Abstract

Tujuan penelitian ini adalah untuk mengetahui Pemanfaatan Lahan Pekarangan dengan Perlakuan Berbagai Model Pertanaman dan Pemberian Pupuk Organik Cair Buatan Pada Tanaman Kembang Kol (Brassica oleracea Var. Botritys L.) Penelitian ini dilaksanakan pada bulan Maret 2020 dan selesai pada bulan Juni 2020 di Kelurahan Tanobato Kecamatan Padangsidimpuan Utara Kota Padangsidimpuan, serta penelitian ini dilakukan dengan menggunakan metode Rancangan Acak Kelompok (RAK) faktorial dengan dua faktor. hasil perlakuan beberapa model pertanaman memberikan pengaruh yang nyata terhadap parameter tinggi tanaman pada semua umur pengamatan, parameter jumlah daun pada umur pengamatan 3 mst dan 5 mst, parameter umur berbunga, dan parameter berat segar tanaman per sampel. hasil perlakuan pemberian pupuk Organik Cair Buatan memberikan pengaruh yang nyata terhadap parameter tinggi tanaman pada semua umur pengamatan, parameter jumlah daun pada semua umur pengamatan, parameter umur berbunga, parameter berat segar tanaman per sampel dan parameter berat segar tanaman per model tanam. hasil interaksi kedua perlakuan memberikan pengaruh yang nyata terhadap parameter tinggi tanaman pada semua umur pengamatan, parameter jumlah daun pada umur pengamatan 3 mst, 7 mst, dan 9 mst, parameter umur berbunga, parameter berat segar tanaman per sampel dan parameter berat segar tanaman per model tanam. Pada parameter jumlah daun pada umur pengamatan 5 mst menunjukkan pengaruh yang tidak nyata terhadap kedua perlakuan.

Abstract

The issuance of Law no. 5 of 2014 concerning the State Civil Apparatus (ASN) almost four years ago became a new episode in managing the government bureaucracy. As a product of public policy, the ASN Law was born due to the encouragement of a policy environment in the form of the still low performance of the bureaucratic apparatus and the high politicization of the bureaucracy so that the public's demands on him were increasing. For more than five decades since independence in 1945, its existence and work were like the small spare parts of a giant state machine whose direction of development was highly dependent on the political rulers at that time. Reflecting on the above statement, the State Civil Apparatus Commission was formed, hereinafter referred to as KASN, which in general has the task of supervising ASN employees. In the ASN Law, KASN is a non-structural institution that is independent and free from political intervention to create professional and performing ASN employees, provide fair and neutral services, and become the glue and unifier of the nation. This writing uses normative juridical legal research methods (normative research). The nature of this research is descriptive, which aims to provide an overview of the role of the State Civil Service Commission. Sources of research data are in the form of primary legal materials, secondary legal materials and tertiary legal materials. The data collection method was carried out using document study techniques, which were analyzed using qualitative analysis techniques. Related to the function of KASN, it is contained in Article 30 of Law No.5 of 2014 that "KASN has the function of supervising the implementation of basic norms, code of ethics and code of conduct of ASN, as well as the implementation of the Merit System in ASN policies and Management in Government Agencies". KASN is tasked with maintaining the neutrality of ASN employees, supervising the ASN professional development and, reporting the supervision and evaluation of the implementation of ASN Management policies to the President. The State Civil Apparatus Commission can recommend the president to impose sanctions on civil service officials and officials who violate the principles according to the provisions of the law. The forms of sanctions referred to above lie in Article 33 paragraph (2), namely Warning, Warning, Correction, revocation, cancellation, issuance of decisions, and / or refunds, Disciplinary penalties for Competent Officers in accordance with the provisions of laws and regulations, Sanctions for Civil Service Officer, in accordance with the provisions of laws and regulations

Abstract

Gambling or Maisir is a criminal act, namely betting a sum of money, having a fate with every game that is lucky for the players, including all other bets where this crime is found in all circles and the community, the main problem discussed is regarding the sanction procedure. against the perpetrators of maisir, especially in Langsa City, which uses the Qanun on the Jinayat Law and the Criminal Law which go hand in hand in imposing sanctions on the perpetrators of maisir. This study uses a qualitative research method with an empirical approach by collecting data from the field through the Islamic Shari'a Service and the Police with interviews and observations as the premier data source. The results obtained show that gambling crimes are regulated in Aceh Qanun No. 6 of 2014 concerning the Jinayat Law regarding maisir which has the aim of preventing and overcoming maisir crime and the Nanggroe Aceh Province Qanun No. 13 of 2013 concerning Maisir (gambling) is in accordance with the ta'zir hukuman punishment in Islamic Criminal Law

Abstract

The journey of post-conflict local elections from the independence era to the reform era as it is now often changes the election mechanism. Starting from the direct election mechanism by the people to the indirect election mechanism chosen by the DPRD. Until its peak when Law No. 22 of 2014. The purpose of this study was to determine the effectiveness of indirect regional head elections through elections by the DPRD, the effectiveness of direct regional head elections through elections by the people, as well as obstacles to regional head elections through DPRD and local elections. directly by the people in a democratic system. The type of research used is empirical juridical research by conducting interviews, and in this case the data is processed using qualitative analysis. Based on the results of the study, the effectiveness of regional head elections through DPRD is indeed more effective because it can reduce the political budget that must be issued by the views of regional head candidates, and also minimizes/prevents clashes or debates in the community carried out between supporters of regional head candidates. The effectiveness of regional head elections through the people will better know what the vision and mission of the candidate pairs and the elected regional heads will have closer ties to the community because the community itself determines the figure who will lead their own region. Constraints in the election of regional heads through the DPRD are basically constrained because they cannot guarantee that the choices from the DPRD are in accordance with community expectations, while the obstacles in direct regional head elections include being constrained by the large political budget, causing conflict in the community due to frictions between the support of the candidate pair. In these areas, the large political costs that candidate pairs have to incur in nominating themselves are considered to have resulted in the candidates for regional heads committing corruption when they were elected and the high number of abstentions in some areas

Abstract

Basically, ethics and behavior for the State Civil Apparatus (ASN) are closely related. The two elements between ethics and ASN behavior support each other and have consequences, both administrative and legal sanctions if violated. This research is a normative legal research that uses secondary data in the form of primary legal materials, secondary legal materials and tertiary legal materials. From the results of the study, it is known that the ethics and behavior of ASN have been regulated in Law Number 5 of 2014 concerning State Civil Apparatus jo. Government Regulation Number 53 of 2010 concerning Civil Servant Discipline, and Government Regulation Number 11 of 2017 concerning Management of Civil Servants. The application of ASN disciplinary sanctions is not only in the form of administrative sanctions in the form of a maximum dismissal, but also does not rule out the possibility of legal proceedings related to the said discipline violations if there are elements of criminal, civil and other legal aspects

Abstract

Negara Republik Indonesia menerapkan sistem pemerintahan Presidensial. Dalam Pasal 4 ayat (1) Presiden Republik Indonesia memegang kekuasaan pemerintahan menurut Undang-Undang Dasar. Untuk dapat mengangkat dan memberhentikan Kepala Kepolisian Negara Republik Indonesia seorang Presiden harus terlebih dahulu mendapatkan persetujuan dari DPR. Institusi Kepolisian merupakan salah satu institusi yang berada dibawah dan bertanggung jawab langsung kepada Presiden. Adapun tujuan dalam penelitian ini adalah untuk mengetahui pelaksanaan pengangkatan dan pemberhentian Kapolri dalam sistem ketatanegaraan di Indonesia serta mengetahui pengaruh persetujuan DPR  atas pengangkatan dan pemberhentian Kapolri dalam perspektif konstitusi dan mengetahui akibat hukum pengangkatan dan pemberhentian Kapolri dalam sistem Presidensial. Jenis penelitian ini menggunakan pendekatan penelitian yuridis normatif. Sifat penelitian yang digunakan dalam menyelesaikan penelitian ini yaitu penelitian deskriptif. Sumber data yang digunakan dalam mengumpulkan data pada penelitian ini adalah data primer dan data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder seperti buku, jurnal dan tulisan ilmiah yang berkaitan dengan judul penelitian ini dan bahan hukum tersier. Hasil penelitian ini menjelaskan bahwa pelaksanaan pengangkatan dan pemberhentian Kapolri harus melalui mekanisme fit and proper test di DPR. Dimulai dengan Presiden mengusulkan nama calon Kapolri kepada DPR kemudian DPR dimintai keterangan atas persetujuannya dan jika disetujui barulah Presiden berhak untuk melantiknya. Atas keberadaan Undang-Undang Kepolisian No.2 Tahun 2002 ini membuat pengaruh yang cukup besar terkait hak prerogatif Presiden yang tidak terlaksana secara utuh dan penuh karena dalam sistem pemerintahan Presidensial dikenal bahwa Presiden memiliki hak istimewa atau hak prerogatif. Pengaruh tersebut memilki dampak hukum secara fundamental perihal melemahnya sistem Presidensial. Adapun atas kejadian ini membuat dasar sistem pemerintahan di Indonesia yang awalnya dianggap sebagai executive heavy bergeser menjadi ke legislative heavy. Mahkamah konstitusi dalam putusannya mengatakan bahwa keterlibatan DPR bukanlah suatu penyimpangan dari sistem Presidensial tetapi salah satu tindakan atas terwujudnya mekanisme check and balances antar lembaga

Abstract

This study analyzes compensation based on a civil law perspective using normative legal research methods by means of library research, namely research on written documents as data sourced from secondary data including primary legal materials, secondary legal materials and tertiary legal materials. The results of the research show that compensation based on a civil law perspective can arise not only due to a breach of performance, but also due to an act against the law. Although according to Article 1243 of the Civil Code, the notion of civil compensation focuses more on compensation for non-fulfillment of an agreement. Compensation based on a civil law perspective can arise either due to a default or unlawful act. The form of compensation is based on the form of loss experienced by the aggrieved party, which can be in the form of material loss or in-material loss.
