Abstract

The development of communication technology is one of the causes of the increase in the crime rate in children so that they are caught in criminal acts. Regarding this matter, the Indonesian government has compiled a law on juvenile justice and implemented restorative justice. Likewise with Islamic law, which regulates punishment for children. This study uses a narrative method with a qualitative approach. The purpose of this research is to find out how child crime is enforced in the justice system. The results of this study indicate that the enforcement of juvenile crime can be attempted to use diversion, but still see what cases the children do first. Not all juvenile criminal cases can be resolved by means of diversion justice.

Abstract

Nagrak Village, Ciater District, located in Subang Regency has a BUMDes with the name Hasil Berkah Motekar which has been established since 2017. There is a Job Creation Law which explains that now BUMDes can run a business and/or public service company and form a legal entity business unit. The BUMDes does not yet have a legal entity, because the management of the BUMDes is constrained by technical problems in its management. During this period of service, assistance was provided in creating a business entity for the BUMDes of Nagrak Village. The activity was carried out in 3 stages, among them: Observation, discussion with the manager and registering BUMDes to the Ministry of Law and Human Rights. In this period of service, the author can contribute to BUMDes Results Berkah in obtaining a new Legal Entity which means it has the same position as business entities in general and hopes to be able to facilitate village partnerships, introduce regional potential, accelerate village economic development and success. Abstract

Tujuan dari penelitian ini adalah untuk mengetahui bentuk-bentuk perlindungan hukum terhadap debitur, penyelesaian sengketa dan langkah-langkah serta langkah-langkah preventif dalam layanan pinjam meminjam uang berbasis financial technology. Metode yang digunakan dalam penelitian ini adalah normatif, dengan menggunakan pendekatan hukum dan pendekatan kasus. Akses Hukum UU No. 19 Tahun 2011 tentang Otoritas Jasa Keuangan, UU No. 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik dan Peraturan No. 77/POJK.01/2016 tentang Otoritas Jasa Keuangan tentang Pinjaman dan Kredit Tunai Berbasis Teknolog Informasi. Pendekatan kasus didasarkan pada wawancara dan pelaporan data oleh OJK selaku regulator. Hasil penelitian ini menunjukkan banyak korban utang yang merupakan pengguna layanan fintech ilegal atau tidak berizin. Untuk melindungi peminjam dalam penerapan layanan ini, OJK bekerja sama dengan Asosiasi Fintech Pendanaan bersama Indonesia (AFPI) untuk menetapkan batas pinjaman dan pedoman proses penagihan pinjaman, yang hingga saat ini belum diatur. Selain itu, OJK bekerja sama dengan Kemeninfo terus rutin melakukan pemblokiran penyelenggara fintech P2PL ilegal dan membuka layanan informasi dan pengaduan konsumen
