Abstract

Pembuatan Akta Perjanjian Pengikatan Jual Beli (PPJB) pada praktiknya banyak menimbulkan permasalahan, salah satunya disebabkan oleh muatan Klausul Hak Membeli Kembali yang memberikan hak kepada Penjual untuk dapat membeli kembali objek tanah dan bangunan yang telah dijualnya kepada Pembeli. Sampai dengan saat ini tidak ada peraturan yang mengatur kebolehan atau larangan penggunaan hak tersebut, oleh karenanya banyak menimbulkan permasalahan, salah satunya adalah kasus pada Putusan Peninjauan Kembali Nomor 539 PK/Pdt/2020 di mana hakim justru menyatakan sah dan mengikat atas Akta PPJB yang memuat Klausul Hak Membeli Kembali. Berangkat dari hal tersebut maka permasalahan yang diangkat dalam penelitian ini adalah mengenai alasan dikategorikannya PPJB dengan Hak Membeli Kembali sebagai Penyelundupan Hukum serta analisis Putusan PK tersebut yang memperbolehkan penggunaan Hak Membeli Kembali dalam PPJB. Untuk menjawab permasalahan digunakan bentuk metode penelitian hukum yuridis normatif dengan tipologi penelitian preskriptif. Hasil analisis penelitian menunjukkan bahwa PPJB dengan Hak Membeli Kembali merupakan bentuk penyelundupan hukum kepemilikan tanah karena memenuhi unsur-unsurnya yaitu adanya perbuatan hukum penundukan kepada lembaga PPJB dengan Hak Membeli Kembali dengan cara menghindari lembaga utang-piutang dengan jaminan kebendaan dan ada niat untuk mencapai tujuan tertentu untuk memperoleh keuntungan. Selanjutnya terkait analisis putusan didapatkan hasil bahwa putusan tersebut tidak tepat karena melanggar Asas Kebebasan Berkontrak, Asas Iktikad Baik, Asas Keadilan, dan Asas Kesesuaian dengan Hukum Adat. Oleh karenanya untuk mencegah permasalahan serupa terjadi kembali diharapkan adanya pengaturan mengenai PPJB secara khusus serta kejelasan atas penggunaan Hak Membeli Kembali pada transaksi tanah. Kata kunci:  Perjanjian Pengikatan Jual Beli, Hak Membeli Kembali, Penyelundupan, Hukum Kepemilikan Tanah

Abstract

Jual beli yang dilakukan dengan “pura-pura” dihadapan Pejabat Pembuat Akta Tanah (PPAT) sehingga menghasilkan Akta jual beli “pura-pura” seharusnya dianggap bertentangan dengan ketentuan perundang-undangan, juga peraturan-peraturan lainnya dan dapat mengakibatkan akta tersebut batal demi hukum. Secara materiil jual beli tersebut tidak pernah terjadi sehingga telah melanggar salah satu syarat sahnya perjanjian yang diatur didalam Pasal 1320 Kitab Undang-Undang Hukum Perdata yaitu sebab yang halal. Penelitian ini menganalisis permasalahan berkaitan dengan akibat hukum dari dibatalkannya Akta Jual Beli oleh Pengadilan yang digugat oleh salah satu penghadap karena dianggap sebagai Akta Jual Beli “Pura-Pura” berdasarkan Putusan Mahkamah Agung Nomor 859 PK/Pdt/2019 dan tanggungjawab PPAT terhadap Akta Jual Beli “Pura-Pura” yang dibatalkan oleh Pengadilan. Bentuk penelitian yuridis normatif dan dilihat dari tipologi penelitian merupakan penelitian preskriptif. Metode analisis data yang digunakan adalah analisis kualitatif. Data dalam penelitian diperoleh dari studi kepustakaan. Hasil penelitian menunjukkan bahwa akibat hukum dari dibatalkannya Akta Jual Beli “Pura-Pura” dan dinyatakan tidak mempunyai kekuatan hukum, juga terhadap Sertipikat Hak Milik yang dianggap tidak pernah terjadi sejak awal dan jual beli “pura-pura” dianggap telah melawan hukum dan harus dibatalkan serta dianggap tidak pernah terjadi diantara keduanya karena jual beli bertujuan untuk kekal dan selama-lamanya. Tanggung jawab PPAT L terhadap Akta Jual Beli “Pura-Pura” yang dibatalkan oleh Pengadilan tidak dapat diterapkan baik secara administrasi maupun kode etik, tanggung jawab perdata maupun tanggung jawab pidana. PPAT “L” hanya menuangkan kehendak yang disampaikan oleh para pihak ke dalam akta tersebut, dan pelaksanaannya telah dilakukan sesuai dengan aturan hukum dan prosedur yang berlaku. Kata Kunci    : Akibat Hukum, Akta Jual Beli, Tanggung Jawab PPAT

Abstract

This research analyses the efficiency, effectiveness and impact of the resolving insurance claims disputes by the newly established The Alternative Dispute Resolution of Financial Services Centre (LAPS SJK) since The Indonesia Insurance Mediation and Arbitration Centre (BMAI) was closed (liquidated) by the order of the Indonesia Financial Services Authority (OJK), and its task and function in resolving insurance claims disputes was transferred to LAPS SJK. Juridical research method is used in writing this research with secondary data. The result of this research shows resolving of insurance claims disputes at BMAI was more efficient and effective than at LAPS SJK. In 2021, the first year of operation of LAPS SJK, there were 10 financial disputes resolved at LAPS SJK, of which 2 cases were insurance claims disputes. There is a total number of 13.516 financial disputes received by LAPS SJK in 2021 waiting for resolution of which 177 are insurance claims disputes. The very low achievement was very disappointed and not in accordance with one of the principle in resolving disputes that is efficient and effective at LAPS SJK. There is a bad impact of the bad achievement of LAPS SJK to the good reputation of insurance industry in the insuring public and the society. This research suggests LAPS SJK: 1 to immediately do a crash programme for resolving the pending financial disputes; 2 to adopt the Ajudication resolution method that is the most efficient and effective in time resolving the financial disputes, as it has only two hearings or three the maximum in the experience of BMAI during its services. With the Ajudication, the thousand pending financial disputes can be hopefully resolved more quickly; 3 to improve its infrastructures including the number of hearing and meeting rooms for arbitration, Ajudication, and Mediation, human capital with good experience, capacity and expertise, and 4 to appoint a new managing director or head of LAPS SJK with good experience in ADR, capacity, expertise, strong leadership, and good tract record.

Abstract

Insurance company defaults in Indonesia have a negative impact on policyholders. Suing the company for bankruptcy is the last resort for policyholders to obtain compensation from the company's assets, but the enforcement of court judgements is difficult due to obstacles such as abuse of receivership powers. Policyholders' rights are often violated as they do not receive insurance claim payments. Law No. 40 of 2014 requires insurance companies to participate in the Policy Guarantee Programme and establish a Policy Guarantee Agency within two years. However, such an institution has not yet been established in Indonesia. This research compares the Policy Guarantee Programmes in the UK and Japan to show the importance of establishing a similar institution to protect the rights of policyholders. This research uses normative research with a comparative approach and legislation. By studying the sustainability of the Financial Services Compensation Scheme in the UK and the Life Insurance Policyholders Protection Corporation in Japan, the research recommends that the Indonesian government promptly establishes a Policy Guarantee Corporation, either as an independent institution or in conjunction with the existing Deposit Insurance Corporation for the banking sector.

Abstract

This study examines and analyzes the rejection of insurance claims because the insured does not honestly disclose the history of illness he has experienced. The research method used is a normative juridical method with secondary data in the form of insurance legislation, insurance policies, and insurance literature, data analysis is carried out qualitatively. Insurance is an agreement to transfer risk from an insured or policyholder to an insurer or insurance company. The insured or policyholder should pay a certain amount of money as a risk transfer fee called the insurance premium. If there is a risk that has been agreed, the insurer must pay insurance benefits or claims whose amount has been stated in the policy which is referred to as the sum insured. Good faith in the form of honesty in filling out and answering questions at the beginning of the insurance closing process, especially medical history or illness that has been or is being suffered or experienced by the prospective insured is very important because it will have an impact on the claim settlement process. If the prospective insured or insured does not have good faith and does not honestly fill in and answer questions about the history of his health condition, it will have an impact on every claim that occurs and is submitted by the insured becomes not guaranteed by the policy, meaning that the insurer has no obligation to pay claims or policy benefits because the policy becomes null and void or void by itself as stipulated in Article 251 of the KUHD. To avoid disputes, and disappointment with the insured / policyholder in the claim, it is recommended that everyone who wants to buy an insurance policy always have good intentions, namely honestly in submitting data, information, and information about his medical history when filling out and answering questions in the Life Insurance Application Letter (SPAJ) form
