Abstract

Sejak diundangkannya hingga saat ini, Undang-undang Nomor 31 Tahun 1999 jo Undang-undang Nomor 20 Tahun 2001, maka Undang-undang Pemberantasan Tindak Pidana Korupsi kini telah berlaku selama kurang lebih 20 (dua puluh) tahun. Dalam kurun waktu itu, Undang-undang Pemberantasan Tindak Pidana Korupsi telah digunakan untuk menjerat dan mempidana kepada banyak pelaku tindak pidana korupsi.Adanya ancaman pidana minimum khusus dalam Undang-undang Pemberantasan Tindak Pidana Korupsi dipandang sebagian kalangan telah membelenggu kebebasan hakim. Hal ini disebabkan hakim tidak dapat menjatuhkan putusan pidana di bawah ancaman pidana minimum khusus jika telah terbukti suatu perbuatan dilakukan oleh terdakwa. Sebagai contoh, jika seorang terdakwa telah terbukti melakukan perbuatan korupsi sebagaimana diatur dalam pasal 2 ayat (1), meskipun banyak hal-hal yang meringankan dalam diri terdakwa, maka hakim tetap harus berpedoman pada ancaman pidana minimum khusus dari pasal 2 ayat (1) tersebut, yaitu 4 (empat) tahun.Di satu sisi ancaman pidana minimum khusus dianggap membelenggu kebebasan hakim, namun di sisi yang lain ancaman pidana minimum khusus ini akan mencegah disparitas dalam penjatuhan pidana. Disparitas dalam penjatuhan pidana ini sering dijumpai pada tindak pidana yang dijerat dengan KUHP.

Abstract

Most of the criminal law reforms outside the Criminal Code currently use a special minimum criminal threat as an instrument of punishment. The formulation of the problem that will be discussed in this study is as follows, How to create a pattern of punishment that is not oriented to the mere imposition of imprisonment and does not cause problems in its application? The conclusion is that imprisonment is still considered effective in preventing and fostering criminals, but it is time for us to think about making policies that are not oriented only to the imprisonment of perpetrators. According to the author's suggestion, law enforcement officers must be more courageous in taking a stand regarding restorative justice efforts, prosecutors and judges have also begun to dare to impose demands and decisions whose criminal threats are in the form of alternatives. Legislators must apply the bottom-up principle in the preparation of criminal legislation. Keywords: Criminal System Reform, Imprisonment

Abstract

Abstract The low level of legal literacy in rural communities often leads to various social problems, such as inter-resident conflicts, rights violations, and low community participation in the village development process. This community service program aims to improve community understanding of the rights and obligations of citizens through participatory and applicable legal outreach activities. The implementation method includes identifying community needs, developing outreach materials, and implementing legal education through interactive lectures, group discussions, and simple case simulations relevant to village life. The activities also include the distribution of educational modules as a medium for continuous learning. Evaluation of the activities was carried out through pre- and post-tests to measure improvements in participant understanding, as well as participatory observation during the activities. The results of the activities showed an increase in community understanding of the rights and obligations of citizens, particularly regarding compliance with the law, conflict resolution through deliberation, and awareness of the importance of participation in village development. In addition, the community demonstrated increased awareness in accessing legal services and government administration correctly. This program has had a positive impact on increasing legal awareness and strengthening the relationship between the community and village officials in creating an orderly and harmonious social order. Thus, a village-based legal counseling program can be an effective legal empowerment model to improve the quality of social life in a sustainable manner.

Abstract

Public legal awareness plays a fundamental role in promoting legal compliance, strengthening the rule of law, and fostering responsible civic participation. However, limited legal literacy remains a significant challenge, contributing to low levels of legal understanding, inadequate recognition of citizens' rights and obligations, and persistent non-compliance with legal regulations. This study aims to explore how a Legal Literacy Program enhances public legal awareness and encourages legal compliance within the community. The research employed a qualitative approach using a case study design. Data were collected through in-depth interviews, participant observations, focus group discussions, and document analysis involving community members, legal practitioners, local government representatives, and program facilitators. The collected data were analyzed using the interactive model of Miles, Huberman, and SaldaƱa, including data condensation, data display, and conclusion drawing, while data credibility was ensured through source triangulation, member checking, and prolonged engagement. The findings reveal that the Legal Literacy Program significantly improved participants' understanding of legal rights, obligations, and available legal remedies. The program also fostered positive changes in legal attitudes by encouraging respect for legal norms, increasing trust in formal legal institutions, and reducing reliance on informal dispute resolution practices that conflicted with statutory law. Furthermore, the participatory and context-based learning approach enabled participants to relate legal knowledge to everyday social issues, thereby strengthening legal awareness and voluntary legal compliance. The study concludes that legal literacy constitutes an effective community empowerment strategy for cultivating sustainable legal consciousness and promoting a culture of legal compliance. These findings provide practical implications for policymakers, educational institutions, and legal aid organizations in developing inclusive and community-oriented legal education programs to strengthen public access to justice and reinforce the implementation of the rule of law.

Abstract

Legal awareness has become a fundamental determinant of public compliance with laws and regulations, particularly in the context of increasingly complex governance systems and the demand for effective law enforcement. Despite continuous legal reforms, variations in public compliance remain evident due to differences in individuals' understanding, attitudes, and perceptions of legal norms. This study aims to examine the influence of legal awareness on public compliance with laws and regulations. The research employed a quantitative explanatory design using a survey approach. Data were collected from members of the public through structured questionnaires using proportionate random sampling. Legal awareness was measured through four dimensions, namely legal knowledge, legal understanding, legal attitude, and legal behavior, while public compliance was assessed based on individuals' adherence to statutory obligations and regulatory requirements. The collected data were analyzed using Partial Least Squares Structural Equation Modeling (PLS-SEM) to evaluate the reliability and validity of the measurement model and to test the proposed structural relationships. The findings indicate that legal awareness has a positive and statistically significant effect on public compliance with laws and regulations. Individuals with higher levels of legal knowledge and stronger legal attitudes demonstrate greater willingness to obey legal norms and fulfill their civic obligations. Furthermore, legal awareness contributes to the internalization of legal values, strengthens trust in legal institutions, and promotes voluntary compliance rather than compliance driven solely by fear of sanctions. These findings highlight the strategic importance of legal education and awareness programs in fostering a sustainable culture of lawfulness. The study contributes to the literature on legal compliance by providing empirical evidence that strengthening legal awareness is an essential mechanism for improving public adherence to legal regulations and supporting effective governance.
