Abstract

In the framework of the arrangement of the street hawkers in the city of Semarang, Semarang Municipality normatively has issued the Local Regulation No. 11 of Semarang City 2000 on the Regulation and Development of the street hawkers. This research used an empirical legal research and the analytical desriptive. The Implementation of the Regional Regulation No. 11 of 2000 on Regulation and Development of the street hawkers, technically made by the Office of Semarang City Market on duty and authorized to regulate the presence of street hawkers in all areas of Semarang. In the field implementation is coordinated by the Office of the District and the Subdistrict Office. The obstacles encountered in the implementation of the Regional Regulation No. 11 of 2000 on Regulation and Development of the street hawkers in Semarang, viz : lack of legal awareness, lack of supervision by the law enforcement officers, relocation, unadequate strategic, and economical factors.

Abstract

The existence of the Judicial Commission in the state system in Indonesia is very interesting to study more comprehensively. Based on the above background, it can be a problem as follows: How does the authority of the Judicial Commission in the conduct of monitoring the performance of judges in the court? The method used in this research is normative juridical (normative legal research). Specifications of research used is descriptive analytical. Data obtained from field research is the primary data and secondary data was analyzed qualitatively, ie an analysis of the primary legal materials, secondary law and tertiary legal materials. According to the research fund of the discussion can be concluded that the judicial commission in the state system is based on the Constitution of the Republic of Indonesia Year 1945 has a position as a body that is independent authorized to propose the appointment of justices and have other authorities in order to preserve and uphold the honor, dignity, dignity as well as the behavior of judges. The Judicial Commission has the authority to supervise the performance of judges in a transparent and participatory.

Abstract

The main matter, a case can be investigated trial by International court of justice is human right violence for instance genocide, war, ethnic killing, human trafficking and salve. No all legal action or law suit could be submitted to International court. Based on the background, could be inferred : How about the existence of International court of justice to take trial human crime ? The matter could be conclude that International court of justice one of United Nation organ which have the main task to solve the International dispute, human crime and human right violence in a country.

Abstract

International trade disputes that occur require an international institution to supervise and become the party that has the role to solve the problem. WTO as a world trade organization has an important role in efforts to resolve international trade disputes. Based on the discussion it can be concluded that the WTO as a world trade organization has an important role in resolving international trade disputes. Procedure for resolving international trade disputes. Procedures for resolving international trade disputes within the WTO framework can be carried out through the consultation stage Panels Formation, Panel procedures, Adoption of panels report, Appellate review, and Implementation.

Abstract

In fact Humanitary law had been arranged for civil defence organization. In reality some countries have been broken for the rules in solving of International conflict. Military operation had often been attacted to no really military obyect. Based on the background could be concluded as : How about development of humanitary law in International military conflict ?In this researct had used juridical normative methot. For specific research had used analysis descriptive. The main data from field research and the secondary data to analysis in qualitative.  Based on research and description to be concluded that humanitary law in solving of International military conflict have been growing fastly. It had been showed with International regulation more comprehensive in additional Protocol I / 1977 which arranget Civil Defence Organitation.Keyword : Humanitary Law, International Military Coflict.AbstrakHukum humaniter sesungguhnya telah mengatur tentang Civil Defence Organization. Kenyataan menunjukkan masih terdapat pelanggaran yang dilakukan oleh beberapa negara dalam penyelesaian konflik internasional. Operasi militer tidak jarang dilakukan untuk menyerang objek sasaran yang sebenarnya bukan merupakan objek militer. Berdasarkan latar belakang, dapat ditarik suatu permasalahan sebagai berikut: Bagaimana perkembangan hukum humaniter dalam konflik militer internasional ?Metode pendekatan yang dipergunakan dalam penelitian ini adalah yuridis normatif (penelitian hukum normatif). Spesifikasi penelitian yang dipergunakan adalah deskriptif analistis. Data yang diperoleh dari penelitian lapangan yang merupakan data primer dan data sekunder dianalisis secara kualitatif.  Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan bahwa hukum humaniter dalam penyelesaian konflik militer internasional mengalami perkembangan pesat. Hal ini ditunjukkan dengan adanya regulasi internasional yang lebih komprehensif dalam Protocol Tambahan I tahun 1977 yang mengatur terbentuknya civil defence organization.Kata Kunci          :               Hukum Humaniter, Konflik Militer Internasional

Abstract

The agreement that forms the basis for developing a joint venture company is the joint venture agreement and articles of association. A joint venture agreement is an agreement between prospective shareholders of a joint venture company subject to the law of contract. The imbalance of position in making Joint Venture Agreements is because foreign participants (Foreign Participants) are more substantial, mainly if foreign parties (Foreign Participants) have cultivated their business strength in the form of multinational (transnational) companies. This imbalance can cause the emergence of such cooperation to be unnatural and result in the strong party controlling the weak party. Such a cooperative relationship becomes a subordinate relationship, not a level relationship, and needs each other. This research aims to find out the concept or theory of legal protection for the Indonesian side in the Joint Venture Agreement. This research is prescriptive normative juridical research. Normative legal research in this study uses secondary data in the form of legal materials obtained through literature studies and emphasizes speculative-theoretical steps and normative-qualitative analysis. It is necessary to improve regulations regarding Joint Venture Agreements to provide legal protection for Indonesia in the Joint Venture Agreement. Because the agreement that forms the basis for developing a joint venture company is a joint venture agreement and articles of association. A joint venture agreement is an agreement between prospective shareholders of a joint venture company subject to the law of contract. The terms of the joint venture agreement should reflect a clear relationship between the parties and describe the development of the relationship in the future.

Abstract

The 2009 ASEAN Comprehensive Investment Agreement (ACIA) itself is one of the elements in supporting the establishment of the ASEAN Economic Community in 2015. This ACIA applies to investments that have existed on the effective date of this Agreement and investments made after the entry into force of this Agreement. The implementation of the ASEAN Comprehensive Investment Agreement (ACIA) provisions requires that all ASEAN member countries ratify this instrument. Indonesia ratified ACIA through Presidential Regulation of the Republic of Indonesia Number 49 of 2011 concerning Ratification of the ASEAN Comprehensive Investment Agreement, so it must commit to wide open the door to liberalization in the investment sector based on the ASEAN Comprehensive Investment Agreement. The approach method used in this research is a normative juridical approach. The approach used in this research is a juridical analysis. The juridical analysis approach method is intended to study the meaning and purpose of various legal rules and regulations. The results of this study show that the ASEAN Comprehensive Investment Agreement is one of the important pillars in the effort to realize the ASEAN Economic Community, which aims to increase investment activities among ASEAN member countries and make the ASEAN region competitive so that it becomes one of the destinations for investors in the world. National investment policy in the context of implementing the ASEAN Comprehensive Investment Agreement is carried out by issuing Presidential Regulation of the Republic of Indonesia Number 49 of 2011 concerning Ratification of the ASEAN Comprehensive Investment Agreement.
