Abstract

ABSTRACT There are many irregularities in life that appear in the form of crimes and violations of the law, especially young people, one of whom is still a student, illegal acts often occur such as murder, violence, persecution, beatings, and many other illegal acts among them. Due to the influence of the bad social environment and the lack of parental supervision of children, many people's behavior is not well controlled. There are many rules that regulate various people's behavior, one of which is persecution behavior that results in the death of a person as stated in Article 351-353 paragraph (3) of the Criminal Code. The existence of abuse by the perpetrator is indicated for the pain of a person, not for the purpose of his death, so it must first be proven that the element of intent is to cause the death of the person. Based on the results of the research and discussion, it was concluded that the acts of persecution committed by students against the death of a person were based on the fulfillment of the elements contained in Article 351 paragraph (1) of the Criminal Code in conjunction with Article 55 paragraph (1) of the Criminal Code against perpetrators who participate in the persecution that results in the death of the person. Keywords: Criminal Liability, Crime of Persecution, Criminal System. ABSTRAK Banyaknya penyimpangan dalam kehidupan yang muncul dalam bentuk kejahatan dan pelanggaran hukum terutama golongan kaum muda yaitu salah satunya yang masih berstatus mahasiswa, sering terjadi tindakan ilegal seperti pembunuhan, kekerasan, penganiayaan, pengeroyokan dan masih banyak lagi tindakan ilegal lainnya di kalanganya. Karena pengaruh lingkungan sosial yang buruk dan kurangnya pengawasan orang tua terhadap anak, mengakibatkan banyak perilaku masyarakat yang tidak terkontrol dengan baik. Terdapat banyak aturan yang mengatur berbagai perilaku masyarakat salah satunya perilaku penganiayaan yang mengakibatkan matinya seseorang sebagaimana Pasal 351- 353 ayat (3) Kitab Undang-Undang Hukum Pidana. Adanya penganiayaan pelaku sebenarnya ditunjukan untuk rasa sakit seseorang saja, bukan untuk tujuan kematiannya sehingga harus dibuktikan terlebih dahulu unsur kesengajaannya untuk membuat adanya kematian seseorang tersebut. Berdasarkan hasil penelitian dan pembahasan diperoleh kesimpulan bahwa perbuatan penganiayaan yang dilakukan oleh para mahasiswa terhadap matinya seseorang didasarkan atas terpenuhinya unsur-unsur yang terdapat dalam Pasal 351 ayat (1) Kitab Undang-Undang Hukum Pidana juncto Pasal 55 ayat (1) KUHP terhadap pelaku yang turut serta melakukan penganiayaan yang mengakibatkan matinya seseorang tersebut. Kata kunci : Pertanggungjawaban Pidana, Tindak Pidana Penganiayaan, Sistem Pemidanaan.

Abstract

Phishing in Indonesia presents significant risks to privacy and data security. This study employs a normative juridical approach to analyze the protection of personal data, with attention to both preventive and repressive legal mechanisms. It assesses the effectiveness of Law No. 27 of 2022 on Personal Data Protection in combating phishing, alongside measures of digital literacy and law enforcement. The findings indicate notable progress but highlight persistent challenges in enforcement capacity, public awareness, and international cooperation. The study recommends strengthening enforcement, expanding cybersecurity education, and enhancing cross-border collaboration to advance data protection.

Abstract

The rapid rise of interactive digital games has led to virtual transactions in which players purchase in-game items with real money. This becomes problematic when children, as dominant users without legal capacity, are involved. Game designs often exploit microtransactions and loot boxes that trigger impulsive spending, making children targets of economic exploitation. This study examines the legal liability of digital game platform providers under Government Regulation No. 17 of 2025, which implements Articles 16A (5) and 168(3) of the 2024 ITE Law. Using a normative juridical approach, the study analyzes regulations and literature. Findings highlight the need for stronger platform obligations, including age verification, parental consent, bans on covert practices, and tiered sanctions. Active state regulation and collaboration with platforms, parents, and society are crucial to ensuring a safe and child-friendly digital environment.
