Abstract

Di Indonesia korupsi dikategorikan sebagai extra ordinary crime atau kejahatan luar biasa, sebab korupsi bukan saja dilakukan secara individu. Namun, dilakukan secara terorganisir, sistematis dan terstruktur oleh kelompok atau istitusi yang menyebabkan kerugian besar bagi rakyat dan perekonomian bangsa. Untuk itu penting dilakukan berbagai upaya pencegahan dan penanggulangan budaya korupsi dengan melibatkan berbagai elemen bangsa termasuk mahasiswa agar berpartisipasi secara aktif untuk mengawal berbagai isu-isu korupsi dan mengontrol berbagai kerja lembaga-lembaga negara dan aparat penegak hukum agar terhindar dari praktek korupsi. Dari sekian bannyak komunitas/ elemen masyarakat yang ada, kegiatan pengabdian masyarakat kali ini kami fokuskan pada komunitas mahasiwa Asal Manggarai-Flores-Nusa Tenggara Timur yang sedang menempu pendidikan di Kota Makassar. Kegiatan yang telah kami lakukan berupa peyuluhan hukum anti korupsi dan membangun gerakan bersama melawan korupsi. Kegiatan yang dilakukan ini menggunakan metode ceramah, analisis kasus, pemutaran video gerakan anti korupsi serta tindakan nyata berupa membentuk Forum anti Korupsi. Hasil kegiatan yang telah dilakukan adalah pemahaman dasar tentang kejahatan Korupsi serta meningkatnya kesadaran tentang pentingnya partisipasi melalui gerakan bersama melawan korupsi. Selain itu hasil yang dicapai adalah menanamkan nilai-nilai dan sikap anti korupsi bagi mahasiswa Manggarai yang ada Makassar.

Abstract

The essence of the  specific minimal criminal sanctions in the Anti-Corruption Act, as a means to prevent disparity in sentencing and as a deterrent effect for the corrupt. The formulation of a specific minimal criminal sanctions in the Anti-Corruption Act considered too small, so criminals are not afraid to do or repeat corruption. In the Anti-Corruption Act is not regulated on guidelines for the application of a specific minimal sentencing. Therefore, the Anti-Corruption Act needs to be reviewed with the aim to aggravate the minimal sentencing so can be a deterrent effect for the corrupt, and stipulate sentencing guidelines as a handle in the application of a minimal criminal sanctions.

Abstract

This writing speaks of strategic steps in eradicating the corruption in Indonesia. The out come of the discussions shows that there is a need for strategic steps to eradicate the corruption in Indonesia they are as follow: (1) There is the social movement to do ,t. (2) Po/Jt,cal networking to strengthen the ant1-corrupt1on movements; (3}The commitment of the P.Olfilcal party to eradicate the corruption; (4) To reform the anti-corruption law so that criminal sanctions are to prevent a person committing corruption; ( 5) Team working of law enforcer to investigate and prosecute for corruption; (6) People's supervision toward the apparatuses: (7) To increase the public service and to implement of good governance and clean government.

Abstract

Penelitian ini membahas tentang penerapan hukum pidana pornografi anak dan perlindungan kepentingan anak. Untuk membahas permasalahan tersebut dilakukan pengumpulan data dengan cara wawancara kepada penyidik Polrestabes Makassar dan pengguna warnet (CAFE) dan observasi non partisipatif terhadap responden pengguna warnet. Selain itu mempelajari dokumen dengan cara membaca dan menelaah berbagai dokumen yang relevan. Kemudian data tersebut diolah dan dianalisis menggunakan analisis kualitatif. Hasil penelitian menunjukkan bahwa: pertama, pada kenyataan bahwa UU Pornografi perlindungan anak berorientasi pada kepentingan perlindungan anak termasuk kejahatan pornografi anak.Namun ketentuan undang-undang tentang Pornografi mengandung kelemahan yaitu rumusan khusus sanksi pidana minimum tidak disertai dengan pedoman ancaman pidana dan minimal keterlaluan rendah atau ringan dibandingkan dengan ancaman pidana maksimal sehingga membuka terjadinya disparitas pidana. peluang. Kedua, Polrestabes, aparat Kepolisian Makassar belum optimal melakukan penegakan UU demi perlindungan kepentingan anak dari tindak pidana pornografi anak.Kata Kunci: Fungsionalisasi hukum pidana, Pornografi Anak, Perlindungan kepentingan anak. ABSTRACTThis research discusses the putting into functionof the criminal law for child pornography and the protection of the interests of the child. To discuss these issues is carried out data collection by means of interviews to investigators of Polrestabes, Makassar and users of internet cafes (CAFE) and non participatory observations against the respondents users of internet cafes. Besides, studying the document by means of reading and examining the various relevant documents. Then the data processed and analyzed using qualitative analysis. The results showed that: first, on the fact that the Pornography Act child protection is oriented on the interests of child protection including child pornography crimes. But the provisions of the law on Pornography containing weakness which is a special formulation of minimum criminal sanctions is not accompanied by the threat of criminal punishment guidelines and minimum outrageously low or mild compared with the maximum criminal threats so that it opens the occurrence of criminal disparity  opportunities. Second, Polrestabes, Makassar Police apparatus is not optimal doing the Act enforcement for the sake of protection of the interests of the child from the child pornography crimes. Abstract

This study examines the problems, the effectiveness of wiretapping (interception) on the internet using a web camera in the law enforcement of prostitution on line via video-converence. The aim of which is to gain the analysis of the effectiveness of wiretapping of the internet using web  camera in the law enforcement of online prostitution case trough a video conference on 17 years of age or older. Abstract

As the leading actor in the criminal justice system in Indonesia, a judge must engage in a dialogue with their conscience before deciding on a criminal case to ensure true justice for all parties. This article aims to analyze the functioning of judges’ consciences in their decisions within the criminal justice system in Indonesia. Therefore, a literature study was conducted. Data is collected by reading and tracing various relevant documents. Furthermore, the data were analyzed using descriptive qualitative methods. The results are as follows: first, conceptually, judges who have a conscience are constantly in dialogue with their consciences, and then they decide cases according to their sincere consciences. Second, in the context of criminal justice in Indonesia, judges are obligated to heed the promptings of their conscience every time they decide on a criminal case. This is because the ultimate goal of criminal justice is to uncover the truth and ensure justice for all parties, namely society, victims, and perpetrators of crimes. However, in fact, there are still judges who disregard their conscience and are easily influenced by extrajudicial powers, such as mass pressure and political interests. For this reason, it is necessary to submit several recommendations: (1) all parents should teach their children the importance of a simple, honest, committed, and responsible life because the family is a cell of society, a place for seedling law enforcement officials, including judges; (2) optimizing the role of the judicial commission in the form of policy support and adequate funds so that the institution can recruit prospective judges and professionally supervise the behavior of judges; (3) Judges who are involved in moral violations or abuse of power are subject to severe criminal sanctions to create a deterrent effect.
