Abstract

The issue of corporate responsibility is still a matter of debate even though several laws outside the Criminal Code have listed corporations as the subject of criminal acts. This relates to the principle of error (geen starf zonder schuld), limits of ability to be responsible and forms of criminal responsibility. The research method used is a literature study research system where research is carried out by searching, reading, recording and analyzing findings in the field related to written sources such as books, journals, archives, articles or magazines that have a correlation with the problem being studied. In the socio-cultural field, corporate criminal acts are carried out in the form of actions that are detrimental to copyright holders, brands; not paying attention to the safety and health of workers/laborers; criminal acts that result in damaging education and the younger generation such as narcotics and psychotropic abuse and so on. In the Indonesian Criminal Code (KUHP), there is no known criminal provision that stipulates an artificial legal subject (rechtpersoon) or corporation, as a subject that can be subject to a crime. This can be seen in the general provisions of the Criminal Code which state that Indonesian laws and regulations apply to everyone.

Abstract

This research is motivated by strategic issues that develop in the community which shows that the role of the Samarinda City Social Service in fostering street children in Samarinda City is still considered lacking, seen from their guidance by including street children into the community. orphanages and in the program, it were stated that there was still no success because street children still chose to be on the streets. Therefore, this study aims to analyze how the role of the Social Service in providing guidance to street children. The research method used is a qualitative research method. The number of informants in this study were 5 people who were determined by data collection techniques using interviews, observation, and documentation. Then the data analysis technique used in this research is done by condensing the data, presenting the data, and drawing conclusions. Based on the results of the research analysis, it can be concluded that the role of the Social Service in the Guidance of Street Children at the Social Service of Samarinda City is still not optimal, seen from the dimensions of Facilitator, Education. Meanwhile, from the representational and technical dimensions, it can be categorized as good. The results of the study indicate that regarding the role of the Social Service as a Facilitator in collaboration with the Orphanage, it has provided facilities in the form of planned social assistance that occurs every year, as an education the social service provides services in the orphanage in the form of formal and non-formal education, as a representation of the social service in collaboration with community institutions such as the Satpol PP, the police, and the community. as a technical social service, collect data according to existing SOPs.Penelitian ini dilatarbelakangi oleh isu strategis yang berkembang di dalam masyarakat yang menunjukkan bahwa peranan Dinas  Sosial Kota Samarinda dalam pembinaan anak jalanan di Kota Samarinda masih dinilai kurang, dilihat dari pembinaan mereka dengan memasuk kan anak jalanan kedalam panti dan dalam program tersebut dinyatakan masih belum ada yang berhasil dikarenakan anak jalanan yang masih memilih berada dijalanan. Oleh sebab itu penelitian ini bertujuan untuk menganalisis bagaimana Peranan Dinas Sosial dalam memberikan pembinaan kepada anak jalanan. Metode penelitian yang digunakan adalah metode penelitian kualitatif. Jumlah informan dalam penelitian ini adalah 5 orang yang ditentukan dengan teknik pengumpulan data menggunakan metode wawancara, observasi dan dokumentasi. Kemudian teknik analisis data yang digunakan dalam penelitian ini dilakukan dengan cara kondensasi data, penyajian data dan penarikan simpulan. Berdasarkan hasil analisis penelitian dapat disimpulkan Peranan Dinas Sosial dalam Pembinaan Anak Jalanan di Dinas Sosial Kota Samarinda masih belum optimal dilihat dari dimensi Fasilitator, edukasi. Sedangkan apabila dilihat dari dimensi repesentasional dan teknis.sudah dapat dikategorikan baik.  Hasil penelitian menunjukkan bahwa mengenai peranan Dinas Sosial sebagai Fasilitator yang berkerja sama dengan panti Asuhan telah memberikan fasilitas berupa bantuan sosial terencana yang terjadi tiap tahunnya, sebagai edukasi dinas sosial memberikan pelayanan dalam panti berupa pendidikan formal dan non formal, sebagai representasional dinas sosial bekerja sama dengan lembaga badan masyarakat seperti satpol PP,kepolisian, dan masyarakat. sebagai teknis dinas sosial melakukan pendataan sesuai SOP yang ada.

Abstract

This study examines the authority of the Attorney General's Office in supervising corporate compliance with environmental regulations under Law No. 32 of 2009 and within the concept of Ius Constituendum. Employing a normative legal research methodology, the study integrates the Statute Approach and a legal concept analysis approach. The Statute Approach analyzes laws and regulations, while the legal concept analysis combines analytical and conceptual dimensions to address gaps in legal interpretation. The research highlights the critical role of the Attorney General's Office in enforcing environmental law, particularly in addressing corporate violations that contribute to environmental degradation in Indonesia. Findings reveal that despite its strategic role, limited human resources and technical capacity hinder effective supervision. To strengthen this role, the study recommends expanding the Attorney General's authority to include preventive, civil, administrative, and criminal enforcement. Additionally, enhancing human
