Abstract

Misogyny is the behavior of someone hating women, both from men and fellow women. This behavior often places and views women as the cause of blame in a problem, even for something that is not really a problem. Misogyny causes a person tends to hate, look down on, blame, label and discriminate against women. This behavior is often associated with male privilege, patriarchal customs, and gender discrimination. In practice, this behavior will place men in a superior position, while women in an inferior position. In certain cases, misogynism can even increase the risk of physical, psychological and sexual harassment of women. There are two problems discussed in this study: 1) misogyny in the perspective of gender-based violence and 2) the relationship between misogyny and violence against women. This research is normative juridical research supported by empirical data on gender-based violence against women. Primary and secondary legal materials were collected through literature study. The research approach used is the statutory regulation, the legal concept, and the legal argumentation approach. Analysis of the collected data was carried out qualitatively.

Abstract

Body shaming is one of the verbal crimes that exist in cyberspace. According to the Clarity Clinic, body shaming is the act of humiliating someone based on their body shape by mocking them. Launching the official website of the Association of Anorexia Nervosa and Associated Disorders, body shaming is any act or practice of insulting other people's body shape or size, weight, hairstyle, dress and appearance. In this study, two problems will be discussed, namely 1) why body shaming act needs attention in criminal law policies and 2) how criminal law policies deal with body shaming. This research is a normative juridical research that examines legal norms regarding body shaming in Indonesia. Legal materials consist of primary and secondary legal materials collected through literature study. The analysis was carried out qualitatively. Body parts are used as objects to drop a person's image. Body shaming is a form of bullying or bullying. Practices like this can leave severe emotional trauma and disrupt the victim's mental health. The trauma experienced by the victim can even occur in the long term. This form of bullying can be carried out by the closest people such as parents, relatives, friends, strangers, to negative comments on social or conventional media. Body shaming act in cyberspace is a challenge in criminal law policy in Indonesia, both in the context of prevention and in law enforcement policies against perpetrators. Digital literacy is a very important pillar to understand that mocking someone's body shape is a crime.

Abstract

Social media provides facilities for citizens to exchange information, upload photos, videos and their daily activities. The activity of sharing personal information is too often referred to as oversharing. Psychological oversharing is a human need for attention and social support. But indirectly, this activity actually endangers the uploader. This study will discuss two problems, namely 1) the context of privacy and protection of personal data and its vulnerabilities and 2) digital literacy for the citizen community to overcome oversharing behavior. The concept of privacy basically provides an option for everyone to sort out private and public spaces for themselves. Personal data is transformed into public data when the owner shares the personal data in cyberspace. Digital literacy is needed to protect netizens from threats in cyberspace such as cyberbullying, intimidation, and even direct crimes such as robbery due to the behavior of netizens who show off their wealth on social media. Digital literacy will increase the social intelligence of netizens to determine what can and should be uploaded on social media. Key words: digital literacy, oversharing, social media.
