Abstract

Within the same group as the USA and India Indonesia is one of the largest democracies in the world. After experiencing authoritarian rule for a few decades since its independence the country finally at the beginning of the twenty first century managed to chart along its new direction along democratic course and values. More than a decade has passed since the democratic transition begun  yet the country still faces various constitutional dilemmas and enigmas. One of organs of the government which has been entrusted to transform the country into a democratic nation is the Constitutional Court. The objective of  this  paper is to provide critical analyses of the role of the Constitutional Court of Indonesia in the process of consolidating local democracy. The scope of analysis is confined to a number of important cases heard by the court on local election disputes from the year 2008  to 2013. The rationale to focus on local election      is because local government provides the second layer of government for this unitary country making the governance more democratic and more in touch with local population. The result of the study is the Constitutional Court through its decisions has created conducive political situation and has provided significant contributions in the process of consolidating local democracy. In spite of limited number of judges and short period of settlement to disputes brought before it the Court have settled all disputes regarding local elections without much delay and complaint. Nevertheless there are some areas  that  need  to  be addressed by the court to enhance its efficiency and effectiveness. A few  factors  have  been identified to be the cause of the problems namely problem of design of structure of the Court, extension of the scope of authority, period of settlement, over-dosis of authority and the breach of  code of  ethics of  the judges.Thus it  is recommended that in order to perpetuate the excellent achievements of the court the institution need to be strengthened by addressing the problems.

Abstract

Putusan Mahkamah Konstitusi No. 46/PUU-XIV/2016 yang menolak perluasan makna zina yang ada dalam Kitab Undang-Undang Hukum Pidana menjadi topik yang ramai diperdebatkan. Sebagian masyarakat berpendapat bahwa seharusnya Mahkamah Konstitusi berani melakukan terobosan hukum dalam isu yang sangat penting tersebut. Namun, Hakim Mahkamah Konstitusi berpendapat perluasan makna zina tersebut bukan ranah kewenangan mereka. Penelitian ini bertujuan untuk mengkaji lebih jauh argumentasi hukum (ratio decidendi) putusan Mahkamah Konstitusi yang bersifat open legal policy dan bagaimana implikasinya terhadap pembentukan peraturan perundang-undangan di Indonesia. Penelitian ini merupakan penelitian kepustakaan dengan pendekatan undang-undang dan studi kasus terhadap beberapa putusan Mahkamah Konstitusi yang mengandung argumentasi open legal policy. Secara konseptual penelitian ini juga akan membahas bagaimana implikasi putusan Mahkamah Konstitusi yang mengandung open legal policy tersebut terhadap sistem legislasi nasional. Hasil penelitian menunjukkan bahwa pertama, konsepsi open legal policy dalam putusan Mahkamah Konstitusi belum memiliki batasan yang jelas sehingga pengertian positive legislator dan negative legislator sering dikacaukan dalam praktik pembentukan dan pengujian undang-undang. Kedua, putusan yang bersifat open legal policy tersebut juga menunjukkan bahwa di antara hakim Mahkamah Konstitusi telah terjadi tarik menarik penggunaan paradigma judicial activism dan judicial restraints sehingga menimbulkan ketidakpastian hukum di tengah masyarakat. Penelitian ini merekemomendasikan perlunya kajian yang lebih mendalam tentang disain open legal policy dalam putusan Mahkamah Konsitusi dan sistem legislasi nasional Indonesia.The Constitutional Court Decision No. 46/PUU/XIV/2016 which rejected the petition of petitioners to broaden the meaning of zina (fornication) in the Criminal Code of Indonesia has been becoming an interesting issue to be discussed. Some argue that the Constitutional Court must use its authority to conduct a break-through in responding the crucial legal issue. On the other hand, the Court asserted that widening the meaning of zina in the Criminal Code of Indonesia is not its authority. The research aims at discussing further the ratio decidendi of the Constitutional Court Decision which contains the element of open legal policy and its implication to national legislation system. The research is a normative legal research which uses statute approach and case law approach. The result of research shows that firstly, the concept of open legal policy in the Constitutional Court decisions does not have a clear limitation which implies uncertainty of its implementation in the Court decisions and the national legislation system. Secondly, the Decision of the Constitutional Court with open legal policy also shows that on one hand, there is a trend of using judicial activism among the constitutional judges. On the other hand, some constitutional judges also use judicial restraint approach as their reasons which results uncertainty of law in Court decision. The research recommends that there should be a further study on design model of open legal policy in the Constitutional Court decisions and its implication to national legislation system.

Abstract

There is an unclear definition regarding the qualification of a statesman in the candidacy of Constitutional Court Justices. In addition, no assessment is used to search for those who qualify as statesmen. This study aims to determine the nature and characteristics of statesmen as an indication of the selection mechanism of Indonesian Constitutional Court Justices and evaluate whether the selection mechanism may produce justice with statesman qualification. The research method is normative and empirical legal research, which uses philosophical, historical, conceptual, and statute approaches. The result shows that the concept and nature of statesmanship as a requirement for Constitutional Court Justices is based on the Republic of Indonesia's Constitution and the Constitutional Court Law, which states that Constitutional Court Justices must meet the requirements such as integrity and impeccable personality, fair; and statesman who control the Constitution and state administration. However, the recruitment procedure is excessively more political and unstandardized. Therefore, the current mechanism for selecting Constitutional Court Justices may not generate Justices with statesman-like behavior. The research recommends that in the future, the selection mechanism of the Constitutional Court Justices needs to be reconstructed to produce Justices with statesman qualifications by having a more transparent procedure.

Abstract

Pelaksanaan Pemilu serentak 2024 merupakan pelaksanaan pemilu serentak yang kedua setelah yang pertama pada tahun 2019. Makna pemilu serentak adalah pelaksanaan pemilu legislatif dalam semua tingkatan bersamaan dengan pelaksanaan pemilu presiden dan wakil presiden atau dapat disebutkan juga dengan pemilu 5 (lima) kotak suara. Tujuan dari pelaksanaan pemilu serentak selaian itu mengefektifkan pelaksanaan pemilu juga dengan tujuan terwujudnya sistem kepartaian sederhana yang dapat mendukung penguatan sistem pemerintahan presidensial. Bentuk sosialisasi dilakukan dengan diskusi di TVRI kemudian pemirsa dapat melakukan pertanyaan melalui layanan telpon yang disediakan adalah operator TVRI. Hasil sosialisasi ini menunjukkan bahwa pelaksanaan pemilu serentak tahun 2024 masih mempunyai banyak kekurangan baik dalam sisi kualitas sumber daya penyelenggara pemilu maupun dari sisi peserta pemilu karena praktik politik uang tetap terjadi meskipun sudah dibuat peraturannya dan penyelenggara pemilu untuk mengawasinya. Abstract

Di dalam Pasal 68 Undang-Undang No.23 Tahun 2014 diatur bahwa Presiden diberikan kewenangan untuk memberhentikan kepala daerah khususnya dalam hal kepala daerah tidak melaksanakan Program Strategis Nasional. Tujuan penelitian ini untuk mengevaluasi kewenangan dan mekanisme pemberhentian kepala daerah yang tidak melaksanakan Program Strategis Nasional tersebut. Jenis penelitian yang digunakan merupakan penelitian normatif yang mengkaji konsep hukum dan peraturan perundang-undangan di Indonesia. Data yang digunakan adalah data sekunder, yang terdiri dari bahan hukum primer, sekunder dan tersier. Hasil penelitian menunjukkan bahwa pertama, kewenangan Presiden dalam memberhentikan kepala daerah yang tidak melaksanakan Program Strategis Nasional dikarenakan pelanggaran kewajibannya, tidak diikuti dengan indikator yang jelas. Pemberhentian tersebut bertentangan dengan prinsip demokrasi karena kepala daerah dipilih secara langsung oleh rakyat. Kedua, mekanisme pemberhentian kepala daerah menurut Undang-Undang Nomor 23 Tahun 2014 juga tidak mengutamakan pertimbangan dan penilaian hukum. Pengaturan pemberhentian kepala daerah yang tidak melaksanakan Program Strategis Nasional belum ideal karena hanya menggunakan penilaian internal pemerintah seperti Aparatur Pengawas Internal Pemerintah. Oleh karena itu, diperlukan pengaturan dan target yang jelas dari pelaksanaan Program Strategis Nasional, penguatan peran dari Dewan Perwakilan Rakyat Daerah sebagai lembaga yang mempunyai fungsi kontrol dan pengawasan jalannya pemerintahan daerah dan diperlukan pembentukan sebuah forum bersama untuk melakukan dialog, penilaian dan klarifikasi antara pemerintah daerah dan pemerintah pusat terkait dengan alasan kepala daerah tidak melaksanakan Program Strategis Nasional.

Abstract

This study examined the delay in the passage of the Asset Forfeiture Bill in Indonesia, despite President Joko Widodo's (Jokowi) strong support. This study identifies several key factors influencing the legislative process, including internal political resistance in parliament, government priorities for economic development, and inconsistent policies. This study used qualitative approaches and thematic analysis to examine the legislative process's complex political, economic, and institutional contexts. The findings showed that the dynamics of political coalitions, the government's focus on infrastructure and foreign investment, governance challenges in ratifying the draft law included in the Prolegnas, and the COVID-19 pandemic are the main inhibiting factors. The study also emphasized the need to align national policies and laws with international legal standards, such as the 2003 United Nations Convention Against Corruption (UNCAC), to accelerate legal reform in the fight against corruption in Indonesia. This research provides important insights for policymakers and the public regarding legislative efforts during President Joko Widodo's administration to eradicate corruption through the legal framework of asset confiscation.

Abstract

Moving Indonesia’s capital city to the archipelago is a strategic policy aimed at addressing development inequality, reducing the burden on Jakarta, and creating a more sustainable center of government. However, the rapid legislative process and lack of public participation raise questions regarding the legitimacy of the policy. This study aims to analyze the legal politics of the National Capital City Law (UU IKN) as well as the social, economic, and environmental implications of relocating the capital city. Using a normative method with a descriptive and comparative approach, this study examines relevant regulations as well as other countries’ experiences in capital city relocation. The results show that capital city relocation faces challenges in governance, protection of indigenous peoples’ rights, as well as environmental impacts such as deforestation and increased carbon emissions. From an economic perspective, while it is expected to boost investment and regional development, the project faces funding constraints as well as social risks for affected communities. Therefore, more inclusive, transparent and sustainability-based policies are needed to ensure the success of this project. Strong regulations, fair compensation mechanisms for affected communities, and strict environmental policies should be top priorities. With a comprehensive approach, the archipelago can develop into a modern, competitive and sustainable capital city.
