Abstract

The purpose of this article is to explore Jamal al-Banna's opinion about the correlation between fiqh and sunnah. Basically Fiqh with Sunnah cannot be separated, various kinds of actions carried out by the Prophet Muhammad SAW become the initial resting in the determination of laws relating to fiqh, activities carried out by scientists collect all the rituals and deeds of prophets which are termed on the basis of the Sunnah recorded by the Sunnah Companions when seeing or confronting the Apostle when educating his Companions. According to Jamal Al Banna, the current fiqh is only fiqh that was initiated by the scholars, not the Qur'anic and Sunnah fiqh. Jamal al-Banna divides fiqh into three characters; First justify the Qur'an as a foothold or the main basis for taking legal policy. However, in addressing al-Qur'an, Jamal al-Banna differed from the scholars, the previous interpretation. In fact he will not make their interpretation as the main source, because there is no requirement for taqlid to be blind to their work. Second, have attention to the sunna. According to Jamal al-Banna, the sunna that was recorded by the previous scholars was mostly a sunna that was included in the fake category. Third, Fiqh has attention to wisdom. Outside the Koran and the Sunna, in fact Allah Almighty. also reduce wisdom. God himself also points to who is entitled to wisdom. Wisdom is a treasure of Muslims spread across the world, and it is the duty of Muslims to find and use it as an effort to make fiqh renewal. As for Jamal al-Banna's opinion about the sunnah is the effort and struggle of the Prophet in giving and presenting guidance or guidance, explanatory or tabayyun, and explaining the details of the verses of the Qur'an. Jamal al bana gives a very significant difference if it is related to the phrase or the term Sunnah and Hadith, during this day Islamic thinkers are not too vigorous in giving the difference between these two words, according to him the Sunnah is the path taken by the Prophet Muhammad on his journey when preaching about rituals of Worship , such as prayer, pilgrimage, zakat, fasting and various other rituals, so that the way, the way the Prophet in doing this worship was passed down from generation to generation and followed by the next generation, the Prophet's expression, people who do not follow my sunnah then he is not a part of me, so this sunnah every act that is exemplified by the prophet peace be upon him in worship, behavior and other actions, then according to Jamal the sunnah is closer to the actions carried out by the Prophet Muhammad, then arises the term Sunnah Amaliah, are various methods, concepts or ways that carried out by the Prophet and educate Muslims in various rituals to religion.

Abstract

The study of Hadith developed in line with the development of science and Islam, so the study of this hadith began to be of interest to Muslim scholars, no less important is that western scientists also began to be interested in studying this hadith, although the basis and purpose of their research was different from that of Muslims, there were those who said that due to the renaissance, namely doubting all knowledge, so they began to re-examine all knowledge, including this effect on Islamic studies and thought, it is said that western scholars study this hadith driven by historical interests, so when they research hadith they are more likely to say only as a model of thought and not as legal texts. Western thinkers in studying this Hadith are based on nothing but wonder and curiosity, to what extent can these Islamic texts be trusted to be true, so that they have such a large mass appeal and followers, are getting more and more stretched and Islamic motivations are increasing. Western scholars feel the need to research and examine the sacred texts according to Muslims. So that western scholars have several approaches in studying hadith that have developed to date. Irene Schneider is an orientalist who is very interested in Islamic studies, she is very diligent in studying Islamic studies, culture, the history of Islamic thought, Irene does a lot of research related to Islamic law and the history of Islamic law, she also conducts research related to gender studies, relationships countries with people in the contemporary Islamic world, including how Muslims stretch in Germany. Irene Schneider's thoughts we can say that theoretically and scientifically it can be said that Irene was greatly influenced by Josep Schacht, we can see that several theories and concepts introduced by Josep Schachat were widely developed by Irene and he published in subsequent research and theories, especially rather he is able to say he is skeptical of the hadith of the Prophet SAW. and Islamic traditions, although on certain issues Irene also has differences with Josep Schacht, such as the Hadith that are based on the tabi'in.

Abstract

The purpose of this journal was made so that we can know the actions of the orientalists in criticizing the Hadith of the Prophet Muhammad, how the criticism submitted by the orientalists has various shortcomings and on that basis, we must see how the hadith among Muslim scholars occupies a very sacred position, so that their research on the validity of hadith is driven by the central role played by hadith as a source of law and theological doctrine. In contrast to western scholars (orientalists) or often termed outsiders, for them studying hadith is not based on theological doctrines but driven by historical interest. For example when studying Islamic law, they tend to approach it as a model of thought rather than a collection of rights, duties and rules. -cultural, although it is not evident from its subjectivity as an outsider. So for the reasons above we need to see how the orientalists criticize the hadith of the Prophet Muhammad

Abstract

The purpose of this journal was made so that we can find out how the two central figures gave fatwas and their ways of thinking regarding taklid in various religious issues. textually, both in the Qur'an and As-Sunnah, various kinds of scholars define ijtihad, namely devoting all abilities in seeking zhanni syar'i laws, within the limit until he feels unable to exceed his efforts , then what is the view of Shaykh Said Ramadhan Al-Buthi in matters of ijtihad or taklid that every person when encountering a fiqhiyyah problem, has only two choices, namely between thinking and doing ijtihad on his own while continuing to look for arguments that can answer, or taqlid following the opinion of the previous mujtahid. Ijtihad cannot just read one or two books, and even without a teacher who has scientific knowledge. If that happens, then the religious law will be damaged, whereas according to Shaykh Albani's view it is very combating the method of taklid, taklid is accepting whatever someone says, usually a scholar or expert in knowledge without questioning the validity of the basis of the basis of the law. Perseverance in the science of hadith causes Sheikh al-Albani not to be bound with certain sects. In fact, in principle, Sheikh al-Albani is bound by 4 schools of thought at once.
