husband, while in the Islamic Criminal Law the prevention concept is at the beginning that is prohibiting to attempt it or to commit it for every one committing it hence it can be punished despite the fact that there is no one husband or wife complains about it feeling loss. While, the ideal adultery concept regulation in the Code in the future is the change of adultery concept that can be found in the religious concept and it should be following the living values of Indonesian society. Key words: Punishment, Adultery, Indonesian Criminal Code and Islamic Punishment. Abstrak. Sanksi hukum terhadap perzinaan dalam KUHP masih menjadi perdebatan di kalangan para ahli hukum maupun di kalangan masyarakat sendiri. Bahkan setiap tahun terjadi 2,6 juta kasus aborsi di Indonesia atau setiap jamnya terdapat 300 wanita telah menggugurkan kandungannya, karena kehamilan yang tidak dinginkan atau dari hubungan gelap. Hal ini terjadi akibat ketidaktegasan Pasal 284 dalam mengatur masalah perzinaan, sedangkan dalam hukum pidana Islam dengan tegas mengatur bahwa setiap orang yang melakukan persetubuhan di luar perkawinan yang sah adalah perzinaan. Berdasarkan hasil penelitian diketahui bahwa, konsep pidana perzinaan menurut KUHP yaitu konsep pencegahan di akhir atau setelah terjadinya perzinaan, dalam artian perzinaan tidak dikatagorikan sebagai tindak pidana, apabila pelaku belum ada ikatan perkawinan yang sah dan dapat dituntut, jika ada pengaduan dari suami atau isteri yang merasa dirugikan, sedangkan dalam hukum pidana Islam konsep pencegahan di awal, melarang setiap perbuatan yang mendekati zina, apalagi perbuatan zina dan siapapun yang melakukan zina, maka dapat dipidanakan walaupun tidak ada pengaduan oleh suami atau isteri yang dirugikan.Sedangkan,konsep pengaturan perzinaan yang ideal dalam KUHP mendatang adalah perubahan konsep delik perzinaan harus dilihat dari sudut agama dan disesuaikan dengan nilai-nilai yang hidup dalam masyarakat Indonesia. Abstract

According to Islamic law, what is meant by marriage is a contract that justifies association and limits rights and obligations as well as mutual assistance between a man and a woman who are not between the two of them. "The purpose of marriage is to form a happy and eternal family, for that husband and wife need to help and complement each other, so that each can develop his personality to help and achieve spiritual and material welfare. stipulated age. Abstract

As with the marriage system in Indonesia, which adheres to a monogamous system, there is also another system, namely the polygamous system where a husband may have more than one, two, three or more wives. The scholars differ on the provisions and laws of polygamy. Among them there are those who approve of polygamy and there are also those who prohibit polygamy, except out of necessity (as rukhshah) under certain conditions. What is certain is that Islamic law does not prohibit polygamy absolutely (haram) and also does not recommend absolutely (mandatory). Some opinions state that the principle of justice in polygamy is not just quantitative justice, such as giving material or rotating time between wives, but includes qualitative justice, namely love which is the foundation of domestic life. The purpose of this research is to find out the meaning of the fair concept of polygamy according to Islamic law and also to find out how to apply polygamy correctly according to Islamic law today. Based on the data from the analysis, it can be concluded that in principle Islamic law allows polygamy in a marriage with various fairly strict requirements, polygamy is prescribed as other provisions of Islamic law are for the benefit of mankind. From this it must be realized that a man may practice polygamy as long as he can realize the benefit. However, if he cannot realize the benefit of doing polygamy, then he is prohibited from polygamous. The concept of fairness in polygamy is not only difficult to live by, but contains more harm than good. The difficulty of creating a harmonious life, because humans will in essence always feel lacking. And Fair in polygamy is very difficult to live in today's life.Keywords: Justice, Polygamy, Law, Islam, and Society.
