Abstract

ABSTRAKBank wakaf dapat didefinisikan sebagai Lembaga Keuangan Syariah yang menjalankan aktivitas wakaf uang termasuk dalam proses penghimpunan, pendayagunaan, dan pendistribusiannya dalam rangka memanfaatkan harta benda wakaf berupa uang sesuai dengan fungsinya untuk kepentingan ibadah dan untuk memajukan kesejahteraan umum. Bank wakaf dapat menjadi salah satu solusi dalam mengoptimalkan pengelolaan wakaf uang agar dapat meningkatkan kesejahteraan rakyat termasuk di Indonesia. Saat ini, pengelolaan wakaf uang melibatkan perbankan syariah sebagai lembaga keuangan syariah penerima wakaf uang. Menarik untuk dikaji bagaimanakah pembaruan regulasi sektor jasa keuangan dalam pembentukan bank wakaf di Indonesia. Penelitian ini menggunakan metode pendekatan yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Pembaruan regulasi sektor jasa keuangan dalam pembentukan bank wakaf di Indonesia adalah dengan melakukan perubahan perundang-undangan terkait wakaf uang yang khususnya meliputi Undang-Undang Perbankan Syariah dan Undang-Undang Wakaf beserta peraturan pelaksanaannya. Sebaiknya pembaruan regulasi tersebut dilakukan dengan membentuk forum koordinasi antar lembaga-lembaga terkait meliputi Kementrian Agama, BWI, OJK, BI, dan Komite Nasional Ekonomi dan Keuangan Syariah (KNEKS), terutama terhadap ketentuan-ketentuan yang berkaitan langsung dengan pengelolaan wakaf uang di Indonesia dengan membuat aturan khusus mengenai bank wakaf sebagai peraturan pelaksanaan dari Undang-Undang Perbankan Syariah dan Undang-Undang Wakaf yang sudah diperbarui yang memuat aturan secara terperinci mengenai operasional bank wakaf. Kata kunci: bank wakaf; perbankan Syariah; regulasi; wakaf ABSTRACTA waqf bank can be defined as a Sharia Financial Institution that carries out the money waqf activities, including in the process of collecting, utilizing and distributing in the context of utilizing the waqf properties in the form of money in accordance with their function for worship interest and also to develop the public welfare. Waqf Bank can be one of the solutions in optimizing money waqf management in order to improve the welfare of the people including in Indonesia. Currently, the management of money waqf involves Sharia Banking as a Sharia Financial Institution that receives money waqf. It is interesting to investigated how is the renewal of financial service regulation within the establishment of waqf banks in Indonesia. This research was engaging a normative juridical research method with descriptive analytical research specifications. Renewal of financial services sector regulations within the establishment of waqf banks in Indonesia is by doing the amendment which related to money waqf in particular that covering the Sharia Banking Act and Waqf Act together with the implementing regulations. It is recommended that the renewal of the regulation is conducted by establish a coordinating forum between relevant institutions which includes Ministry of Religion, BWI, OJK, BI and Sharia National Economics and Finance (KNEKS), especially regarding the provisions which relating directly to the money waqf management in Indonesia by making a specific regulation about waqf banks as implementing regulations of the Sharia Banking Law and updated Waqf Law which accommodate a detailed regulations regarding waqf banks operations. Abstract

The freedom to choose forum institutions and legal options in resolving business disputes is a freedom to contract exercised by national and international business actors, likewise in settling Islamic economic business disputes. This freedom of contract is recognized both in the principles of international trade law and Islamic law. The present development of sharia business transactions at the national and international levels does not rule out the possibility of disputes in its implementation. The consistency of implementing Islamic economics also concerns the choice of Islamic law, which is used as a choice of law for international business actors in case of a dispute between them. Studying how specific Islamic law can be applied to each country's national law is interesting. This article will discuss how Islamic law can be chosen to settle international business disputes using a normative juridical approach. Choice of law is the law the parties choose to resolve disputes between them, which can be expressed in their business contracts. The choice of law chosen by these parties in the settlement of international business disputes will also be closely related to the principles of Private International Law in harmonizing with the provisions of the National Law of each country. There needs to be mutual agreement from both countries, as well as international forums or institutions, especially international trade institutions, to support the recognition of the application of Islamic legal principles in resolving international business disputes through international agreements both bilaterally and multilaterally.
