Abstract

Indonesia’s territory has a lot of wealth in assets of marine resources and human resources. This wealth has become challenge for the Government of Indonesia to manage it. Nowadays, Indonesian marine is expected to be more developed, but in contrary, a lot of interest that should be regulating in the sea. The main questions that arouse are: how should government give an equation for Indonesian fisherman and how should the government put marine resources’ protection to supply the equation for natural resources. These questions will solve by a normative juridical study on the protection of natural resources and the resources of Indonesian fisherman. The study uses a descriptive analytical method for a number of regulations that apply in marine trade law and employment law. This research is also complemented by a literature approach in the form of Indonesian legal literature and marine journals to address the issues raised in this paper. The findings in practice prove that the government should give more attention for the fisherman’s welfare and protection related to fish catching. The objective protection for Indonesian marine resources is from regulated all the regulation to develop Indonesia economic from Maritime sector. It is all needed to make a new system in legal protection for Fisherman and Marine Resources in Indonesia.

Abstract

Expert testimony in criminal evidence is needed to explain a case clearly so that the judge can decide a legal case with full objectivity. In fact, experts who provide their statements are often used as defendants because their statements are considered detrimental to the defendant's position so that the defendant sues the expert to court. The approach method used is a normative legal research method, namely legal research conducted by examining library materials or secondary data. The approach used is a statutory approach, a case approach and a conceptual approach. Experts have immunity in providing their statements based on professionalism and good faith, so that the Expert cannot be prosecuted either criminally or civilly. If forced, there will be a weakening of the independence of the Experts and will disrupt the existing judicial system. However, if the Expert in providing his statement is not based on good faith and manipulates the data so that it benefits a certain party, then the Expert can be prosecuted through the PMH channel. In order to strengthen the immunity of the Expert, there must be a strict rule stating the protection of the expert who has good intentions.

Abstract

With the ratification of the prosecutor's law in 2021, it finally caused a polemic regarding the authority of the public prosecutor in filing a judicial review. The counter-opinion argues that the framers of the law did not understand the norms in the existing legislation. On the other hand, MK Decision No.33/PUU-XIV / 2016 which states that the review by the Public Prosecutor contrary to the code of Criminal Procedure is final and binding for anyone. Therefore, the prosecutor's authority in applying for judicial review is considered unlawful. But on the other side, the Internal Affairs of the prosecutor's actually took another view and strongly supported the authority for filing a judicial review by the prosecutor's under the new law. Based on this study, which uses normative juridical methods and legislative approaches and conceptual approaches, then with the ratification of the prosecutor's law in 2021, it is considered to provide more legal certainty for the authority of the public prosecutor in filing a judicial review and providing space for “justice” for victims and as an effort to correct and improve in realizing justice.

Abstract

Sexual crimes are a form of crime that is rife today. This can arise due to imbalances in the role of community oversight, weaknesses in law enforcement, and misuse of technology among the younger generation. It has transformed a form of conventional sexual crime into a modern sexual crime involving advanced technology and complicated syndicates. On the side of victims of sexual crimes, special handling is needed to solve sexual crime cases.  On the side of victims of sexual crimes, special handling is needed to solve sexual crime cases. This is done in the pattern of examination, submission of evidence, determination of suspects, even for trials that are carried out specifically. The victim needs to be protected, so a chemical castration is required. This study uses descriptive analysis methods for a number of regulations applicable in Criminal Law and Criminal Procedure Law. This research is also complemented by a literature approach in the form of Indonesian legal literature and legal journals to provide support for the implementation of chemical castration for sexual crimes. This paper shows that the Indonesian government should immediately impose chemical castration penalties against child predators. The Indonesian government must also ensure the certainty of the rights of children who are victims of child predators through chemical castration.
