Abstract

The purpose of this study was to find out how Islamic law reviews the practice of debt and receivables in rice farming communities in Sukamantri Village, Tanjungkerta District, Sumedang Regency. This study uses a qualitative approach with case study methods and collects detailed and in-depth information using several data collection procedures during the period. certain. The results of this study indicate that the practice of debt and receivables in the rice farming community and rice dealers in Sukamantri Village, Tanjungkerta District, Sumedang Regency is contrary to Islamic law. However, in the practice of accounts payable, there is an additional that has been promised at the beginning by the rice farmer (creditor) and in additional delivery if it cannot pay off the debt, the addition is first given in the form of rice each time it is harvested.

Abstract

Tujuan dari penelitian ini adalah memberikan suatu gambaran tentang penerapan manajemen pemasaran Multi Level Marketing yang sesuai dengan Fatwa DSN-MUI No 75 Tahun 2009, serta manfaat yang diperoleh jika manajemen pemasaran tersebut diterapkan oleh kedua perusahaan. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kasus. Data yang dianalisis adalah hasil wawancara dengan distributor Sumedang kedua perusahaan, pengamatan langsung pada manajemen pemasaran yang dilakukan distributor Sumedang kedua perusahaan serta telaah berbagai informasi dan dokumen kedua perusahaan. Hasil penelitian menunjukan bahwa penerapan manajemen pemasaran pada PT. Milagros Indonesia Megah dan Millionaire Club Indonesia distributor Sumedang secara sistem kerja sudah sesuai dengan Fatwa DSN-MUI No 75 Tahun 2009. Namun dalam aspek legalitas ada yang belum memenuhi yaitu sertifikat dari Dewan Pengawas Syariah (DPS) dimana Dewan Pengawas Syariah (DPS) bertugas melakukan pengawasan terhadap proses manajemen pemasaran Multi Level Marketing agar tidak melenceg dari ketentuan-ketentuan syariah Islam. Tetapi ada suatu hal yang menyebabkan proses pembuatan sertifikat Dewan Pengawas Syaiah (DPS) menjadi terhambat sebagaimana yang terjadi pada salah satu perusahaan Multi Level Marketing yang diteliti.

Abstract

The purpose of this study was to see the theoretical and practical application of the Murabahah contract at the Tegalkalong Large Mosque Sharia Cooperative. This research uses a qualitative approach with a study method and collects detailed and in-depth information using several data procedures over a certain period. The results of this study indicate that in general the practice of the Murabahah contract at the Tegalkalong Grand Mosque Sharia Cooperative is in accordance with the MUI DSN Fatwa NO: 04 / DSN-MUI / IV / 2000 concerning Murabahah. However, there are 2 (two) points in the fatwa provisions regarding murabahah that are not in accordance with the practices carried out by the Tegalkalong Grand Mosque Sharia Cooperative, namely, the purchase of goods is represented by members, and members who buy goods on their own behalf, not on behalf of the cooperative. and when the cooperative performs a murabahah contract, at the same time the cooperative that carries out the wakalah contract because the purchase of goods is represented by the member and the member buys goods that have been agreed upon by themselves, this means that the murabahah contract is carried out before the goods become the property of the cooperative.
