Abstract

In the United Nation of Republic of Indonesia the highest authorization holder is center government, but geographics of Republic of Indonesia is very large and divided into islands and archipelegoes and large and small regions so in running authorization, center government obliges to give part of its authority to regions, in order to manage each region. It is called decentralization or Region Authonomy. The principle of Republic of Indonesia can not be separated with principle of Region Authonomy, it includes in section I verse I Undang Undang Dasar 1945 and its and section 18 amandement, therefore Region Authonomy is sub system of Republic of Indonesia Authorization system. If it looked from Organization of Region Authonomy in Indonesia has organized since Freedom of Indonesia, and it happened before Indonesia Freedom, Holland and Japan have done Region Authonomy version Colonial, so it is impossible if Region Authonomy in Indonesia must be maintained and develops up to now.

Abstract

Corruption in Indonesia has leaded big impact and be a fundamental problem. It even has been setted in mind, that's why it needs serious preventing action from all sides. In general corruption is done by goverment officers who are doing administration duty of goverment, because of intentional factor to misuse the anthonty caretessness and even lack of accuration can be decived by law of criminal of corruption. Corruption case that has been happened was the case of area liberation for the guard-house of PLN in Samarinda that caused several public administration officers or civil servants are affected by criminal corruption punishment so that civil servants should be careful in performing their duty and not violate the laws, the effect for another government officers are afraid in doing their duty/task.Keywords : Corruption, civil servant, public administration task. Perbuatan korupsi di Indonesia selama ini telah membawa dampak yang sangat besar dan merupakan masalah mendasar bahkan telah mengakar sedemikian rupa, sehingga pemberantasannya perlu keseriusan dari semua pihak. Pada umumnya korupsi dilakukan oleh pegawai negeri yang sedang menjalankan tugas administrasi negara, karena unsur sengaja, menyalah gunakan wewenang, kelalaian dan bahkan kurang cermat bisa terjerat dijatuhi hukuman pidana korupsi. Pengalaman yang telah terjadi adalah kasus pembebasan lahan untuk kepentingan pembangunan gardu PLN di Samarinda, yang mengakibatkan beberapa pejabat administrasi kota Samarinda dijatuhi pidana korupsi, sehingga pejabat administrasi negara harus super hati-hati dalam mengemban tugas administrasi negara, akibatnya  terhadap pegawai negeri yang lain  ketakutan dalam menjalankan tugasnya.Kata kunci  : Korupsi, pegawai negeri, tugas administrasi negara.

Abstract

AbstractPurpose of this study is to find out the independence of the judiciary of corruption in the state system in Indonesia. The method used is a normative legal research methods (legal research), with the approach of the statute .Data sourced from legislation, library materials, and interviews. Qualitative data was analyzed in such a way and set out in writing a descriptive analysis. The results of this study illustrate that the independence of the corruption judiciary is determined from the independence of its institutions, the courts, and the judges. The intervention against corruption court decision is not aimed at her agency or the judicial process, but addressed to the judge overseeing the corruption case, in the form of feedback, criticism and even censure which was published in a newspaper that has led to contempt of court. AbstrakTujuan Penelitian ini ialah untuk mengetahui kemandirian pengadilan tindak pidana korupsi dalam sistem ketatanegaraan di  Indonesia.  Metode yang digunakan ialah metode penelitian hukum normatif (legal research), dengan pendekatan perundang-undangan (Statute approach) .. Data yang  bersumber dari perundang-undangan, bahan pustaka, dan hasil wawancara. Data kualitatif kemudian dianalisis sedemikian rupa dan dituangkan dalam bentuk tulisan secara diskriptif analisis. Hasil penelitian ini memberi gambaran bahwa bentuk kemandirian pengadilan tindak pidana korupsi ditentukan dari kemandirian lembaganya, proses peradilannya, dan hakimnya. Adanya intervensi terhadap putusan pengadilan tindak pidana korupsi bukan ditujukan terhadap lembaganya atau proses peradilannya, tetapi ditujukan kepada hakim yang menangani perkara korupsi, berupa tanggapan, kritik dan bahkan celaan yang dimuat dalam berita surat kabar yang sudah mengarah pada contempt of court.

Abstract

AbstractThis research discussed about the development of the constitution in Indonesia which has been determined since August 18 1945. The approach used in this research is yuridis normative, while the source of data is secondary data. The result of this research indicates that the constitution in Indonesia has ever been changed several times. It can be seen from UUD 1945, UUD rIS, UUDS 1950 and them turned back again to the UUD 1945, which has been approved for from times and it is valid until now on. The changeover of the constitution in Indonesia is caused by internal and external factors. It is also influenced by the real condition of law political which brings the impact to the change of the constitutional system in Indonesia.Key words : The development, constitution, IndonesiaAbstrakPenelitian ini membahas tentang perkembangan konstitusi di Indonesia yang telah ditetapkan  sejak tanggal 18 Agustus 1945. Pendekatan yang digunakan adalah yuridis normatif, sedangkan sumber datanya berupa data sekunder, analisisnya menggunakan diskriptif kualitatif.   Hasil yang diperoleh menunjukkan bahwa konstitusi di Indonesia telah mengalami perubahan beberapa kali, diantaranya adalah UUD 1945, UUD RIS, UUDS 1950 dan kembali lagi ke UUD 1945 hingga mengalami perubahan sampai ke 4 (empat) kalinya dan berlaku hingga saat ini. Perubahan konstitusi di Indonesia disebabkan oleh faktor eksternal dan faktor internal serta dipengaruhi oleh kondisi politik hukum yang ada kemudian berdampak pula pada berubahnya sistem ketatanegaraan di Indoensia.Kata kunci : Perkembangan, Konstitusi, Indonesia.
