Abstract

Renewable energy currently becomes one of the global issues. Not all developing countries are capable of inventing or making renewable energy technology. In this regard, the intellectual property serves as a hindrance. The present study aims to further identify hindrances in recreating renewable energy technological invention, as it is protected by intellectual property. This normative legal study reviews literature and other sources relevant to technology transfer, intellectual property, and renewable energy. It concludes that reengineering, as a developmental effort, is difficult to be done within the context of technology transfer. It is possible to perform renewable energy invention reengineering by applying specific stipulation that does not harm the inventor’s moral and economic rights

Abstract

Undang-Undang Nomor 27 tahun 2022 Undang-Undang Nomor 27 tahun 2022 tentang Perlindungan Data Pribadi (UU PDP) adalah instrumen hukum yang melindungi data pribadi masyarakat Indonesia dari penyalahgunaan, termasuk praktik phising. Penulisan ini bertujuan untuk mengetahui sejauh mana efektivitas peran pemerintah dalam menanggulangi phishing di Indonesia melalui UU PDP. Penelitian ini akan menganalisis implementasi UU PDP dalam menanggulangi praktik phishing dengan menggunakan metode hukum normatif. Hasilnya menunjukkan bahwa UU PDP tahun 2022 melindungi data pribadi, termasuk informasi secara merinci yang menjadi target phising. Lembaga Otoritas Perlindungan Data Pribadi akan bertanggung jawab dalam pelaksanaan UU PDP, memberikan sanksi administratif, mendukung penegak hukum, dan menilai persyaratan transfer data pribadi ke luar Indonesia. Sanksi pidana termasuk penjara atau denda diterapkan untuk menanggulangi phising, serta sanksi administratif seperti pencabutan izin usaha dan/atau pembekuan kegiatan usaha sebagai efek jera. UU PDP tahun 2022 penting dalam melindungi data pribadi dari phising, tetapi perlu perkuat pelaksanaan dan kerja sama antara lembaga pemerintah terkait agar efektivitasnya meningkat, sehingga masyarakat merasa aman dalam transaksi online dan menjaga data pribadi mereka.

Abstract

Kemajuan teknologi yang muncul di dunia memaksa manusia untuk terus beradaptasi dan berinovasi. Salah satu terobosan teknologi yang paling inovatif adalah kecerdasan buatan atau artificial intelligence. Ketiadaan payung hukum dapat menimbulkan penyimpangan penggunaan artificial intelligence yang merugikan orang lain seperti penggunaan wajah tokoh masyarakat, yang dijadikan parodi ataupun suara yang dibuat sama seperti tokoh masyarakat. Tujuan penelitian ini ialah penyalahgunaan artificial intelligence terhadap tokoh masyarakat dalam konten di media sosial berdasarkan perundang-undangan di Indonesia. Metode yang digunakan dalam penelitian ini adalah pendekatan peraturan perundang – undangan (statute approach), dan pengkajian terhadap norma – norma dan kaidah – kaidah yang berlaku di Indonesia. Hasil Penelitian ini ialah pengaturan artificial intelligence masuk kedalam ranah Undang–Undang Informasi dan Transaksi Elektronik, selain itu penggunaan Artificial Intelligence juga diawasi oleh Badan Siber dan Sandi Negara serta pihak kepolisian pun menerapkan mempunyai divisi siber polri untuk menangani kasus yang bersifat elektronik dan digital. Untuk perlindungan terhadap public figure yang dirugikan karena data pribadinya dipergunakan sebagai artificial intelligence dilindungi di dalam Undang-Undang Perlindungan Data Pribadi dan dapat di indikasikan pada unsur pencemaran nama baik dalam ruang lingkup Kitab Undang-Undang Hukum Pidana.

Abstract

The practice of sailing permits encounters challenges when the issuance of relevant sailing permits does not align with the designated jurisdictional authorities, as shown in the case involving KM Karya Indah. This study aims to identify the underlying causes of disharmony between Central and Regional Government Regulations regarding jurisdictional authority over sailing permits. Additionally, the study seeks to establish the proper approach to managing sailing permits based on the principles of balance and public interest. The research employed a normative legal research method, utilizing both the Statute Approach and the Conceptual Approach. Primary and secondary legal sources were employed as research materials. The findings indicate that within the domain of jurisdictional authority related to sailing permits, there is a lack of congruence between Central and Regional Government Regulations. In particular, the regional regulations necessitate that the processing of sailing permits should occur through the respective region first, under the jurisdiction of the Governor as the responsible authority. However, the practical application deviates from this structure, as the sailing permit processing is directly pursued at the central government level, and endorsed by relevant parties. The issuance of the pertinent sailing permits should align with the designated jurisdiction and the respective authorizing entities to avoid disharmony among regulations. Such harmonization is necessary to maintain balance and uphold the public interest, which serves both the permit applicants and the broader society. Keywords:

Abstract

The current phenomenon is that there are many cases of the use of air guns and airsoft guns whose true purpose is for sports activities, to be a tool to frighten, terrorize and injure other people. Another thing, the circulation of these types of weapons in the community, deserves attention from law enforcement, because they can cause various incidents. This study uses the normative juridical method, which is to carry out a juridical analysis regarding the ownership of air guns and airsoft guns in the laws and regulations in Indonesia. The results of the research are: the implementation of supervision is carried out by the police; supervision is carried out by means of checking and securing the implementation of permits, and carrying out investigations and investigations in the event of irregularities; also give warnings/sanctions and; as well as revoking licenses and withdrawing weapons. Owners of air guns and airsoft guns are obliged to: store firearms in the warehouse of the Indonesian Shooting Association (Perbakin) or Clubs or in a safe place when not in use; obey the rules; extend the license when the validity period expires; report to the police if the weapon is lost; do not bring weapons to locations that are not permitted; do not use for other purposes; and put an orange tip on the weapon. Suggestions that can be given include: The function of granting licenses in the sale and ownership of air guns and airsoft guns, should be more stringent, especially in terms of conditions that must be met; air guns and airsoft guns must have a manual and explain the dangers if misused. There are criminal sanctions against owners of air guns and airsoft guns who carry, display, and use these weapons in an inappropriate manner.
