Abstract

Artikel ini bermaksud mendiskusikan (kembali) status ahl al-kitāb dalam konteks hukum perkawinanya dengan seorang Muslim. Meskipun secara tematis kajian ini telah banyak dilakukan oleh para ahli, pendekatan tafsir yang digunakan dalam tulisan ini menjadi faktor pembedanya dan diharapkan menghasilkan pemikiran yang unik. Secara umum, sesuai dengan khiṭāb al-Qur’an, bahwa yang disebut ahl al-kitāb adalah umat Yahudi dan umat Nasrani. Namun sebagian ulama memperluas cakupan makna ahl al-kitāb kepada semua pemeluk agama yang kitab sucinya diduga keras berasal dari Allah. Islam tidak melarang umatnya untuk melakukan perkawinan dengan ahl al-kitāb, tetapi yang menjadi masalah siapa yang dikategorikan ahli kitab pada zaman sekarang. Perdebatan ini menjadi akar perbedaan pendapat di kalangan ulama sehingga ada ulama yang membolehkan dan ada yang mengharamkan atas dasar nilai maṣlaḥat yang dikandungnya. Namun demikian kebolehan menikahi perempuan ahl al-kitāb bukan merupakan anjuran, sehingga dampak positif dan negatifnya harus dipertimbangkan secara mendalam oleh umat Islam.***This article intends to (re) discuss about the position of ahl al-kitāb woman in the legal context of her marriage with a Muslim. Although thematically, this study has been carried out by experts, an interpretation approach used in this paper is expected to be as distinctive and produce a unique thought. According to khiṭāb Quran, that are called ahl al-kitāb are Jews and Christians. But some scholars expand the meaning scope of the ahl al-kitāb for all faiths whose holy book allegedly from God. Islam does not forbid people to marry with ahl al-kitāb. In other side, who is categorized scribes today is the problem. The controversial would be the root of the difference opinions among scholars that there are scholars who allow and forbid anyone on the basis of beneficiaries contains. However, the ability to marry the ahl al-kitāb is not a recommendation, so the positive and negative impacts should be considered in depth by Muslims.***Keywords: ahl al-kitāb, munākahāt, tafsir al-Qur’an, maslahat

Abstract

Ahl al-Kitab is a very popular term but it is still not clear to those who are meant by the term and it is always debated by Islamic scholars, both classical and contemporary. Is the term identical with Jews and Christian only or it also include other believers, like Zoroastrian, Shabi’in, and even Hindis or Buddhist? Discourse of the coverage of the term is certainly very interesting to discuss because it can give wide law implication in social life like marriage with them and their slaughtered animal.

Abstract

As the perfect creature, human beings have naturally good nearness and harmony either with their God or among them. This natural tendency, however, is often depraved by themselves by committing a sin or break norm. The fadedness of this natural tendency makes them suffering in their whole life. Therefore, there is no other way unless seeking medicine and solution, i.e. repenting or al-taubah al-shâdiqah or taubatan nasûha.

Abstract
