Abstract

Registration of land is a State obligation undertaken by the Head of the District Land Office/Cityassisted by PPAT, as mandated in Government Regulation number 24 of 1997 on Land Registrationand Government Regulation number 37 of 1998 on the Regulation of the Land Deed Officer Position.In this case I raised the issue of limiting factors in implementing the tasks PPAT associated withGovernment Regulation, as well as the implementation of the tasks PPAT in implementing landregistration data and guidance PPAT by Tangerang District Land Office. The method used is by usingempirical juridical approach to the specification of descriptive analytical research. Based on theresearch results can be given some conclusions that inhibiting factors in implementing the tasks PPATin supporting the maintenance activities of land registration data that there are still assignee is onlyintended to get a deed made by PPAT and is not intended to register their rights; so that the filesubmitted to the Land Office is not yet complete, and the result can not be implemented juridical datachanges. Abstract

Manusia hidup dan bertempat tinggal di atas tanah dan memanfaatkan tanah untuk sumber kehidupan. Mengingat begitu pentingnya tanah karena dapat menghasilkan sumber kehidupan yang sangat bermanfaat bagi orang banyak maka perlu diatur oleh pemerintah. Dalam Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah (PP No. 24/1997) yang menyatakan bahwa Pendaftaran tanah bertujuan untuk memberikan kepastian hukum dan perlindungan hukum kepada pemegang hak atas suatu bidang tanah yang terdaftar agar dengan mudah dapat membuktikan dirinya sebagai pemegang hak atas tanah yang bersangkutan. Berdasarkan penjelasan tersebut kami melakukan pengamatan di Kelurahan Mauk Timur dan langsung terjun kelapangan guna bertemu dengan tokoh masyarakat untuk mengetahui keadaan di Desa tersebut. Berdasarkan data yang diperoleh dilapangan bahwa kepemilikan sertifikat Tanah masih saja menjadi suatu kendala dalam masyarakat, lalu kami berdiskusi dan berkoordinasi dengan perangkat desa. Setelah kami selesai mengamati, lalu segera menyusun kegiatan dan langkah-langkah apa saja yang akan kami lakukan. Setelahnya barulah melaksanakan kegiatan. Kemudian kami melakukan koordinasi untuk melakukan sosialisasi penyuluhan tentang Pentingnya Pendaftaran Tanah dan fungsi PPAT (Pejabat Pembuat Akte Tanah) dalam proses pembuatan Sertifikat Tanah, di kantor kelurahan Mauk Timur.

Abstract

This study examines the role of legal awareness and community empowerment in enhancing access to justice within marginalized communities. Grounded in the perspectives of Legal Studies and Sociolegal Studies, the research explores how individuals’ understanding of legal rights and their capacity for collective action influence their ability to seek and obtain justice. The study aims to analyze the extent to which legal awareness contributes to empowerment processes and to identify structural and cultural barriers that hinder equitable access to justice. This research employs a qualitative approach using in-depth interviews, focus group discussions, and document analysis to capture the lived experiences of community members, legal aid providers, and local stakeholders. Data were analyzed through thematic analysis to identify recurring patterns related to legal knowledge, empowerment strategies, and institutional responsiveness. The findings reveal that increased legal awareness significantly enhances individuals’ confidence and willingness to engage with formal legal mechanisms. Moreover, community empowerment initiatives, such as legal education programs and grassroots advocacy, play a crucial role in bridging the gap between formal legal systems and vulnerable populations. However, the study also identifies persistent challenges, including limited institutional capacity, socio-economic inequalities, and cultural perceptions that discourage legal engagement. The research concludes that strengthening access to justice requires an integrated approach that combines legal literacy, participatory empowerment, and institutional reform. This study contributes to the development of more inclusive legal frameworks by emphasizing the importance of community-based strategies in achieving substantive justice.
