Abstract

The  justice gender of issues continues to be voiced. The justice is the most central ideas as well as the highest goal is preached by every religion. Principal of mission of the al Qur’an Islamic Holy Book was revealed to free mankind from all forms of discrimination and oppression. Abstract

The gender sensitivity of judges towards women in court is crucial to ensure that judgments provide a sense of justice and accommodate the rights of wives after divorce. This article aims to analyze judges' considerations from philosophical, juridical, and sociological aspects in divorce judgments due to nushūz (disobedience) from a gender perspective, addressing two main questions: 1) how judges use a gender perspective in deciding divorce cases due to nushūz, and 2) what factors influence judges' decisions in divorce cases due to nushūz from a gender perspective. This research employs qualitative research methods, which is a case study design, with juridical and gender approaches. The primary data source is derived from the rulings of the Religious High Court of Kupang No. 009/Pdt.G/2015/PTA.Kp obtained from the Supreme Court of the Republic of Indonesia's website, and judge interviews as supporting data, which were analyzed using content analysis. The research findings indicate that from a gender perspective, judges exhibit gender bias in categorizing nushūz as if nushūz can only be committed by wives, whereas nushūz can be committed by both husbands and wives. Judges' interpretations of nushūz are still influenced by the content of the law, the culture of the law, and its structure of the law. This study implies that judges should undergo gender-based training or workshops organized by judicial institutions or universities to enhance their gender sensitivity in deciding legal cases, especially nushūz cases.

Abstract

Hadith of Professionalism: the Concept of the Head of State of the Prophet. The focus of this study is to analyze the characteristics of the head of state of the Prophet Muhammad when in Madinah based on a review of professionalism hadiths. The purpose of this research is to explain the role of the Prophet Muhammad in Madinah when he served as head of state and to find out the quality of hadith in the form of analysis of professional hadiths. This research approach uses hadith, philosophical and political criticism. The type of research used is qualitative, including primary data sources, namely data obtained directly from hadith source books and secondary data, namely obtained from the results of writings that have been systematized in the form of books and journals. The methodology used by this study is takhrij al-hadith and hadith criticism which is used as a tool for measuring the studyofhadith. The result of this research is that the hadiths of professionalism in this study are included in the category of sahih hadith and can be used as an argument as a study of the criticism of sahih hadith in the book of al-Bukhari, Muslim and Ahmad Ibn Hanbal. The conclusions of this study show that leadership hadiths on professionalism have accommodated the role of the Prophet Muhammad as head of state, because it is covered in prophetic leadership characteristics such as: the ability to carry out trust, equalize justice for society, realize the advantages and weaknesses of the self, be honest and the ability to fight against the enemy. The implementation of this paper is the position of the Prophet Muhammad (peace be upon him) cannot be separated from the guidance of Allah swt regarding the ability to lead so that success in the head of state when in Medina is conveyed through the professionalism possessed by the Prophet.[Fokus penelitian ini adalah menganalisa karakteristik kepala negara Nabi Muhammad saw ketika di Madinah berdasarkan tinjauan hadis-hadis profesionalisme. Tujuan penelitian ini adalah menjelaskan peran Nabi Muhammad saw di Madinah ketika menjabat sebagai kepala negara serta untuk mengetahui kualitas hadis dalam wujud analisis hadis-hadis profesionalisme. Pendekatan penelitian ini menggunakan kritik hadis, filosofis dan politik. Jenis penelitian yang digunakan adalah kualitatif di antaranya sumber data primer yaitu data yang diperoleh langsung dari kitab sumber hadis dan data sekunder yaitu diperoleh dari hasil tulisan yang telah disistematisasi berupa buku-buku dan jurnal. Adapun metodologi yang digunakan penelitian ini ialah takhrij al-hadis dan kritik hadis yang dijadikan sebagai alat bantu untuk tolak ukur penelitian hadis. Hasil penelitian ini ialah hadis-hadis profesionalisme dalam penelitian ini masuk dalam kategori hadis sahih dan dapat dijadikan hujah sebagaimana telaah kritik hadis sahih dalam kitab al-Bukhari, Muslim dan Ahmad Ibn Hanbal. Kesimpulan pada penelitian ini menunjukkan bahwa hadis-hadis kepemimpinan tentang profesionalisme telah mengakomodasi peran Nabi Muhammad saw sebagai kepala negara, sebab tercakup dalam karakteristik kepemimpinan profetik seperti: kemampuan dalam mengemban amanah, mengimbangi keadilan untuk masyarakat, menyadari kelebihan dan kelemahan diri, berlaku jujur serta kemampuan berperang melawan musuh. Adapun implementasi tulisan ini ialah posisi Nabi Muhammad saw tidak terlepas dari tuntunan dari Allah swt terkait kemampuan dalam memimpin sehingga kesuksesan dalam kepala negara ketika di Madinah tersampaikan melalui sikap profesionalisme yang dimiliki oleh Nabi.]

Abstract

This study examines the changing causes of divorce at the Religious Court of Bekasi between 2011 and 2020. Employing a qualitative approach, the study utilizes descriptive analysis of recorded divorce cases to explore these trends. The findings reveal fluctuations in the primary causes of divorce. Initially, economic factors dominated, but over time, moral and ethical issues, such as infidelity, domestic violence, and neglect of responsibilities, became more prominent. Subsequently, economic reasons reemerged as a leading factor, albeit with a smaller margin. Social issues such as ineffective communication, lack of mutual respect, and external family interference also contribute to divorce cases. These changes are influenced by the evolving social dynamics and modernity of Bekasi's urban society, where perceptions of family roles have transitioned from a primarily economic partnership to one emphasizing love, self-fulfillment, and emotional connection. This study highlights that social transformation and modernity significantly impact divorce patterns in Bekasi, with economic and moral-ethical factors alternately taking precedence over the past decade.

Abstract

This study investigates the interpretation of the Majelis Tafsir Al-Qur'an (MTA) regarding the obligation of Friday prayers for women, employing the analytical frameworks of Fiqh al-Ḥadīth and Maqāṣid al-Sharīʿah. MTA adopts a literal exegesis of QS. al-Jumuʿah: 9, asserting its universal applicability irrespective of gender. The study critically reevaluates the traditionally understood Hadiths to exempt women, interpreting them as providing legal flexibility rather than categorical exclusion. By applying sanad (chain of transmission) and matan (text-content) analysis, MTA integrates classical methodological rigor with contextual reasoning, thereby advocating a reformist yet tradition-conscious stance. This research highlights MTA's inclusive perspective as a significant contribution to contemporary Islamic legal discourse, aiming to promote enhanced religious participation and social cohesion. Nonetheless, the study identifies ongoing challenges, including contextual limitations and restricted mosque access for women. The findings underscore how MTA's interpretive model embodies a progressive rethinking of Islamic obligations in response to evolving social realities.

Abstract

The purpose of this research is to understand and analyze child marriages in Muslim-majority countries in Southeast Asia from the perspective of the Convention on the Rights of the Child. The research design used in this study is qualitative. The research nature is juridical-normative, referring to legal norms present in the legislations of Indonesia, Malaysia, and Brunei Darussalam. The research results indicate that using the CRC's concept of Child Participation in dispensations for underage marriage, it was previously shown that the concept of child protection encompasses a broad scope (O'Donnell), and the Convention on the Rights of the Child emphasizes that all actions taken concerning the child must be contextually appropriate, for the best interests of the child (Eekelaar). Therefore, this study shows to what extent the protection of children's rights regarding their participation in dispensations for underage marriage in Southeast Asian Muslim countries, is allegedly contradictory to the CRC's definitive provision on the age of the child. This research implies that it can help analyze the extent to which child marriages violate the rights of the child as guaranteed by the Convention on the Rights of the Child. It aids in understanding how cultural and religious factors influence the practice of child marriages in Muslim-majority countries in Southeast Asia. Additionally, the results of this research could stimulate further studies in the same or related domains.
