Abstract

ABSTRAKPutusan Mahkamah Agung Nomor 139 K/Pdt.Sus HKI/2018 tentang pemegang merek terdaftar yang jangka waktunya berakhir dan belum perpanjangan merek, menyatakan bahwa penggugat tidak memiliki legal standing melakukan gugatan a quo. Penelitian ini berupaya memahami dan menganalisis apakah tepat atau tidak pertimbangan Mahkamah Agung dalam putusan tersebut (dilihat dari perspektif hukum materiil). Metode penelitian yang digunakan adalah yuridis normatif, dengan berbasis pada data sekunder. Berdasarkan hasil penelitian diketahui bahwa Mahkamah Agung kurang cermat dalam menjatuhkan putusan. Selaku judex juris, Mahkamah Agung seharusnya mempertimbangkan bahwa penggugat memiliki legal standing melakukan gugatan a quo didasarkan pada adanya iktikad tidak baik dari tergugat. Yaitu pertama, tergugat tidak melaksanakan putusan judex juris dalam perkara serupa Nomor 803 K/Pdt.Sus/2011, yang menyatakan penggugat adalah pemegang hak merek terdaftar, tetapi tergugat kemudian tetap menggunakan merek yang sama kedua kalinya. Kedua, penggugat memiliki legal standing mengajukan gugatan a quo adalah mengacu pada Pasal 77 Undang-Undang Nomor 20 Tahun 2016, yang menyebutkan bahwa gugatan pembatalan dapat diajukan tanpa batas waktu jika terdapat unsur iktikad tidak baik.Kata kunci: legal standing; judex juris; iktikad tidak baik. ABSTRACT Decision of the Supreme Court Number 139 K/Pdt.Sus HKI/2018 concerning registered brand holders which the period ended and the brand was not extended yet, states that the litigant does not have a legal standing to make a quo lawsuit. These researches analyze whether the Supreme Court's consideration is appropriate or not in the decision (viewed from a material legal perspective). The research used a normative juridical method, based on secondary data. The author believes that the Supreme Court was not accurate in giving decision. As a judex juris, the Supreme Court should consider that the litigant has a legal standing to make a quo lawsuit since the defendant has a bad faith. First, the defendant did not implement the judex juris decision in the similar case Number 803 K/ Pdt.Sus/2011, which states that the litigant is the holder of registered brand rights, but the defendant then continues to use the same brand twice. Second, the litigant has a legal standing propose a quo lawsuit referring to Article 77 of Law Number 20 of 2016, which states that an accusation for cancellation can be submitted without time limit if there is a bad faith. Abstract

Background. Often, conflicts occur in modern business. However, business disputes can be very detrimental to a company financially and to its reputation. Therefore, the role of corporate law firms in preventing and handling business disputes is becoming increasingly important. A corporate law firm can help manage risk and minimize the possibility of disputes. Purpose: The purpose of this research is to study how corporate law firms prevent business disputes. The focus of the research is to understand how they spot potential disputes, create strategies to prevent them, and how they handle disputes that arise. The main aim of this research is to provide deeper insight into how effective the role of corporate law firms is in reducing the risk of business disputes. Method. This research was conducted using a structured interview method. Members of corporate law firms who have relevant knowledge and experience in managing business disputes are the respondents interviewed. Using pre-prepared interview guidelines, interviews are conducted in person or via a virtual platform. Next, qualitative analysis was carried out on the interview data to find patterns, themes and important findings. Results. The research results show that corporate law firms are very important in preventing business disputes. To avoid disputes, respondents create clear contracts, provide training to employees, and monitor changes in legislation. Company authorities also handle disputes using mediation, negotiation, and arbitration. Conclusion. The study found that corporate law firms play a very important role in preventing and handling business disputes. By using the right strategy and proactively involving various parties, corporate law firms can help companies reduce risks and reduce the negative impact of business disputes. Therefore, investment in the development of a corporate law firm can be considered as feasible.
