Abstract

Fenomena pemberlakuan hukum Islam memunculkan beragam teori yang ikut berperan dalam menentukan eksistensi Peradilan Agama di Indonesia. Adapun teori tersebut ialah teori receptio in complexu, receptie dan tiga counter theories yakni teori receptie exit, receptie a contrario, dan eksistensi. Masing-masing teori memberikan pengaruh yang berbeda dan memberi andil pada pasang surutnya Peradilan Agama. Penelitian ini bertujuan untuk mengkaji pengaruh teori-teori pemberlakukan hukum Islam terhadap perkembangan kedudukan dan kewenangan Peradilan Agama di Indonesia. Metode penelitian yang digunakan ialah yuridis normatif dengan mengkaji berbagai peraturan perundang-undangan terkait perkembangan kedudukan dan kewenangan Peradilan Agama. Hasil penelitian menemukan bahwa perjalanan politik hukum penguasa dalam memperlakukan Peradilan Agama bergantung dengan penerimaan keberlakuan hukum Islam. Jika hukum Islam dapat diterima, Peradilan Agama pun juga dapat diterima. Sebaliknya, jika keberlakukan hukum Islam dimatikan, Peradilan Agama pun akan bernasib sama. Oleh karena itu teori-teori yang memiliki argumentasi terhadap penerimaan keberlakuan hukum Islam akan memberi ruang postitif terhadap eksistensi Peradilan Agama. Sebaliknya jika teori tersebut berisi argumentasi yang kontra terhadap penerimaan hukum Islam, maka teori ini akan menjadi landasan kebijakan untuk mengebiri kedudukan dan kewenangan Peradilan Agama.

Abstract

o overcome the barriers in the dispute settlement in court, the Supreme Court issued a new mechanism for the settlement of civil cases, called as simple civil claims. The procedure mechanism was introduced through the issuance of PERMA No. 2 of 2015 concerning Simple Civil Claim. The researcher in this study intended to observe the implementation of the PERMA of Simple Civil Claim in Yogyakarta DistrictCourt, along with the obstacles. The study was conducted using the empirical juridical research methodand  analytical  descriptive  data  analysis.  From  the research  results,  it  can  be  concluded  that  the implementation of PERMA No. 2 of 2015 concerning Simple Civil Claim in Yogyakarta District Court is still ineffective in practice. This has been determined by various factors such as the rule of law, legal officers, facilities and infrastructure and community. The researcher also found a number of obstaclesfaced in implementing PERMA, some of which were related to the existence of options to choose the procedure  mechanism,  tight  case  qualifications  that  could  be  submitted  through  simple  program procedures and lack of PERMA socialization.

Abstract

Arbitration is an institution of dispute settlement based on arbitration agreements. An arbitration agreement may be an arbitration clause incorporated by a standing agreement or an arbitral agreement independent of its principal agreement. Based on the arbitration agreement, there are two principles named Niet van Openbaar Order and Pacta Sunt Servanda. Based on the principle of the arbitration clause of the Niet van Openbaar Order, the arbitration clause does not necessarily provide the competence of the arbitration body to resolve the dispute under arbitration agreements. Instead the principle of clause is Pacta Sunt Servanda provides absolute competence for the arbitration body to resolve the dispute. The existence of these two principles leads to a lack of interpretation of the absolute competence of arbitration among law practitioners. This study aims to find out how exactly the competence of arbitration institutions in settling disputes that have been bound arbitration agreement is based on the duality principle of Niet van Openbaar Order and Pacta Sunt Servanda arbitration clause in Indonesian law. The results of the study explained that the legislation in the legal system of Indonesia as stipulated in Law no. 30 of 1999 has expressly stated that absolute competence for arbitration institution as the institution of dispute settlement which is bound by arbitration agreement. Therefore, the legal practitioners should return to the legal norm in order not to happen again the tug of competence to adjudicate disputes between the arbitration institution and the court institution. With this it is expected that the legal certainty in the arbitration order can be enforced.
